08/20/2012 43 MINUTE ORDER IN CHAMBERS by Judge David O. Carter: ORDER TO SHOW CAUSE WHY THISCOURT SHOULD NOT CONSTRUE PLAINTIFFS NOTICE OF APPEAL AS A DESIRE TO STAND UPON THE FIRST AMENDED COMPLAINT. Thus, this Court ORDERS Plaintiffs to SHOW CAUSE why this Court should not construe Plaintiffs notice of appeal as a desire to stand upon the First Amended Complaint and treat the August 7, 2012, Order as a final judgment divesting this Court of jurisdiction. See Edwards v. Marin Park, Inc., 356 F.3d 1058, 1061, 1064 (9th Cir. 2004) (holding that plaintiff who filed an Election to Stand Upon the Sufficiency of AmendedComplaint Pleadings made a reasonable choice to expedite the rest of the case and test her belief that the... claim was adequately pled). Plaintiffs shall file a Response to this Order to Show Cause by 9 a.m. on August 21, 2012. Judge writes that he has rarely experienced such incompetency

An excerpt from this most recent order from Judge Carter:

"...The few courts to address similar mixed messages from plaintiffs have done so exclusively in the context of filings from unrepresented prisoners..."

This fiasco has been a long trail of "mixed messages" from Gilbert and his cheerleaders. But Carter's message is crystal clear. Gilbert's practice of the law is on par with the filings from unrepresented prisoners.

Where are all of Gilbert's apologists today?

They used to swoop in like a swarm of locusts to throw flames on and down-vote every DP poster who dared to question the validity of this lawsuit or the competency of their fearless leader.

Please don't underestimate Dr. Gilebert

He has planned this for years in advance. We are playing 3d chess, and Dr. Gilebert has succeeded in preventing the RNC from filing a motion to dismiss. Since there is no motion to dismiss, we should take this as a VICTORY for our Nation, as we have tentatively won this historic case.

Once the judge recognizes the sheer brilliance of Gilebert's strategy, he has no choice but to rule in our favor. Now all we have to do is go to the RNC Crime Convention and place the crime boss mitt under citizen's arrest. This should convince all the delegates that Ron Paul will be our nominee, and will win the vote 2286-0.

Finally, someone here gets it.

This case is small potatoes in the grand scheme of planet-wide challenges that Dr. Gilbert handles (daily) on Twitter.

who absolutely do not ‘get’ the legal sarcasm. In Federal Court, this is as good as it gets. Where are the damn transcripts? Those are probably hysterical (which is most likely why the person hasn't released them, even though PACER shows that someone got them)

Please, someone, find the transcript of the hearing. I wonder if Richard brought up internment camps. I'd also love to know exactly what the judge said to make Richard so sure that he was going to decide in his favor.

the original ruling didn't unbind the delegates at all

Here's a paraphrased version of what the judge said to Richard Gilbert:


The delegates were always unbound anyway

so whatever ruling from the clown in the gown today one thing came out of this: multitudes that count found that out with the introduction into evidence of the RNC attorney stating that the delegates were unbound and State rules concerning binding didn't apply on the floor of the RNC.

that was a Romney bound delegate

who was allowed to vote for Romney after the state tried to tell him that they wanted him to change his vote. He wasn't bound to McCain. Do you see the difference between this and the general question regarding delegate binding?

And there is no key to blocking my guy. He will win and it will not be close, no matter what you try. You just don't have the numbers.

He actually wanted to vote for Ron Paul but was afraid

to cast his vote for him and felt that he would have been removed from the convention if he took it that far.

This would HELP Mitt to get to 1144 on 1st ballot.
I do not believe it is true. Thank goodness.

Currently Santorum has circa 107 bound delegates.
If ANY of them vote Mitt on first ballot it helps him.
I think about 80% would vote for Mitt if they thought they could.
We would not have had a chance to persuade them otherwise.

There are plenty of other reasons that Mittens is sweating.
But this is definitely not one of them.

it is the all out PR blitz to get this in front of the actual delegates once confirmation comes.

I humbly suggest, that the act of holding one's breath until

such time so as to receive confirmation verifying the other day's press-release which indicated that Dr Gilbert had tentatively won the case, is not only medically inadvisable, but will lead to a tragically predictable, though terminal, case of self-initiated asphyxiation.
