Louisiana’s casket-making monks declare victory with appeals court ruling
From the public-interest law firm Institute for Justice, Chip Mellor writes:
The 5th U.S. Circuit Court of Appeals handed down a major victory for economic liberty last night in IJ’s case on behalf of the monks of St. Joseph Abbey. The court said that the actions of the state board were either unconstitutional or an outrageous abuse of power unauthorized by state law.
The decision is a great example of judicial engagement in action. The court addressed the constitutional questions concerning economic liberty by looking at the evidence, looking at the law, and not paying excessive deference to the government.
