District Court Refuses to Stop Transfer of Marine Brandon Raub to Psych Ward 3 Hrs. Away From Lawyers & Family

CHESTERFIELD, VA— Special Justice Walter Douglass Stokes for the General District Court for the City of Hopewell, Va., has denied an emergency motion filed by attorneys for The Rutherford Institute to stop former Marine Brandon Raub from being forcibly transferred to a psychiatric facility more than three hours away from his family, friends and legal team. Raub, who was arrested, detained indefinitely in a psych ward and forced to undergo psychological evaluations based solely on the controversial nature of lines from song lyrics, political messages and virtual card games which he posted to his private Facebook page, is being transferred from John Randolph Psychiatric Medical Hospital in Hopewell to the Veterans Hospital in Salem, Va., on the other side of the state. Raub was arrested on August 16, 2012, and has since been detained against his will due to alleged concerns by government officials that his Facebook posts are controversial and “terrorist in nature.” Rutherford Institute attorneys are challenging Raub’s arrest and detention on the grounds that the detainment order was procedurally improper, the result of an unlawful detention, and was based entirely on statements made by Raub that constitute protected free speech under the First Amendment.

“This is not how justice in America is supposed to work—with Americans being arrested for doing nothing more than exercising their First Amendment rights, forced to undergo psychological evaluations, detained against their will and isolated from their family, friends and attorneys. This is a scary new chapter in our history,” said John W. Whitehead, president of The Rutherford Institute. “Brandon Raub is no different from the majority of Americans who use their private Facebook pages to post a variety of content, ranging from song lyrics and political hyperbole to trash talking their neighbors, friends and government leaders.”

Brandon Raub, a former Marine who has served tours in Iraq and Afghanistan, was detained by FBI agents and police officers at his home in Chesterfield County based upon the nature of content posted to his Facebook page in recent months. Like many Facebook users, Raub uses his FB page to post songs lyrics and air his political opinions, as well as engage in virtual online games with other users. On Thursday, August 16, police and FBI agents arrived at Raub’s home, asking to speak with him about his Facebook posts. They did not provide Raub with a search warrant. Raub was cooperative and agreed to speak with them. Without providing any explanation, levying any charges against Raub or reading him his rights, law enforcement officials then handcuffed Raub and transported him first to the police headquarters, then to John Randolph Medical Center, where he has been held against his will. Outraged onlookers filmed the arrest and posted the footage to YouTube.

In a hearing before Special Justice Walter Douglass Stokes on August 20, government officials again pointed to Raub’s Facebook posts as the sole reason for their concern and for his continued incarceration. Ignoring Raub’s explanations about the fact that the FB posts were being read out of context and his attorney’s First Amendment defense, Stokes sentenced the former Marine to up to 30 days’ further confinement in a psych ward and signed a court order for Raub’s involuntary admission to the Veterans Hospital in Salem. Rutherford Institute attorneys are in the process of filing various emergency motions and procedural appeals to challenge Raub’s detention.

How is this any different from the Pussy Riot Detention?

Americans sneer at the treatment of the Pussy Riot bandmembers yet ignore that our government is doing essentially the same thing under the guise of the terrorist watchlist. All the good little Republicans go to sleep feeling "safer" while the government oppression grows unchecked.

This is worse.

According to LRC's Daniel McAdams, Pussy Riot broke into a church service and launched their demonstration, which was sacreligious in addition to being anti-Putin.

If you broke into a church service on Sunday morning here in the US and started reciting the 'punk prayer' in English, you would probably get forcibly removed as well, and might just wind up in jail.

Contrast this with Raub. If they had anything on him, they would have thrown it out ther right away to justify his detainment.

Maybe they do it differently in Virginia, but where I live, most people get discharged from the hospital after a day or two. Only the really emotionally disturbed or crazy people are held for a month. As soon as they determine there is no liability by letting the person out, they are out the door. Why? Because it costs a lot to keep someone in the hospital!

I'm not a psychiatrist, but I'm both hospital security and an on call sheriffs deputy, so I meet these people and often know the outcome.

You guys are right, this doesn't seem to pass the smell test, but then again, only the doctor would know what's really up.

There is no justification for the 30 days.

This is to shut him up and also they hoped to create FEAR in others who criticize the government. He is meant to be an EXAMPLE.

The media is focusing on a meaningless blunder made by a worthless politician in Missouri. Something that is important is happening, so they need all the idiotic things that have no meaningful reprecussions on the future of this country to be kept front and center. We cannot be allowed to know that somebody is going to be detained without trial and thrown into a nut house.

Todd Akin is a strong supporter of Dr Paul and his voting record is as close to Ron Paul's record as anyone can get! They are doing the same things to Akin as they have done to Dr Paul for decades. The corrupt Congress fears him because he wants smaller government, drastic spending cuts, auditing the Fed and getting rid of several Federal Agencies including the Dept of Education. We in Missouri know exactly what is happening, we voted for and placed him in the position of the Republican Candidate for a reason. He is a strong Constitutionalist and they don't want him to win because of what he stands for. Whatever happened to William Millay?

I'd still like to know what happened to Specialist William Millay, the 22 year old from Owensboro KY who was taken into custody from an Alaska Army Base for "espionage" in 2011. There has been a media blackout on his case.

Is he free? Did he ever actually get charged? What is his fate? Anyone know?

Based on the comments he made and the profile it created it is absolutely not a surprise that the Authorities had him picked up, arrested, and sent for psych-eval. My take on this situation; Brandon Raub purposely created this profile and knew full well that they would pick him up. I believe that this was a strategy to engage the Government and to flush out their policies and applications of laws such as the NDAA and new legal doctrine such as pre-crime.
The Authorities bit hook line and sinker and now Brandon Raub has been catapaulted into full public view and consciousness. Afterall who ever heard of an ex-marine named Brandon J Raub before this arrest? It appears that he has created a firestorm to highlight threats against individual liberties and Constitutional protections and to raise the awareness level of the threats lurking behind the thin veneer of reduced rights for increased security and safety. We know the Benjamin Franklin quote, "Those who sacrifice liberty for security and safety deserve neither". I think this Franklin quote is very appropriate for the times America finds itself as a Nation and a people.

I heard his interview with Adam Kokesh, and he definitely sounded totally sane, and totally together.

I cannot believe that a Judge would order him to be detained, period! This is NO LONGER AMERICA. It is absolutely shocking, and our Founding Fathers would be outraged for sure.

*If*, and I say *If* gingerly, Brandon said anything that was not tactful, then, that is his only so-called crime, and that is NOT a crime. I cannot believe the police are aiding and abetting this atrocity, regardless of what they "think" his intent was. If he denies any intent, then, what is the matter with these people, the FBI, and the Judge?

This is unheard of, and it will NOT silence the rest of all of us. We might be more careful of what we type online, or how we say something, but we will not be silenced with our opinions! Our politicians---where are they? Where is their common decency?

If a man said he'd like to kill a neighbor of his, he might be questioned about it, but the police could NOT hold him, because he has done nothing! They would have to release him. So, if Brandon said something, as long as he has done nothing, they should not be able to hold him, except for the unconstitutional NDAA. How is Brandon's situation any different than the former example? Answer--it isn't!

So, what is happening! Brandon Raub is no more or less than a POLITICAL PRISONER. That is what this whole escapade is about, nothing more, nothing less.

Even though this is UNconstitutional, this proves to the whole world and everyone just how corrupted our politicians & government representatives, etc. have become. They hate the US Constitution and hate it with impunity! They are the ones who are the hate-mongers, not us, I'll tell ya!

I thought the line saying men were going to pick him up were very odd, but seeing your explanation makes a lot more sense. He probably knew exactly what to say to trigger this and he also knew that his facebook was being monitored. Now we all know that there are mental evaluations, Soviet style for all us dissenters. Oppositions of science so falsely called-psychology is a huge weapon of the authoritarians.
