Parent Alert: A Danger At School

As a parent of four kids, two of whom are in the public school system, I am always on alert for dangers to my children from a source many may not consider - the school system. There are direct threats, that are easy to see, and there are indirect threats, which are hidden but often do more damage in the long run. We as parents put our trust in the school system. We rely on it to protect our children, while educating them. The school system is likely unaware of many of the indirect dangers faced by children today due to poorly drafted or worded legislation, but it is the job of parents to police the schools and institutions that have access to our children.

There is a lurking danger to the consolidation of records our government is attempting to impose. When your health care records are tied to your educational records - which are tied to your employment records - which is tied to your financial records - you are in danger. The danger is that a data breach exposes everything about you in one step. Another danger is that your employer knows all your health records, or your school knows your financial records, or your bank knows your educational records - you get the idea. Anyone with access to part of this unified record may get access to all of it. If your child is counseled for behavior issues at age 10, will that stop them from getting a job at age 30? I don't know, but that should not be a situation they face. There are many reasons we keep our health, education, financial, and employment records private - and separate. The disclosure of such records should be only done by the person in the record, and only the part they wish to disclose. We have a right to our privacy - and that right is being eroded.

You may argue that HIPAA protects your child's privacy while in a school environment. That is what I believed, until I heard a presentation by ROPE - Restore Oklahoma Public Education. I have independently investigated what I heard, and I was shocked. Schools that receive funds from the US Department of Education - which means all public schools - are NOT subject to HIPAA. They are subject to FERPA. Read this paragraph, from a guide on HIPAA and FERPA by the US Department of Health and Human Services (HHS):

V(1.) Does the HIPAA Privacy Rule apply to an elementary or secondary school?

Generally, no. In most cases, the HIPAA Privacy Rule does not apply to an elementary or
secondary school because the school either: (1) is not a HIPAA covered entity or (2) is a HIPAA
covered entity but maintains health information only on students in records that are by definition
“education records” under FERPA and, therefore, is not subject to the HIPAA Privacy Rule.

OK - so FERPA protects them, right? After all FERPA requires the consent of the student for such records to be released, or the parent/guardian of the student - except for this long list (34 CFR 99.31). You could drive a truck through that long list of exceptions. The bottom line is that I don't want my children's medical records tied to their educational records. So, how do you prevent this from happening? I will give you two examples of how to opt out.

First, there are all sorts of dire warning that you must vaccinate your children for all sorts of things or they can't enroll in school. The letters scream that it is the  law. And they are right, there is a law saying you must vaccinate, except they are wrong, there is an legal exception for medical, religious, or philosophical grounds. The government cannot force you to take a shot. Here is the Oklahoma Law covering that:

70 Okl. St. § 1210.192 (2007)

§ 1210.192. Exemptions

Any minor child, through the parent, guardian, or legal custodian of
the child, may submit to the health authority charged with the
enforcement of the immunization laws of this state:

1. A certificate of a licensed physician as defined in Section 725.2
of Title 59 of the Oklahoma Statutes, stating that the physical
condition of the child is such that immunization would endanger the life
or health of the child; or
2. A written statement by the parent, guardian or legal custodian of the
child objecting to immunization of the child; whereupon the child shall
be exempt from the immunization laws of this state. 

This year, I will be submitting a written statement and citing this law, declining to disclose whether I have vaccinated my children or not. Whether you choose to vaccinate or not is a decision between you and your child's pediatrician. It is your right to exclude the school from that information in the State of Oklahoma.

Second, you should be aware that the schools perform psychological counseling. Since this is considered medical treatment (mental health), it falls under medical records. As such, the school is required - by law - to obtain parental consent to participate. My children will NOT be allowed to receive counseling at the schools, for any reason. Any counseling they receive will be done by a counselor of my family's choice and paid for privately, so there is no danger of such a record harming their future educational or employment prospects. It is the only way I know of to guard their privacy - which is my duty as a father.

Last year, my oldest daughter began middle school. The counselors went to each classroom, recruiting students for group counseling. My daughter joined up, thinking it would be fun. Not only did we not consent, we had a very long discussion about why we declined with the head of counseling for the school district (Deer Creek). After all of that, a month later we received a phone call from her math teacher, telling us she was falling behind. The reason given was she was missing a lot of class. This was news to us - it seems she was in counseling AGAINST OUR WISHES. A very angry phone call to the Vice Principal of Deer Creek Middle School rectified the situation. I should point out that my wife has a clinical license in counseling (LCSW) and is more educated and certified than any of the counselors at the school. IF our child needs counseling, WE will determine it and it will certainly NOT be group counseling at the school. They are lucky I didn't sue them - but I wonder if other parents have children in counseling and don't know it is happening? That is some serious liability for the school system, and I sincerely hope this example is an isolated incident.

Protect your children. Be aware of the danger to their privacy. Opt out of notifying the school about vaccinations. Decline treatment at the school, and use your family doctor or pediatrician. Educate yourself on your rights, and on the rights of your children. If they choose to allow their records to be combined, as an adult, that is their decision - but make sure they have the choice.

It is time the schools focused on education. The health care of our children - both mental and physical - is the right and responsibility of us as parents, not the state.

There is another dangerous

There is another dangerous personal records collection threat to Americans. Facebook. Unfortunately, people volunteer their data in this case.

This is true!

I also know people who decided to get rid of their facebook. Not because they had anything "bad" on theirs, but because the people who were listed as their friends had questionable posts or pictures. People don't realize that a potential employer will judge those associated with questionable characters as well. It's all so not fair, but that's what they do.

Can You Get To See Their "Cumulative Records"?

I remember when in the early elementary grades in public school, my parents - quite informed back in the early 60's! - used to go to the school, talk with the principal, etc., and try to get hold of their "cumulative records" on me. I do remember that they first denied their existance, then I believe when they couldn't deny it anymore, may have refused to let my parents see what information they had on me.

These are records that are kept throughout a child's school years - I believe still inaccessable to parents - that can have a major impact on how that child is "branded" throughout those school years and possibly even into the job world. (I don't know if they are accessable to parents today.)

It's beyond me how any Ron Paul supporter could send his/her...

child to the public (aka Government) school. With all due respect, it is a very hypocritical (not to mention dangerous) thing to do as it goes against everything we stand for. If a free lunch at noon is an entitlement program--so is a free math lesson at one.

It's not free...

I pay tons of taxes to support this school. I moved to a very expensive part of town due to the school district, and purchased a home here. I pay thousands of dollars a year in property taxes to support this school and district.

With that being said, I am considering selling my home, buying a shack, and either homeschooling or private schooling the kids. It depends on the opinion of my wife which way we go - we are also looking for nearby rural properties to get out of town and practice as much self-sufficiency as possible.


Wise decision that you may not truly appreciate for another 10 or 15 years.

I know of what you speak - beautiful home, shiny new schools, taxes beyond your wildest nightmare. Go for shack that is filled with the love of parents for their children - and the love from the children for their parents who care about them.

You can't go wrong with that combination.

However, do try to find a shack with indoor plumbing. ;)

yes, i understand...

"there is no such thing as a free lunch". but the schools are supported through forced taxation, which is one reason i don't participate (they take a lot of federal money too). i pay for the schools in my area, but so do my neighbors who don't have children. also, just as in every government program--there are chains of bondage attached (main one being the possibility of losing the hearts and minds of your children--gov is banking on this one).

I wish you well in your endeavor. we've been living in a shack, homeschooling, homesteading, etc. for about 5 years now. It's VERY HARD, but very rewarding.

The rural shack is the way to go.

Don't have much money in it, and it's almost "judgment proof"
Keep all private assets private, as much as possible.
Grow food, and preferably have a water source(spring or well) on the land.

They don't have much to tax you on, don't have much they could take from you, and you are not supporting the beast.

Home School

As a parent of three, who are all out of school now, my last child never darkened the door of public school.

Even so, the private schools (including "Christian" ones)try to incorporate the indoctrination programs from the public schools.

I spent innumerable hours of my life going head to head with the public school board. At one meeting I thought the crowd was going to lynch me - for telling the truth. Imagine that.

What I kept hammering repeatedly, meeting after meeting, year after year: IF the child does not have a good base on which to build - you will cripple them for life. READING, WRITING and ARITHMETIC. That's what they need to know - teach it - and teach it well. Look back at what worked in the past - reproduce it.

Every hour they spend on social engineering and the like - is another hour the children won't learn those three most important subjects that will last them, literally, a lifetime.

Too, please don't be deceived - unless you are sitting there with your child 24/7 - there is so much more going into their hearts/minds that you will never be able to extract.

Home school, my friend, that's the only way. Look around - there are home school support groups everywhere.

Many who have "graduated" from public school are illiterate (except for the ability to text and create a facebook page). They were passed from one grade to the next without mastering the skills to do so.

Just sit in a college freshman Algebra or English class...very discouraging.

Functional Illiterates

You are right, joeneesima - they can function, but they're functional illiterates. When they text, they use "cyber speak" (Example: R U 4 RP?).

I was one of thirteen English tutor's in college. The incoming Freshmen class had over 70 students who did not pass the English entrance exam. Uhm - they had just graduated from High School. One of my students wrote a two page story - all of it in one paragraph. Oy!

Home-schooling can't be beat. If you think you can't afford it - think again. You can't afford to let the government teach your child revisionist history, "creative" spelling, no penmanship at all, along with all of the brainwashing they can possibly stuff into their minds and hearts.

Most things I learned I

Most things I learned I learned on my own. Subjects that interested me, I researched at the library (pre-Internet). Some subjects I read every book available in that section of the library.

Hiring from outside the U.S.

Many college freshmen are in need of remediation in math and writing. This passing from one grade to the next without mastery in skills continues from high school to college. It's all fine and good so long as you remain within the artificial construct of the education system. It's not necessarily so good once you leave. We have unemployed college graduates at the same time that employers are hiring from overseas. Adding insult to injury, this occurs even with the teaching profession, the industry (and I do mean industry) that's responsible. From a USA Today article in 2008: "As far back as five years ago [2003], the National Education Association estimated that up to 10,000 foreigners already were teaching U.S. students in primary and secondary schools, mainly to fill vacancies in math, science, foreign languages and special education." It's not that there are a shortage of teachers, just a shortage of QUALIFIED teachers. The New 3 R's

Thank you for pointing out that even parochial schools can reflect the same problems as public schools. In no small part it's because parochial school teachers graduate from the very same teacher education programs as public school teachers. These days, so-called teacher training is a farce.

I agree about the importance of readin', writin', and 'rithmetic. Because of misguided elementary school education that neither 1) gives children a good grounding in those three SKILLS, nor 2) fosters an APPRECIATION for language, mathematics, history, and science, by junior high grades, in all subjects, education is reduced to the new 3R's, mind-numbing Repetition, Reinforcement, and Review.

There are some worthy private schools, Waldorf elementary schools, for one (I'm saying from firsthand experience and years of comparison with public school curriculum & methods); many home-school parents avail themselves of curriculum info and materials. (Google Waldorf homeschooling.)

When my Son was in middle school the counselor called me to schedule a "sit down" with all his teachers. They all proceeded to tell me that my Son had ADD, was suicidal and needed to be put on medication immediately. I asked them which one of them went to college and was certified to make that assessment of my Son at which point his Language Arts (what use to be English) teacher said she knew because her Son also had ADD. I informed them that I would contact my Son's pediatrician and work from there.

I did so and the Pediatrician suggested a few sessions with a psychologist to just vet out the "suicide" assertion. The school insisted that I send them a copy of the psychologist's report..which I refused.

My Son is now an adult..never took medication for any type of mental issue and he is employed, happy, and as much as any of us..well adjusted.

Five years after that my Daughter was entering middle school. She brought home paperwork the first week of school concerning the issuing of lockers for students. Imagine my surprise and horror when as I read it I found a stipulation that says any female school faculty member can take my Daughter aside and give her a FULL cavity search if they suspect her of carrying contraband on her person as long as they have another female faculty member act as a witness!(I don't even have to be there..if they "can't reach me")
I'm shortening the details for the post..but that is the basic part.

Of course I amended this paper before I signed it, stating that if the school felt my Daughter was some how a danger to the other children or carrying something illegal then she is to be released into police custody. (I felt I'd have a better shot with the police not searching a minor without a parent present).
The Principle of the school called me after getting the paperwork back to inform me that I could not alter the paper in any way due to the school's lawyers drafting it that way. I informed him that any contract can be amended until agreed upon and if he wanted, we could sit down with the school lawyers and my own to hash it out.

They let it stand..and the following year when my youngest Son entered middle school I got a call from the Principle saying that he already knew I'd be amending the paperwork but that he just wanted to touch base to let me know that neither of my children would be bodily searched.

So yes...you really do have to read every stupid paper they send home..and question everything that your child does while in their guardianship.

When two of mine were in Junior High ("middle school" hadn't been created quite yet) they showed mine a "PG" movie. Of course my children told me about it. Of course I stormed the "castle" and asked the teacher what they thought that "P" in the "PG" stood for? Why wasn't I asked? Why was there no permission slip?

Then I stormed the School Board meeting. I asked why they were allowing teachers to show the children "PG" movies without the Parents Guidance?

The head of the School Board told me it was due to their policy of "Loco Parents" (allegedly they were standing in the place of the parent when the parent was absent). I asked to see this policy - and told them I had never given them permission to stand in my place.

For six months I attended the School Board meetings - asking to see the policy. That was, oh, about 20 years ago. . .I still haven't seen it.

In the meantime I gathered enough signatures of parents so that they had to create a new policy that NO movie could be shown to minor children without the parents written permission.

Boy, do I not miss those days.

I'll tell you, life would have been easier and less stressful if we would have just kept them home and taught them. Their education would have been better than any public school teacher would have ever taught.

I would be beside myself if such a form were sent home for me to sign. I knew the schools were failing the kids academically but I had no idea these kinds of things were happening.

The ADD thing is totally out of control - if a child isn't a mindless drone, he/she must be drugged. I would love to know how much money big-pharma makes from Ritalin and similar drugs.

The "Truth" about ADD

The thing is, the kids are bored spitless. I know this is true, because I was one of them. BTW, my DOB is 3/3/1949. One of my earliest memories is of sitting on my Mom's lap, with a book in my lap, Mom reading from it and running her finger along pointing to each word as she read it. I didn't learn to read at age 2, I had reading imprinted on me. When I got to kindergarten, I was sorely disappointed. "What? I thought they were supposed to teach us stuff here! I already know how to fingerpaint!" And when they made me go down for a "nap," I simply didn't understand it. I had never had a "nap" in my life! "Geez, don't you have anything to read?" that sort of thing. I have very little doubt that if I'd behaved like that in today's schools, they'd have started drugging me or something. But the schools in the 1950's were still under local control, and the union thugs hadn't turned them into propaganda mills.

That wasn't my issue at all...
My issue was that my Son's Language Arts teacher said she KNEW he had it because her Son had it. She is not a Doctor..so why should I listen to her without having my Son's Doctor check him out?

I had my Son's Doctor check him out. She said my Son was fine. We also went to another Doctor to look into the "suicide" assertion of the teacher.

My Son did benefit from talking to that Doctor..because there was some issues that were on his mind..but he was not suicidal and the Doctor felt strongly that he was not.

My point was yes, there are some children that may indeed have ADD/ADHD but a teacher should not be advising Parents to medicate their children or demanding to see medical records. That is for Doctors and Parents to decide. Not every child that is opinionated, a bit energetic, or even a bit disruptive has ADD/ADHD. There are multitudes of reasons why a child may be "difficult" in class.

It is very important for Parent's to question everything. It could be that their child is a discipline problem...or it could be their child is bored and unchallenged, or..it could be that there is a medical reason. BUT...Parents should not be told in absolutes by Teachers what needs to be done "or else". AND...Parents need to be aware of what rights they are signing over to the school while their child is in it's care.

I've seen, due to parents putting their children on Ritalin-type of medications, is very horrible.

People may try to tiptoe around you because you allege to be on medication - but I've experienced the results of adults who have been drugged since they were young - and it's not been a pleasant experience.

One young man is fighting every day to get off of all of the medications the government insists he take, that started with his parents. The government has the carrot and the stick motivation going for him. You take your drugs now, Andy or we will, BAM!, whack you where it hurts and throw you out of our government housing.

There is another alleged ADD/ADHD victim, in his late 30's, who was also started on legal drugs by his parents. He had to be removed because he was on so many psycho meds, when he decided to lace it with some alcohol - yeh, he went over the top and started destroying things - wound up in the psycho ward.

Yes, I think there is something wrong with it. I'm tired of the pharmaceutical companies creating dependencies on drugs that do more harm than good. That goes especially for those giving drugs to young children because they're deemed too active. They aren't sitting placidly at a desk, glassy-eyed and drooling.

Thank you, Jan, for sharing your experience and for setting such a good example! It's shocking - all of it. Yes, you DO have to read every stupid paper they send home from school and question everything that your child does while at school in their guardianship.

While the issues you dealt with are more critical than curriculum issues, you have to read and question there, too! For example, if a permission slip comes home from 10th English class saying the assigned book "deals with some controversial issues," you might want to ask if that means your child will be reading (from the victim's POV) a graphic, sexually-explicit depiction of a girl getting raped by an adult male family member, followed by (from the perp's POV) his rationale of why he prefers sex with girls vs. boys, or women, or men, or animals.

How CAN One Expect to Continue this Way?

How about that Social Security Number? I think it is time to get rid of it. If everyone would just do it all at once, we might have a chance. Otherwise I think we are fighting a loosing battle. There is another post on DP that says we are paying the Gov’t till mid July this year...certainly we the people could take care of each other with out the help of the Federal Government and that number to which we are attached. When are we going to wake up? I think the SSN is the link.

From what I understand roughly 35% of the population is paying the bill. 50 some odd % is on welfare and 15% or so on SS. Granted those who are on SS should get every time they paid. But really folks how can we expect to continue this way?

I have signed on in spirit to the 2013 Liberty Day Challenge to begin to look for competitive forms of money so we quit paying for our demise.


Perhaps together we can investigate and find a way to cut out this noncense.

Thank you so much for this information.

A quick search on the internet landed me on a site called "Vaccination Liberation" and it gives information on vaccination exemptions from each state. Not sure if all states are listed, but the site is loaded with helpful information.
