Massachusetts State Election Fraud Lawsuit To Be Filed; Injunction Requested to Prevent Seating of Romney Appointed Delegates

If you haven't heard, the MA Republican party has recently decided to deny certification to around 17 delegates/alternates over some unprecedented technicalities. Many of these are liberty supporters that you may have helped elect at the MA district caucuses on April 28th.

Due to the results of the state primary, all the delegates were bound to Romney on the first ballot of the National Convention, but the Liberty delegates still wanted to go in order influence the party and spread the message of liberty. The party rules do state that after being elected at the caucuses, the delegates have to be certified by the candidate who they are bound to, but it also says that the candidate must have "just cause" to throw them out, and the decision must be upheld by the Allocation Committee. The state party used this vague rule to setup arbitrary and unprecedented requirements of the delegates, including a poorly worded affidavit that everyone was required to sign. The affidavit required the delegates to swear under penalty of perjury, that they would indeed vote for Mitt Romney on the first ballot of the convention. However, at the caucuses the delegates had already publically agreed to uphold state law and vote for Mitt Romney on the first ballot at the national convention. Yet the state party still took the unprecedented step of requiring the signed affidavits, and gave very little time for the delegates to review the document and return it by their arbitrary deadline. In addition, the affidavit contained several material defects. Many delegates tried to still comply with the demand by returning a slightly edited version which tried to correct the the errors and make the affidavit clearer. However, even though the affidavit was an arbitrary hurdle, never used before, and not in the rules, the state party refused to accept anything but their poorly worded version, by their short deadline.

Even Michael Graham, who in the past I've heard strongly criticizing Ron Paul and his supporters, agrees that the MA GOP has been using some dirty tricks:

This seems to be a clear message from leadership within the Romney campaign and the Massachusetts Republican establishment that they do not want or care about your vote in November, or your presence in the party. So we need your help to send them a message.

How you can help:

3) Contact you members of the MA GOP state committee. Go here where you can find their info.

Let them know that you disapprove of how the party has refused to certify so many duly elected delegates over minor technicalities that are not in the rules. As well as refusing to count the provisional ballots. You can get more info here: http://www.malibertycaucus.com/?page_id=902 The ONLY way that these Republican Party leaders will realize that they need to move towards Liberty is if YOU let them know. Otherwise, they will pretend it is business as usual, and ignore the activists that are promoting Liberty principles.

This fight will continue, and the duly elected delegates that have been thrown out will go all the way to the convention in Tampa in order to formally appeal being de-certified. In addition, a letter has been sent to the MassGOP telling them that there is a state lawsuit being filed for election fraud and asking for an injunction from seating the delegates. Still, these liberty delegates could definitely use your help to apply pressure to the right people. Some in the leadership of the MassGOP already support us, so please remember that and be careful to not offend allies. For those that may oppose us, or are neutral, those are people we want to win over. It is good to be direct and adamant about your position, and explain that their actions are alienating potential supporters and causing them to loose credibility, but name calling and rudeness will not help the cause.

President Ron Paul!

I may be a little late

but I just contacted Brad Jones the head of the Romney campaign in Massachusetts. After raking him across the coals I told him that being a National Delegate to the RNC I would correct one of his mistakes by voting Ron Paul first ballot at the RNC.
I surly hope that the long arm of the law will jail these people. What burns me to no end is the fact that those delegates had already pledge to support Romney at the RNC. But oh no that was not good enough for the Massachusetts GOP or Romney, they wanted it signed in blood.

To Mass. RP delegates:

I have asked more than once: Why have you not joined the national legal case? Evidently, I understand you're posing a state legal case, which is great. But, why not join in the national one as well? Why would that be so detrimental? I can't think of one reason that it would be. Furthermore, there was a point made about people hiring attorneys at the local level. When they are expensive as they are this simply makes no sense. So, what's the real reason?

People say that the Lawyers for Ron Paul could be a bad thing. People right now they are all we have left. If you have not realized it Ron is out. We do not have five states with plurality and he can not even be nominated. So how is a law suit on down the line filled in Massachusetts going to get Paul on the ticket? Before that gets settled the RNC will have been over for two years. I don't care if the Lawyers for Ron Paul are the biggest crooks in the world. We have to go with them. If Judge Carter of the ninth circuit were to rule that all delegates are unbound then we can really put some heat on the Republican Party. Will he? I have no earthly idea but as I said right now this is our last straw and we best take it. Also you delegates in Massachusetts best climb on board. What do you have to loose? You have everything to gain and nothing to loose.

Now that is really some good advice

Lets say the delegates from Massachuetts hire their on Lawyers and some where down the road in 2016 they win. Sure it will still do some good. But what about now? What are we going to do right now? The RNC will come and go, RP will not be nominated and will not have his 15 minutes and Mitt Romney and the Republican Party will die laughing. So we loose a National Law suit, so what. If we loose we loose no matter if it is now or two years down the road. If I am going to go for it I am going to do it right now where it might do some good. I mean has anyone even stopped to think that we could just win. And if we loose now we would lose down the road so I say go for it.

Filing complaints and local charges is NOT expensive, and we need to do it now!..(we:being the affected delegates).

A chance at individual personal action is an empowering conceptualization.

And the "numerous, individual actions" will effectively "overwhelm" the opposition.

As a side note;
I've spent years with lawyers, waiting for actions,or motions on my behalf, only to find they were unprepared, and the courts were painfully slow in moving things along.

That's precisely why a complaint made out to the RNC and a "small claims" court date are so desireable...not to mention a criminal complaint to the DA...especially since they are obligated to investigate.

I'm sorry I'm being repetitive but I was wondering

if the Mass. RP delegates will join the national lawsuit? If not, WHY? I really don't understand why this hasn't happened, but perhaps there's reasons I don't understand. It is my understanding that federal law is stronger than state law, so why not join the lawsuit along with what they are already doing?

This isn't how it is suppose to work. Everyone at the local level should be suing with their own lawyers, and it should work its way up to federal lawsuits from there. Sorry if you thought different.

Better hurry is not the right two words

Lets see the RNC is the last of August. It is now July 17. Well darn we have about a month and a half to push this from the state courts all the way to Federal court. I agree go ahead and sue them white eyed but do any of you know how slow the courts work. The deal in the ninth circuit is coming up on Aug 6 and that could have time to do some good but what you are going with is not going to help Ron Paul in the short term. It takes a court clerk five days to put paper into a printer. First they have to get coffee and then they need to go to the bath room and then they have to stop in the hall and talk for two hours. Then the Judges calender is full because he has to take two weeks off for that trip to the Bahamas. We will grow old waiting on this to go from state court to Federal court. Obama will have done his last four.

Yes, but where in God's name will all the money come from?

Look how hard everyone scrapped to fund Nebraska? And some delegates are really struggling to get the final money they need: money is moving in slow motion, now.

So, the delegates can join a case for FREE? Why would there be even the slightest resistance?

I was wondering what you thought of all the court costs and

filing fees? I mean where are the Paul supporters, some unemployed, several put their business' on hold, Dr's offices closed, donated their entire savings, 401k's etc. to the campaign, went to work full-time for the campaign with little pay, or volunteered full-time with no pay. How are these people who were abused supposed to pay for individual law suits from every state and county where corruption was continued and the court costs involved?

People cannot just "get their own lawyer"! They're very expensive and many people can simply not afford one, which is one of the MAIN reasons that I asked why they were not jumping on board with the national legal case. Why not? There has YET been no good answer to that question and I have asked NUMEROUS times and still NO real answer. Any Mass. delegates are very welcome to ANSWER the question.

1 delegate or 10 million, it matters not. If the judge is fair than he will base his case on the legal standing, nothing more. You have plenty of delegates on-board already, more will not make a difference in the case. Good luck!

As of the most recent conference call by the......

Lawyers for Ron Paul the 17 Mass. individuals unduly removed as National Delegates and alternate delegates had not contacted the lawyers to become plaintiffs as a part of the Federal lawsuit filed. There were evidently (per Richard Gilbert) a couple of individuals from Mass. whom did contact the Lawyers for Ron Paul but the majority had not as of the recent conference call and he (Richard Gilbert) had quoted that "They should be ashamed of themselves". He stated that he felt they were letting down so many of we, the Ron Paul supporters. So, anyone from Mass. whom was duly elected as a National delegate and alternate National delegate, the Lawyers for Ron Paul are awaiting your hopeful response/contact to become plaintiffs. This is a Federal Lawsuit filed that could drastically change this election by breathing new life into Ron Pauls campaign. They (the Lawyers for Ron Paul) truly believe that many in Dr. Paul's campaign staff (i.e. Jessie Benton) are saboteurs. This is for unduly removed National delegates and alternate delegates in several other states as well. Please, contact these Guys.

What lawyers are working on it? From how it is written, it seems to be a State suit with local lawyers, but it isn't obvious by how it is worded.

If Mass had to

re seat the original delegates would that clinch the 5 states?

no

They had 16 of 41 before the inquisition. So restoring all still doesn't get to a plurality. If all delegates were restored and provisional ballots were counted, I believe that could/would get them to 20 of the 41. Even if it hit 21 of the 41, though, they're still bound to Romney and they're going to vote for him. So it's unclear as to whether that would officially count as one of the 5 (if it does, then Nevada and Oregon would count as well, so Ron Paul would easily hit 5).
