Why Isn't The Right To Be Wrong In The Constitution?
Possibly the closest that the founders came to identifying the foundational right to be wrong is in the Declaration of Independence, section two: '...they are endowed by their Creator with certain inalienable Rights, that among these are Life, Liberty and the pursuit of Happiness'. "pursuit of happiness".
Obviously what makes me happy may not be what makes you happy. You may even find my idea of 'happiness' to be distasteful or even clearly wrong.
It may even be that the rights to life and liberty are dependent on the 'happiness' clause, which is basically the right to exercise one's free will. Liberty is free will, and for the pre-deterministist, even the right to life must be seen as the right to make decisions, right or wrong, even if one is just following an unconscious script.
