Many in and out folks in the military now

many think they go in to do good for the world and than find out its not the case, this is certainly not the military of the early 1900's or early where they were only used to defend this country. Of course many go in to get benefits, bad economy and hopefully get skills for a career after service, aka desperation. Of course in the military in and out you don't have rights to speak out unless you risk stuff like this happening to you, i have a few in and out neighbors who just don't want to talk about everything they did probably for that reason.

Curious - can the gov't put things on his facebook page and make it look like he wrote it?
What some people are saying here at the DP seems to be the complete opposite of what his mother was saying. She even had his posts in front of her while on the Josh Tolley show.

A few of his posts were threatening including a quote from the song Bring Me Down by the band Swollen Members saying "Sharpen up my axe; I'm here to sever heads". He also mentioned starting a revolution and made threats against military generals saying "I am coming for you"

Threatening the government officials of the United States is a serious crime under federal law. Threatening (non-presidental) officials is a federal felony, usually carrying maximum penalties of 5 or 10 years under 18 U.S.C. § 875


He says he is "coming" for the generals who are training

"young Americans to fight Americans." Thus he lays a legal basis for acting against generals who are breaking their oath to defend the Constitution (OWS right to peaceably assemble comes to mind.) "Come" could mean come to arrest. Why not?

just sayin'. On his support page some friends got to talk with him and he told them to post a 50 cent video. It has nothing to do with his situation . "Sharpen up my Axe" means get ready. Get ready to fight. And there is no threat to any military generals. I have seen the posts and I have seen your screen captures of the posts. You are reading this one all wrong.

Surely you jest. I read his FB posts, he was not threatening anyone. Is reading poetry, writing and performing a song now a crime if the message is "threatening"? You should listen to what your actually saying.

This kind of arrest and detention contradicts the rule of law

BUT you all may want to read what he wrote over the last couple weeks on his facebook page before you comment, because it's very different than what is talked about and written in the above videos. VERY different: http://www.facebook.com/brandon.raub?sk=wall

He clearly was set on the idea of being detained by the feds for his facebook posts, and I don't mean that as a figure of speech, like "he was asking for it". No, that was his literal purpose and I would even say his stated goal. He seems a bit delusional and seems to think his arrest will spark a revolution in which he will be the leader.

His whole page is designed to set off red flags. Check this post from last year "Fuck the New World Order. I'm bringing it down." Somewhat innocuous, until you read his mysterious comment posted this very week, which only says "Soon". Then there's some stuff about a secret Bush castle in Colorado, which he says is set aside for raping and sacrificing children. And 9/11 stuff, of course. Then in August a bunch of oddly urgent calls to arms. Then this week he adds that "soon" comment to his old post, and posts a shitstorm of cray-cray with such hits as "This is the part where I tell Generals, training our young men to fight Americans, I am coming for you. The Veterans will be with me." and who can forget "I'm starting the Revolution. I'm done waiting." and that timeless treasure "Your government evil. It is as simple as that. And the calvary is coming." or maybe "The people responsible for posioning the America people from the sky will be held accountable. And there is going to be justice."

Then by around aug 12th, cranks it up a notch with a comment probably designed to make him look suicidal "Death is nothing, but to live defeated and inglorious is to die daily." and adds "Sharpen up my axe; I'm here to sever heads." Then, perhaps after being annoyed that the feds haven't picked him up yet, he tips his hand a bit and openly suggests that his comments are for their benefit, with "You should understand that many of the things I have said here are for the world to see." and "The Revolution will come for me. Men will be at my door soon to pick me up to lead it. ;)" after that last post, he even goes so far as to post his address so they don't have trouble finding him, so that he can become more powerful than they can possibly imagine and lead us all to the promised land.

So, by all means do point out the typically unlawful actions of the "law" enforcement community and their questionable collaboration with the mental health industry, but you might not want to use equivocal language or phrase your objections in a way that feed this guy's delusions of grandeur while you do it, like these videos do.

for those of us that want to base our knowledge on truth rather than one sided stories. Two wrongs don't make a right. Just because the government is drunk on power doesn't mean that every person not in the government is right in their actions.

If I read these things I would be wondering if he is the next one to be in the news for shooting a bunch of people up.

Of coarse there is a lot of grey area when we have founding fathers saying stuff like "Give me liberty or give me death"... now-a-days that would get the FBI dragging you out of your house and sending you to the mental hospital. But then again Patrick Henry said that at a convention as part of a coherent speech to convince other delegates to rebel which is a bit different.

Imagine if you pushed a cop like that, then its considered a threat and aggression that justifies violence. But some how this psychological analysis does not apply to cops who use it.
Why is it ok for cops to shove people for no reason and expect no reaction, while they would respond violently for the same thing.
If so, then they should not be conducting that way to a person obviously going with them.

He was arrested, and not read his Miranda rights, and taken to a psych ward.

No evidence of PTSD. Fully functioning.

Just critical of the US Government.

Most laws regarding mandatory mental health treatment are similar throughout the states. Now I'm not saying it's justified, so don't attack me. But as long as I have been in the business, since 1996, and much longer, people here in Wisconsin have been placed on mental health "holds". The rationale being they are a danger to themselves or others.

This is not considered an arrest, as no crime has been committed, so Miranda rights don't legally apply. Here, you can be held for up to 72 hours, during which you are evaluated by medical staff. If the Psychiatrist believes it is essential to keep you there longer, then they must make the case to a judge at a hearing during which you are present unless they can make the case you are too out of control violent or verbally aggressive to be heard. The majority of people here are released before the 72 hours is up. My guess is he will be as well and might not have to see a judge. That, however, can vary from state to state.

This is ONLY for your information, as I am one of you, and have been for years very outspoken. My dad told me, based on my Facebook posts, if they ever round people up who disagree with the man, I will be among the first ;-). Hope it never comes to that as I am not a danger to anyone and I suspect, and hope, this guy is not either.

Apparently Boing Boing is more concerned with Russian Punk Band

being arrested for speaking up against the Govt. in Russia than a former Marine in the US.

This had better be a lesson to all FACEBOOK users.

You had better be careful what you post on Facebook. You cannot trust anybody anymore.

If he used colorful language, but it wasn't threatening to any person or individual, then the only thing he is guilty of is poor judgment, but not a crime.

I think the FBI needs to arrest rappers....because their music is certainly suggestive in a violent manner.

P.S. to his mother....get an attorney, and you better be checking on him 24x7 to make sure they aren't drugging him.
