Rand Paul holds up NDAA bill over indefinite detention amendment

Kentucky Republican Sen. Rand Paul is holding up consideration of the fiscal 2013 defense authorization bill over an amendment he plans to offer that would require a jury trial for Americans detained in terrorism investigations.

A Paul spokeswoman said the senator wants “an agreement in principle to get a vote” on the amendment, which would likely produce some fireworks on the floor.

Paul’s demand for a vote comes as Senate Armed Services Chairman Carl Levin, D-Mich., and Arizona Sen. John McCain, the top Republican on the panel, are working behind the scenes to limit debate on the sprawling policy measure (S 3254) to ensure it receives floor time during the lame-duck session.


Text of amendment:

A citizen of the United States who is captured or arrested in the United States and detained by the Armed Forces of the United States pursuant to the Authorization for Use of Military Force (Public Law 107–40) shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defence.

Chip off the old Block I say

Rand is showing that he is going to follow in his fathers footsteps, but do it in a way that gives him a chance at actually convincing Republicans that Liberty is the right way. He is compromising some things that cannot be defeated at the moment, but if he is able to gain more power, his voice of Liberty will get louder and louder and these things will have a chance of being defeated along the way. We need to put the past behind us, in some ways, and get behind Rand and help him move Liberty forward.

Good But Not Far Enough

The constitution never just protected the rights of American citizens. It talked about man's inalienable rights. Foreigners are humans too.

On top of that, what about that act that congress was voting on regarding expatriating American citizens? So if they wanted to indefinitely detain you (even if Rand gets his way) they could still expatriate you and then detain you.

He only included U.S citizens to make the bill easier to pass. It would have no chance to pass if it included non U.S citizens. Also, this way anyone who votes against this amendment will be on record as voting to indefinitely detain U.S CITIZENS, not simply foreigners.

Message to Rand - Form Allies to fight this

Pull in the Kucinich's, pull in the progressives against this. Pull in the other Dr. No Tom Coburn (R). Get a group of like minded people behind you on this amendment. This is probably the greatest tragedy of a bill that has passed in my lifetime, and it must be stopped.

John McCain

was the Senator who wanted to lock up Americans abducted on US Soil because the government (him included) allowed the release of people from GITMO who had no access to due process nor was their release based on due process of law. Do the names Ramzi Yousef and Omar Abdel Rahman ring a bell, Senator? They aren't going to be released anytime soon, having been subjected to due process of law, not the Patriot Act stupidity.

John McCain, Lindsay Graham and Carl Levin should be banished from the halls of congress, they no longer care to uphold and defend the United States Constitution to which they have sworn allegiance.

John McCain is a traitor to the United States of America, and should be investigated on his role around POWs in Vietnam.

He should be removed from office in disgrace, and be denied any taxpayer "benefits" in the future. Depending on the outcome of the investigation, "harsher" penalties should be considered.

He may have been referring to reasons for establishment candidates--who were polling 3rd or 4th days before a primary--pulling off 8 vote victories. Think about it, Santorum got screwed so obviously Rand would be no exception. Primaries are generally fair game for the GOP to do whatever the hell they want.

Here is Rand's response to McCain:

"The article quotes a Senator saying I have "some demands, as usual." Yes, I do. Follow the constitution. Stop indefinite detention. My amendment simply puts the language of the 6th Amendment into the NDAA. That is apparently not acceptable to some of my colleagues."

Ron always worked with people he didn't agree with when they agreed on a specific issue. And in the case of Rand we actually agree with him on almost everything. The Romney endorsement was a kick in the teeth - but it doesn't mean we dont support Rand 100% when he is fighting for an issue that is important to us, to the country, to liberty itself........lets band together behind Rand on this

are awful on economic issues - but when they stand up against the drug war or against undeclared war - we give them our approval and support.
