Federal Judge Finds North Carolina 'Choose Life' Plates Unconstitutional

RALEIGH, N.C. – A federal judge has ruled it is unconstitutional for North Carolina to issue pro-life license plates unless the state offers similar plates supporting abortion rights.

U.S. District Court Judge James C. Fox ruled on Friday that North Carolina cannot produce or distribute the “Choose Life” plate.

Judge Fox concluded, “The State’s offering of a Choose Life license plate in the absence of a pro-choice plate constitutes viewpoint discrimination in violation of the First Amendment.”

That's insane!

In my state you can get a license plate with a dog and cat on it. But I like horses better. By the judge's logic, it is unconstitutional for my state to issue license plates with the dog and cat on it while not issuing ones with a horse on it. -.-

WTF?

What constructive wielding of law (by a person presumably with a degree in the field) would nit-pick to this level of absurdity?

It would be one thing if there were both pro-life and pro-choice plates, with one being more expensive than the other (a little economic discrimination or some such). But this is just dumb. So now ALL possible viewpoints on such issues MUST be equally represented on fecking license plates, or else no dice: unconstitutional?!

And we have Mr. Dumb*ass who proclaims:

“This is a great victory for the free speech rights of all North Carolinians, regardless of their point of view on reproductive freedom,” said Chris Brook, legal director of the ACLU-NCLF.

Victory for free speech?! By its very censorship?!

Foolishness.

What would the Founders do?

The constitution applies to the fed

The constitution of these United States applies to the federal government. I believe if the State chooses to do something, I think the federal government should but out. Especially if that State decides that abortion is illegal. We need to start enforcing the 10th amendment and remind the fed of it's limited power over the States. This federal judge should be looking at what our federal government is doing and leave the States alone. There is plenty of constitutional laws being broken and ignored right now by the federal government that have higher precedence than what a State license plate says on it. How about counterfeiting by the federal reserve, the IRS, Obama's kill list, NDAA and so on.

It is better to look dumb and not be, than to look smart and not be.

what the hell is "Viewpoint Discrimination"?

This is just insane.

It's like banning a license plate that says "Life is Good". What the hell is wrong with judges and juries these days.

Choose Death

Someone should petition the legislature to create choose death plates. That way there would be an opposing option to choose life. I'm sure they would be quite popular.

Of course, if license plates were issued by private companies, you could buy the plate design of your choice.
