States where no declaration needed from Dr. Paul to write-in and have vote counted: AL, IA, WI, PA, CA, VT, NH, DE, OR, RI

UPDATE: Oregon in Play for Write-in Votes for Ron Paul.

It seems that they total the write-ins but do not tally them for the individual candidates. Looks like a good place for a Ron Paul write-in campaign. If suddenly 20% of the votes in some counties are write-ins, it will be pretty obvious who it is.

No declaration from candidate needed. Oregon looks good for a legal challenge demanding they tally the write-ins.

Oregon 2008 presidential write-in vote:

Missing from previous lists is Delaware. From this link which cross-checks accurately with my research:

http://www.anamericanvision.com/info/state_certifications_re...

There are no requirements in the state of Delaware. Voters can just write in the candidate's name, and the vote will be counted.

Seeming to verify this is this Voter Instructions circular from DE Elections, which states:

http://elections.delaware.gov/services/voter/pdfs/how_to_vot...

Once you have finished making ALL your selections, push the GREEN VOTE button on the lower right of the screen to cast your ballot. You may not use the write-in option during a primary election.

I take the bold to say you MAY use the write-in option during a general election.

New Jersey is problematic. You can write in a president but according to the link above (more inquiries needed): "Write-in votes will only be tabulated if there are enough of them to contest the election."

But how do they know if there are enough of them to contest the election? I guess it's like, hmm there seem to be a lot of these maybe we'd better start counting.

In the other states listed, varying levels of activism are required for write-in votes to count, from running a slate of official presidential electors to simply writing in the candidate.

A visual summary of presidential election write-in laws is here:

What about Virgil Goode, Constitution Party? The Libertarian

won't get the right-to-lifers.

For some reason, we're expected to know every law that exists in America & in our state so we don't break it. We're supposed to know this when we're 18. There's no litmus test for them, as in the 10 commandments or rhyme or reason. C.U.R.E.

Absolutely AGREE!

http://www.usanewsfirst.com/2012/06/18/ron-paul-or-virgil-go...

I know - so many seem to think the same people who voted on principle for Ron Paul will now deny their principles (ex pro-life) and vote pro-choice for Johnson. Can't do. We need a Ron Paul party.

Where I live in Wisconsin Virgil Goode is on the ballot and Ron Paul will supposedly count for a write in. Do you think they really will count it? If so, then that will be one more vote the two-party system did NOT get. If not, Virgil is a Goode option. :-)

I will be voting

I will be voting for the Libertarians to help them get 5% to meet the threshold to qualify for easier ballot access and funding. Johnson just happens to be on their ticket.

A vote elsewhere is a wasted vote.

And I'm still a Republican engaged in the local GOP.

Isn't WI pretty clean electorally as far as states go?

I mean corruption-wise?

I don't know

Did anyone ever run the ballot flipping algorithm on the recall election? I would be interested to see that.

Sorry,

I don't know for sure if they will or will not do the right thing. I guess I haven't heard of fraud cases here, but it probably wouldn't exactly be advertised :-)

Please List RHODE ISLAND

Rhode Island was the ONLY PRIMARY STATE to elect Ron Paul delegates with 25% of the popular vote.

AND AND AND our state does count write ins. I contacted the RI Secretary of State's office. Here are the counts from 2007. Mind you, we are a SUPER SMALL and totally a DEMOCRATIC state. I swear we are a petri dish for any Federal Program out there because we are so financially broke.

2007 RHODE ISLAND WRITE INS
Hillary Clinton 655
Ron Paul 472
No Vote 43
Mike Huckabee 34
Mitt Romney 25
Al Gore 15
Colin Powell 14

Stephen Colbert 8

Bill Clinton 6

OH GREAT! thanks Sue4theBillofrights

It will be interesting to see how many write ins Ron Paul gets this year. If it stays the same I'd be very surprised.

My wife and I were observers in the Jackson County Oregon Primary election this year on May 15, 2012.
What I saw was:
A team of 36 people sorting out the mail in votes and the PCP votes which were on 2 separate ballot sheets. The voting sheet that had the presidential and other candidates, including write ins was separated by hand.

This made me think that if enough write in votes for one candidate, such as RON PAUL, outnumbered the candidate on the ballot, he/she could be elected.

Now, the thing to think about is; During the Oregon primary election "NOT" all registered voters received a ballot with a presidential candidate on it because Oregon is a "closed" election, meaning only registered democrats and registered republicans were mailed a ballot with a choice for president.
Apparently, there are many, many, unregistered eligible voters in Oregon, and many, many voters who are registered as "Other" than republican or democrat.
My opinion is, if these disenfranchised voters wrote in Ron Paul, in the November general election, he could possibly out number the choices, on the mail in ballot, of course we'd have to start a strong P.R. campaign, right now !

vote for Gary Johnson

You could technically add RI

to that list.
They do say they would like notice of any potential write in campaigns because they need extra supplies or something stupid like that. It is not required though.
I know for certain that they won't be tabulated on election night unless there are enough write-in votes to affect the outcome of the election. They will count some, or maybe all write-ins later. Nobody really knows.

They actually do count them! I contacted RI Sec of State

Here's 2007's count sent to me from the RI Sec of State:

Hillary Clinton 655
Ron Paul 472
No Vote 43
Mike Huckabee 34
Mitt Romney 25

I can't wait

Personally, I can't wait to write in Ron Paul. He's the only one that deserves a vote... yes, even over the 'newly beloved' Gary "Red Herring" Johnson and Virgil "No-Good" Goode.

Anybody in Wisconsin?

This website reads (for 2008):

http://writein2008.blogspot.com/search/label/Wisconsin
-------
Wisconsin

The candidate must file a list of 10 presidential electors and a “Declaration of Candidacy” in the following manner no later than October 21, 2008. The list shall contain one presidential elector from each congressional district and 2 electors from the state at large and the names of the candidates for president and vice president for whom they intend to vote, if elected.*

Because of the clause below, candidates do not actually need to file the list of electors to have votes counted.

Note: Compliance with this subsection may be waived by the board but only if the results of the general election indicate that a write-in candidate for the office of president is eligible to receive the electoral votes of this state except for noncompliance with this subsection. In such event, the write-in candidate shall have until 4:30 p.m. on the Friday following the general election to comply with the filing requirements of this subsection.

-----------------

The way I read this, it means if Ron Paul wins the electoral votes of Wisconsin then he has until the next Friday to file his electors. He doesn't have to do anything before that.
