The RP Revolution seems to be much indebted to Aaron Russo’s Freedom to Fascism. This movie has awakened a lot of people to the frightening truth about our government and its total disregard for the rule of law. This is nowhere more true that Russo’s revelation that there is no statute or regulation that makes the average American liable for a tax on labor or wages. However, PLEASE do not be so simple or naïve as to simply stop filing. If you stop filing without adequate research and preparation, you will end up in federal prison FAST.

Those who win against the IRS win only on issues of fact. Issues of law are for the court (judge) and they will rule 100% of the time against you! Only on questions of fact can you hope to win. This requires great research and preparation if you are to be successful, and even here there are NO guarantees. (Juries often lack moral courage too!) The judge can prevent your key evidence from ever being heard by the jury! That’s right! The skids to the jail house are greased, big time.

The issue to win on is whether you knew you had a liablity and wilfully failed to file. To negate wilfulness you must get letters from CPA's, Congressmen, Accountants, and others stating you have no liability. This requires preparation! You must invest a huge amount of time getting informed first, so you know EXACTLY the risks.

So, PLEASE, if you feel the moral courage to stop filing, please do your research first. Contact the leaders in the Tax Protest movement. Lowell Becraft Huntsville AL is probably the best attorney in the patriot movement. Get council first BEFORE you stop filing. Good luck!

Many people withhold a percentage of their taxes commensurate with the amount that would be spent on things they cannot morally support. Undeclared wars, for example.

On last years return the fed owed me money. Now I have yet to file but most likely will file when I file this years (simply because I'm starting a business and would rather not be in jail.)

Would not owing exempt you from trouble or does it just not matter?

And "income" means the common-sense definition of it--include wages and all that.

is to start your own business....deductions work wonders!!

But I totally agree...you have to know the law and have the knowledge...knowledge is power...especially when dealing with the government. Even know the IRS is a private entity

I paid my taxes and didnt file for 10 years... eventually they

contacted me about how I owed them taxes because they filed me automatically under the work case scenario rules... so I had to file all the past years to prove I didnt owe all the money they said I owed... the alternative was they would take my checks from my employeer which of coarse would not have allowed me to live... so no prison for not filing for 10 years... but they did end up getting some money out of me and pressured me into filing...

The Supreme Court has refused to listen to arguements about our right to petiton government for redress of our grievances as mandated by the Constitution. This is the Constitution under attack by government. Bob Schulz and We the People have worked tirelessly for years on your behalf to make our government accountable. They have steadfastly refused our requests for redress of grievance. I think Bob has finally reached the conclusion that nothing more can be done in court to make these people follow the law.

No right to have EVERY case heard before the Supreme Court

You have the right to PETITION the Supreme Court to have your case heard. You don't have the right to FORCE them to hear frivolous arguments. Think about it -- there are 9 Justices of the Supreme Court but 300,000,000 citizens. Do the math on how many milliseconds you'd get to argue if every citizen got to force the court to hear oral argument.

What "petition for redress of grievances" refers to is to your right to petition CONGRESS, not the courts.

We have the right to petition and to redress. The problem here is that they won't redress.

We petitioned, they wouldn't answer. Clinton admin., Bush admin, congress, the IRS, etc.

You have the right to petition for a redress of grievances. The government doesn't have to actually give you what you want.

Otherwise, how would government function? Imagine that I'm in favor of a certain tax break, and some Guiliani supporter is against it. If we both petition for a redress of grievances, how is the government supposed to simultaneously satisfy us both?

The Petition clause is protecting your right to CALL, WRITE, and PROTEST. It doesn't guarantee you that you'll be happy with the outcome.

Credentials? You don't want to go there.

There's no such thing as a "degree in constitutional law." There's just a law degree. Which I happen to have.*

I'm telling you that, whether the Supreme Court is "right" or "wrong" it doesn't really matter. They aren't going to change it. It is SETTLED LAW that these arguments are frivolous. They have been rejected REPEATEDLY. Maybe the Supreme Court was "wrong" to reject them, but it doesn't matter since they aren't going to change. As a result, you will assuredly pay penalties if you try to claim that your "income" isn't really "income", and you might well end up in jail.

It's purely a statement about the universe, not right and wrong. It doesn't matter if you're "right" that "income" isn't "income" (most tax protesters probably are wrong about that anyway), but you WILL end up losing.

* I am NOT a practicing attorney, let alone YOUR attorney. I suggest that you see a practicing attorney in your state for legal advice.

SC is often wrong

Congress and the Supreme Court upheld the idea that a black person was worth 3/5 of a white person. The only thing you need to change "SETTLED LAW" is the right arguement and the right court. I'm not challenging your expertise, I just think saying it is "SETTLED LAW" is giving up the ship. That's not what the RP Revolution is about.

If I seemed doubtful, it was probably because I object to your characterization that the petition is only directable to CONGRESS (your caps within your misquote), when the First Amendment clearly states, "petition the government".

And I have a problem with (anyone, not necessarily you) buying into Mr. Shultz' generalization of the effects of the denial. It does not leave the Second Circuit's nasty ruling in effect over all of us, only over those unfortunate enough to live and/or function within the Second Circuit.

Going fatalstic after a major setback is to more or less concede the battle. That's weak. The next step is to bring stronger cases in other Circuits until finally one of them renders a contrary ruling and then take that one up for resolution against those existing.

But then, you know that: you're the lawyer.

In fact the feds estimate that 10 million people are non-filers, yet they only prosecute a scant 200 - 300 people per year. The truth is that most non-flier/non-payers get away with it.

I am self employed and of course have some creative ways in reserve for deduction claiming of course they are all lawful. But I haven't made enough since 2000 to file against the business. It would be great to have made a lot more money but all in all I am thankful that I haven't directly funded Iraq.

There are some options for the self employeed, 1. spend any and all excess on marketing, equipment etc. or don't file, get a tax attorney and place the money in an account of some type or vault it in metals in your own safe.

LLCs and corportations have some very nice benefits also but sole proprietors can do just fine to spend all their money on business stuff.

Heck if you take your work with you i.e. cell phone/computer one can take a nice working vacation and write it off.

Needless to say I haven't filed in years but have all documentation to prove my lack of earnings.

I cheered the decision in the Kahre case, but to call it a staggering defeat is not realistic. This was a jury trial. I'm pretty sure the decision of the jury will not be recognized as a precedent that others can raise in defense in their own cases. Every jury case is like starting over again. And it's an uphill battle as the court controls what the jury is allowed to hear and gives the jury instructions on what it may consider and which laws it may rely on. It takes a fully informed juror to overcome this.

Everyone who loves freedom needs to become a fully informed juror.

This solves about 70% of the american publics problems. The Feds get none of your money and you can invest the amount they would normally take in Silver or Gold... http://www.dailypaul.com/node/24110 and if you really want to screw a majority of the sheeple, you file anyway, claim the child exemptions, claim your donations to reduce your taxable income and walla, you get money that is allowed through the corrupt tax code. Then take that money and invest it. Or if you have any scrupples, you claim EXEMPT and dont file because you dont owe anything. Just do your tax computations in January to make sure that you dont owe anything and dont send it. If they want to get stupid on you, you ignore them, let them take you to court... They will soon see that if you did file and claimed all the expemptions, that they actually owe you. Example: go to taxcut and plug in these numbers... Taxable income $54,000, Your, Your wife and 3 kids... Withholding of Fed Taxes $1500... dont claim anything else... I'll bet you get a refund for about $2500.00.. So why in the heck would you, on your W4, claim the Max allowed 10 exemptions, When you can claim "EXEMPT" on your W4? Am I brain dead or what?
