Judge Andrew Napolitano Praises Gary Johnson

The following is from a transcript of of an audio recording of Judge Andrew Naplitano's presentation at Freedom Fest in Las Vegas on Thursday (12 July 2012) afternoon. His presentation was entitled “A Government of Waste and Lawlessness.” Here are the comments he made regarding Libertarian Presidential nominee Gary Johnson:

34:30: “I’m going to really go off script for a minute. . . .

There’s really no script; there’s just a note telling me I’m talking too long.


There is a person in this room, who I must invite to the attention of everyone, because he has the courage to stand in front of the establishment and say, “Enough is enough!”

Whether he wins or loses in his latest quest to set you free, he is a figure of historical significance and profound contemporary interest. He was once called, “Governor No!” when he said to the legislature of his state, “You are not going to interfere with commercial transactions that are voluntarily entered into.”

Maybe . . . who knows . . . after this campaign, or the next one, he might be in 1600 Pennsylvania Avenue. Former New Mexico Governor, whose sandal straps I am unworthy to fasten, who will speak here tomorrow (sic) at 10:30, Governor Gary Johnson.

That’s what we should be doing. Challenging the establishment, reminding them that there is a Constitution and a Declaration of Independence that put restrictions on the government.”

Some of it sounds good, but things like this are kind of disturbing.

Full funding for our assessed dues to the UN ensures that it can carry out its vital humanitarian(LOL), peacekeeping(LOL), democracy-building(LOL), and development work(I think we know what they're trying to "develop"), all of which serve core U.S. foreign policy interests(Are you crazy?). As the U.S. is the UN’s largest contributor, Congressional funding shortfalls significantly impact the UN’s ability to carry out its operations. So, if we stopped funding the UN, it probably wouldn't even exist.

Seeing as how we are in the midst of another financial crisis, most certainly on the way, why would someone entertain only decreasing spending by 43%? Wouldn't ALL of those dollars be much better off spent somewhere else? I know we can't just defund and withdraw overnight, but there should be a discussion about when we could COMPLETELY withdraw. We need the U.S. out of the UN and we need the UN out of the U.S.

The FAIR tax proposal addresses these concerns — only applies to new goods and services, not for B2B transactions. Embedded non transparent tax will go away, even with the FAIR tax, the absolute price of goods should drop.

The FAIR tax does away with the IRS, Income Tax, withholding, etc.

Rand Paul promised in his primaries to endorse the nominee. I think he contributes to the US Senate. I got it. I wish he would not have done it, but I’m glad he is in the US Senate.

What’s your position on free trade?

I think we should get rid of central banking in general. I stand for free trade. No tariffs. Genuine FREE TRADE.

How do you feel about secret military research.

We need a transparent government. Non transparency does not make us safer. We need a strong defense — but not secrecy around offense. A 43 percent cut in military spending takes us back to 2003. We’re spending more than half of all military spending worldwide and we are 5 percent of the world’s population.

The biggest threat to our national security is our debt.

What about illegal immigration?

Work visas are the key. We need a line that is moving. You cannot get a work permit today, that’s why we have 11 million illegal immigrants. I’m calling for a 43 percent reduction in federal benefits — that will impact immigration as well.

Can you paint a picture of a coalition government?

Historically democrats were good on Civil Liberties, historically republicans were good on dollars and cents. Imagine a cooperation with a POTUS on those traditional agendas.

What about waste and fraud in government?

I personally lost a bunch of money in ERON. I put a whole lot of money into ERON, and now they come up with more government regulation that caused the 2008 mortgage meltdown. CEOs had to recognize the actual worth of the asset. Everyone becomes insolvent. The point here is that there is an unintended consequence for everything the government does. The regulations to prevent ENRON caused this latest collapse.

I have three questions for you.

Please explain what you mean by marriage equality?

That it is Constitutionally guaranteed. On par with Civil Rights in the 1960s. That the Federal Government recognizes marriage between same sex couples for our tax code. The FAIR tax does away with with most of those issues.

Second — Do you envision possible advantage if you joined with the Constitution Party?

Ideas are more important. The candidates matter more than the parties. Look at Democrats and Republicans? Aren’t we all about the ideas of Liberty and Freedom here at Freedom Fest?

What about the millions of people who have representation without taxation? This is the growing part of the electorate. What about a Constitutional amendment to have those people on welfare to give up their right to vote?

I’m advocating the FAIR tax, so that would not be an issue.

I’d like you to clarify about the war on drugs? Would you legalize all drugs?

Yes. The world would be a better place if all drugs were legal. But I’m only advocating marijuana legalization for now. When we legalize marijuana and see the world is a better place — that police go after real crime, that when release the 2.3 million people behind bars for drug crimes, that 90 percent of the drug problem is prohibition caused, not use caused, the world will be a better place.

What about military bases around the world?

I am proposing a 43 percent reduction in military spending — cutting the military footprint in Europe, Japan, South Korea, cutting nuclear warheads . . . Those discussions are ones I look forward to conducting.

How do I respond to my friends who think you won’t be elected? What about running as a Republican in 2016?

There’s only one choice for POTUS, and that’s Jim Gray and me. There’s no real choice in the lesser of two evils. Vote for what you believe in. That’s how we will change the world.

What about immigration — I’m concerned about open borders.

Making it as easy as possible to get a work visa. To come to the USA to visit. I am not in favor of a fence. Legalize marijuana and 75 percent of our border violence goes away.

What about suitcase bombs?

Let’s face it, we have a risk of terrorism. If we’re going to bankrupt ourselves over preventing a suitcase bomb from coming over the border, then what kind of nation do we have?

What about the 11 million illegals here now?

In the case of New Mexico we have people in New Mexico who are technically illegal, but are productive citizens with grandchildren. Reagan caused this with federal quotas. If there are jobs, it works. If there aren’t they will go back.

What about Syria and the UN?

The UN will see a 43 percent reduction in funding from the USA.

What about Obamacare?

First — we’re telling all our kids that we will retire and have health care, but you will NEVER be able to retire, and not have healthcare when you are our age. This has all fallen on our kids. I would love to repeal President Obama’s healthcare plan — but it can also be amended in ways that open up the floodgates of free markets.

At the basis of healthcare need to be free markets — the only way to blow the lid off of supply.

It's very informative about his positions. He's not Constitutionally consistent like Dr. Paul - no one is, so I'm surprised the Judge is backing him.

I have friends and family in the military,

and there might be a thing or two I don't agree with on Dr. Pauls foreign policy, but Gary Johnson seems to have a very neoconservative foreign policy. Not only did he say he would support the U.S. invading Uganda to track down that Kony dude...Not only did he say that he wouldn't have a problem leaving military bases in Afghanistan even after the war there is "over"...As President, Gary Johnson would continue drone attacks in Yemen and Pakistan..

What other countries would Johnson be willing to instigate preemptive wars with?

A humanitarian war is when you're getting the crap kicked out of you by your neighbor for no good reason and I whack him on the head with a baseball bat because I believe in your liberty to live.

As far as any offensive use of force, such as sending out a team to catch a terrorist fugitive, that would be done ONLY IF he can be convince that the benefits outweigh the risks and that's a pretty high threshold.

What he SAID is that he wouldn't say "never", only that there had to be a very convincing argument and a situation that he can't envision.

I prefer someone with common sense, not rigid ideology in the White House.

For instance, if the drug lords launch a takeover of Mexico and are going to be successful and Mexico asks for our help (which their Constitution actually doesn't allow, so they'd have to be in dire shape), I don't give a crap how great it is to be libertarian in theory, we can't have our neighbor being taken over by the kind of people our drug laws create.

Repeating the same thing over and over and over and over...No rhyme, no reason..You're just another "Rand endorsed Romney, that means Ron Paul is out, let's all just jump ship to Johnson" mentality. I was simply addressing what you wrote. Did Dr. Paul WANT to grow his practice into a multi-million dollar business? Obviously not, or he would have, as I'm sure he would of been more than capable. He probably would of been more than capable of getting elected as a governor as well, if he wanted to. Apparently he didn't want to. So, Johnson has 8 years governing experience and Dr. Paul has a couple decades of Congressional experience, whereas Johnson has NONE. What's your point? And if Johnson has such a successful multi-million dollar business, why doesn't he use some of that money to help get his message out? Why did he wait until the very last minute (actually 3 minutes late) to withdraw from the Republican party, thus potentially threatening his ballot access in many states? I'm having a hard time understanding your "arguments", as they lack substance to say the least.
