"Accepted" it" simply just

"Accepted" it" simply just means the clerk accepted the filing. Once the defendants get served they will likely file a NEW motion to dismiss and THEN the judge will read the complaint.

If this attorney refiled the same type of complaint without making the CORRECTIONS the delegates should be furious.

We don't know that --- yet. Have you read the new complaint? Second, the judge doesn't read the complaint until there is either a motion to dismiss or some other reason to read it.

Second, it would have to follow the reasoning set forth in the order. I.e. it has to state facts supporting the conclusions.

The motion to dismiss was

The motion to dismiss was granted yesterday, without prejudice to plaintiffs. meaning a few things needed to be changed and refiled. Richard refiled today and the court accepted it.

I wish he'd waited and we could have seen it. It might not be

practical, but some of the info he was given on prior go rounds was simply inaccurate and there were better facts than he had in some places. We did tweet him some information though. I'm just crossing my fingers because this was the FINAL amendment according to the judge.

It may never go to trial. It has to survive yet another motion to dismiss, then discovery, then a motion for summary judgment. It can be years before there is even a trial, AND he could possible be required to put up millions as a bond pursuant to Rule 65.
