Attorney Statement on Brandon Raub; Raub to Be Detained Indefinitely

CHESTERFIELD, VA— The Rutherford Institute has come to the defense of a former Marine, 26-year-old Brandon Raub, who was arrested, detained indefinitely in a psych ward and forced to undergo psychological evaluations based solely on the controversial nature of lines from song lyrics, political messages and virtual card games which he posted to his private Facebook page. Although the FBI and Chesterfield County police have not charged Brandon Raub, a resident of Chesterfield County, Va., with committing any crime, they arrested Raub on Thursday, August 16, 2012, and transported him to John Randolph Medical Center, where he was held against his will due to alleged concerns that his Facebook posts were controversial and “terrorist in nature.”

In a hearing held at the hospital, government officials disregarded Raub’s explanation that the Facebook posts were being interpreted out of context, sentencing him up to 30 days’ further confinement in a VA psych ward. In coming to Raub’s defense, Rutherford Institute attorneys are challenging Raub’s arrest and forcible detention, as well as the government’s overt Facebook surveillance and violation of Raub’s First Amendment rights.

“For government officials to not only arrest Brandon Raub for doing nothing more than exercising his First Amendment rights but to actually force him to undergo psychological evaluations and detain him against his will goes against every constitutional principle this country was founded upon. This should be a wake-up call to Americans that the police state is here,” said John W. Whitehead, president of The Rutherford Institute. “Brandon Raub is no different from the majority of Americans who use their private Facebook pages to post a variety of content, ranging from song lyrics and political hyperbole to trash talking their neighbors, friends and government leaders.”

Brandon Raub, a former Marine who has served tours in Iraq and Afghanistan, was detained by FBI agents and police officers at his home in Chesterfield County based upon the nature of content posted to his Facebook page in recent months. Like many Facebook users, Raub uses his Facebook page to post songs lyrics and air his political opinions, as well as engage in virtual online games with other users.

On Thursday, August 16, police and FBI agents arrived at Raub’s home, asking to speak with him about his Facebook posts. They did not provide Raub with a search warrant. Raub was cooperative and agreed to speak with them. Without providing any explanation, levying any charges against Raub or reading him his rights, law enforcement officials then handcuffed Raub and transported him first to the police headquarters, then to John Randolph Medical Center, where he was held against his will.

Outraged onlookers filmed the arrest and posted the footage to YouTube. Law enforcement officials have stated in press reports that Raub was not arrested. However, as attorney John Whitehead points out, if the police have put handcuffs on you and you’re being held against your will, that qualifies as an arrest.

In a hearing before a special justice on August 20, government officials again pointed to Raub’s Facebook posts as the sole reason for their concern and for his continued incarceration. Ignoring Raub’s explanations about the fact that the Facebook posts were being read out of context and his attorney’s First Amendment defense, the special justice agreed that Raub should be incarcerated at a VA hospital for up to 30 more days. Rutherford Institute attorneys are working to challenge Raub’s detention and the highly unconstitutional nature of the government’s actions.

If 'The Government' operates outside of the Laws it is suppose to uphold, then 'The Government' must expect the Citizens that it SERVES to operate outside of the Law as well.

It will be very interesting to see how 'The Government' reacts when Citizens begin indefinitely detaining Government Officials and Enforcers. It is inevitable that this will occur once 'The Government' is detaining everyone that posts 'anti-government' speech.

Let us not forget that "The Government' has given itself the power to execute Americans without Trial, on a two way street what does that lead to?

I have no faith in them whatsoever, but still, they never said indefinitely or even implied it. They said up to 30 days. Up to 30 days does not equal indefinitely. When you say indefinitely it implies that he was picked up under the NDAA, which is not the case, so the title is very misleading.

We should consider rallying

the ex military in this nation over this. The American Legion's as well as the V.F.W.'s would be prime locations. Let them know the Government is considering them as the enemy if they dare speak out and exercise their rights that they have sacrificed so much for. If you know a vet, make sure he is aware of this ominous development. I have a feeling that we will see a few more examples made of us before the Convention ends and the MSM will gleefully tie it in with Dr. Paul. On the light side, they did this to a renegade Governor from La. , Huey Long, the Kingfish. He dared to stand up to the oil companies and for his efforts was detained and committed to an asylum. When released he proudly stated he was sane and had the paper work to prove it.

He doesn't mention Dr. Paul's name, he says "truth is treason in the empire of lies, right?" Obviously, these liberty- loving Constitutionalists are dangerous lunatics! Clearly, the concept of IRONY escapes every government official


THEY, and their present actions, are EXACTLY what this marine was warning Americans about with his posts.

Their actions are an admission of guilt, and an admission that these postings were "spot on TRUTH."

Thus, by their actions, the marine's postings demonstrate completely reasonable discourse and dialogue and by definition, indicate that he poses no threat to either himself or anyone else around him.

The threat is clearly coming from the government.

I would think they prove the ground what they can get away with.
Detention for psychiatric treatment without preexisting medical merit can be also considered crime against humanity. Preexisting classified medical condition must be present otherwise there's no probable cause so the person seizure is illegal - otherwise called abduction, kidnapping.

Can you find the naughty word?

One word in the following clause is now commonplace in politics talk regardless if it comes from media heads, politicians or people such as you and me, the average person.

The word needs to be left out of discussion about politics, leaving in place discussion of issues. Politics -- the relationship between government and business to create conditions to remove man's natural relationship with man, individual to individual freely -- is nothing to take lightly.

In case the word eludes you, here's a hint: Other than saying it to correct the person who uses that word wrongly, as in to suppress anyone but himself or herself, there is no room for that word, a word that raises the politician -- or is that lowers the individual, or both? -- from the mouth of a free man or free woman.

As for FB being a surveillance operation, of course it is. It's CIA funded. And created. Zuckerburg is but a face for FB, a lackey doing the job assigned to him: make FB personable especially for the -- young -- people, always a demographic ripe for influence. That influence is from a perspective that, as any perspective from anyone to anyone, those young people when they're parents would instill in their children.
