This is infuriating to read if you know the truth and have seen the videos, but Brent deserves to have us all pulling for him.

St. Peters trial begins for Paul activist accused of trespassing

ST. PETERS • A local leader in Republican presidential candidate Ron Paul's campaign was arrested because he tried to "reorganize and reopen" the unruly St. Charles County GOP caucus March 17 after it disbanded, a St. Peters police officer testified Tuesday.

"He was attempting to keep the people from leaving," Sgt. Tim Hickey said on the opening day of the trial of Brent Stafford, 45, of O'Fallon, Mo., who faces a trespassing charge in municipal court. The trial resumes next Tuesday night.

Stafford maintains he did nothing wrong. He has said he left the caucus site, the Francis Howell North High School gym, with other participants as ordered by police and then exercised his free-speech rights on the sidewalk outside by trying to reconvene.

The police order didn't apply there, argued Stafford's attorney, David Roland. City officials contend that it did.

Yes Brent was ACQUITTED!

The city never made it's case. After the prosecution rested it's case, Dave Roland, Brent's attorney, stood up and said "Your Honor, I move to dismiss. The city has failed to prove it's case!" After the Prosecuting Attorney stated her rebuttal the judge thought for a minute or two, dead silence, and rendered his verdict. It was a sweet moment. There was an outburst from the crowd for a brief moment, until the judge put a stop to it. You should have seen the looks on the faces of the cops when the crowd was leaving the courtroom. Priceless :-)

There was a reporter there from the Post Dispatch (stltoday.com) so expect a story in the morning.

Congratulations Brent! I hope my outcome is similar.

Why have a Lawyer??

I am not trying to knock Brent but if the action has now moved to trial and he has an attorney, he and his attorney have failed to fully grasp the true beauty of American form of Law. The statutes and codes and even the Constitution does not apply to anyone not under the capacity of the contractual oath. Common Law is the only applicable law to a free full liability man of which any criminal action requires a full liability accuser to face you with their accusations.

The state cannot be an accuser because the state is presiding over the case and must not be a party to the case because they must be impartial. The men and women operating under the capacity of the state are under contractual duty to protect the rights of every individual and the government's just powers, or powers of justice aka a criminal or civil action, is derived only from the consent of the governed not the consent of the government. The derivation of lawful power comes directly from the accuser because the owner of the liability of the accusations has been identified to the court and if that accuser has all elements in a valid cause of action ONLY then does the court have jurisdiction. If there is no member of the governed who executed the powers of justice through accepting personal liability for their own claims against the accused then the court does not have lawful power to hear the case, period. Lawyers won't tell you this because most of them (not all) are hackf''ks who got brainwashed in law school on a Lockean philosophical foundation instead of the true derivation of American law outlined in the Organic Laws of the United States and the non repugnant precedent Common Law, note to lawyers- Lockes words did not make it into the American Organic Laws aka the Declaration of Independence they are the words of a British Bureacrat who's tyrannical government forced our ancestors to violently abolish them for their lack lawful governance and all out tyranny. Lawyers please drop the Locke failure of logic and find the supreme logic in our Organic Laws your entire understanding will crystalize to the proper interpretation of our truly beautiful form of Law.

In criminal cases without an Accuser who is member of the governed with all elements in a valid cause of action there is no cause and thus no case and therefore EVERYTHING is null and void.

Special Appearance- Legalise for the only reason you at the court is to challenge the jurisdiction of the court. Jurisdiction is not just geographical it is also related to the subject matter. If the subject matter does not have a member of the governed making an accusation against you and accepting liability for that accusation then there is no subject matter at all because their is no plaintiff. Special Appearance everytime all the time in a tyrannical system.

Some may say the state is the accuser accepting liability but that would not be equal justice under the law because the State does not hold equal liability as a full liability man or woman. Brent sorry you let your lawyer send you down the wrong path. You and your lawyers should probably actually read our laws and why we threw off a tyrannical government in the first place and how we made repugnant state Authority over the people.

Politics is the place for changing policy aka code aka the rules for Government, the courts is where we intepret the law. I guess the lawyers want to set precedent that the state has power over the people instead of setting the precedent that the State serves the people. Do we pay the government to accuse us of 'crimes' and destroy our lives or take our property when we have not harmed anyone or do we pay them to serve us when we call them to duty? It all depends on the facts of the case you present.

The most powerful Law of Nature is Time. It is finite and we all will run out of it. Use this Law to your advantage, for it offers you infinite possibilities...

Bottom line

Brent did everything within his constitutional guidelines. He followed all the rules. The establishment was obviously upset because they knew Paul backers had it in the bag thus the reason to cause disorder in turn it led to the "do-over" where we solidified our win. Will someone please show the judge the tapes?

Any Sane Judge .....

I'm having real difficulty understanding what he did wrong. Was it disobeying a police instruction? A breach of the peace? Tresspass (once it became clear what the police instruction was)? Was the police instruction ever clear? Was it even a legal instruction - given the nature of the meeting taking place on private hired property? Or were the police just being used as heavy bouncers for the illegal instructions of some disgruntled GOP official? Any sane judge with half an ounce of guts and rational thought would chuck this out within minutes - and give a reprimand to the police.

What the problem is, is basically the GOP DOESN'T like that he was doing everything right by the book and following all the party rules and WINNING!!!

The GOP just wanted to USE FORCE against him wrongfully in hoping to stop the Paul backers from winning the delegates.

The police went along with it because they work for the power brokers, not the people as many assume. So to make a long story short, the power structure HATES LIBERTY and people who would dare support it. So that's why they TRUMPED up trespassing charges against him. Anything to get this guy out of there....

Simple as that. This is why Liberty is SOOOO HARD to attain. Because at every frigin' corner, there's always some power broker attempting to stop you from exercising your Liberty because your Liberty can be a thorn in the side of their "power"! Well, they can go f' themselves!

The sad thing is that they own much of the justice branch as well. I advice you to listen to the interviews of the whistleblower and former black op. Chip Tatum and hear what he has to say about the US judicial system in his own words. Anyhow, it amounts to that those that are trying to fight the system from within end up framed and convicted by a friendly judge. The US need a reboot, anything less than that will just let the travesty continue. Imagine, the US being in need of an imminent revolution to survive, what an irony.

Assuming this was a bench trial?? not a jury?? Paid attorneys or Pub defender? What were the terms of the gop renting the venue? I can't believe the prosecuter would even bother with this. Depending on the state in a lot of states, even with a petty misdemeanor, you can request a jry trial and they often drop the case(especially a weak one). Sometimes you don't have a right to jury trial if the charges are minimal.. but wow.. this is just nuts.. can't believe a judge would find probable cause, a prosecuter would proceed, and a cop woukd even have made an arrest.

But if thjs is being arfued out its going to come down to: was he asked to leave the property? if so by who and did he refuse? and did that person have the authority to ask him to leave?

Brent Defense Ideas

Pursue criminal and civil charges right away against the other parties as a negotiating tool. Brent's charges can be dropped by the Chief of Police at any time without notice; same by prosecutor. Plus hard to convict with no witnesses willing to testify. This should never have gone to trial. Brent reconvened under proper protocol and rules. GOP/RNC/Parliamentarians/Other Delegates need to come out and help and support Brent right away and be there EVERY DAY! This should be dismissed with prejudice and an apology to Brent, including from Romney; along with Romney donations plus anything else to make up for all the distress and money put out.

Huge publicity should be put out against Romney; another reason for him not to be trusted to be POTUS. He could fix this with a phone call or two; and HE JUST NEEDS TO DO IT-NOW! Maybe this could tie in a news story with all the stolen delegate seats.

couple things..

Cheif of Police can't drop the charges once they are filed. At this point only the prosecutor. Or the Judge could jave it dismessed on certain grounds, but he has already found probable cause, so unlikely. And its quite easy to get a conviction if its a bench trial. Only the judge decides as opposed to a jury. All misdemeanors are set for a bench trial unless you request a jury(some states don't give you a right to a jury if its one of the lowest level misdemeanors)

Civil charges are unrealalistic unless you pay to file the suit. Theres not enough of a prize for a lawyer to take up on contingency. And he can't file criminal charges against anyone. He can report a crime and then its up to the DA. And for the witnesses, if your supeonad.. you risk contempt if you refuse. Right to remain silent applies to self-incrimination.
His best leverage would have been to ask for the jury trial of it was an option.
But this is a huge abuse of the law.

If Brent Was Attempting To Prevent People

from leaving...wouldn't that be an unlawful impisonment charge of holding someone against their will?
Obviously the cops don't know the law, or didn't have a reasonable cause for arresting Brent.
A good judge will throw this case out, but alas, "good" judges are as scarce as a needle in a haystack.
