Dianne Feinstein Announces Plan For American Gun Owners To Be Fingerprinted and Registered

California Democrat Dianne Feinstein will introduce legislation in January calling for the fingerprinting and registering of all gun owners in the United States.

On her Senate web page, Feinstein states her proposed legislation will add fingerprinting and photo identification to the National Firearms Act.

A firearms seller must currently submit Form 4473 to the government containing the name, address, driver license information, NICS background check transaction number, serial number and model of the firearm, and a short federal affidavit stating that the purchaser is eligible to purchase firearms under federal law. Feinstein’s bill will add a substantial layer of bureaucracy to the existing regulations.

The effort to expand firearms registration will include weapons grandfathered prior to the enactment of Feinstein’s proposed legislation. In other words, all gun owners will be required to register their constitutionally guaranteed firearms with a federal government inimical to the Second Amendment.

Poll Tax

People scream and yell whenever any kind of ID requirement is instituted in regards to voting. Requiring ID is often referred to as a Poll Tax, equating the cost to acquire identification to the taxes used earlier in our country's history to keep poor people from voting. The argument is that adding this additional cost prevents poor people from participating in their constitutional right to vote.

So, my question is: how is this any different regarding our constitutional right to bare arms. Are the additional costs for 2 forms of color photo identification, finger printing, and non refundable deposits to purchase firearms not an infringement on the rights of the poor to own firearms?

This racist legislation must be struck down immediately! Everyone please call your senators and congressman (especially Feinstein) and let them know what racists they are for supporting legislation that will restrict the rights of poor minorities in this country. (sarc)

Constitution forbids ex-post facto laws

It isn't ex post facto. But it is still unconstitutional.

They can only make these requirements at best via the commerce clause.

Thus, anything not in interstate commerce - like a gun you already own, cannot be required to be registered for you to continue to possess it within your state of residence.

The reason it doesn't violate ex post facto is that it does not make it a crime for you to have behaved differently the day the law goes into effect.

Say for example, it will be a crime to possess a semi-automatic rifle without a special tax stamp starting July 4th 2013.

Now, if you possess such a gun now, of course, with no tax stamp, then that is presently legal. You cannot be prosecuted for any period BEFORE July 4th 2013 that you possessed such a gun without paying the tax. You CAN be prosecuted for possessing such a gun without paying the tax on or after July 4th 2013.

Your actions prior to the law taking affect are and will forever remain - legal. You cannot be prosecuted for them. But perhaps CONTINUING to engage in them, might mean you run afoul of the NEW law.

But, as I said, since there is no interstate commerce, and no other provision of the Constitution being implemented here, then her bill can't do anything about guns already owned.

It will be interesting to see those who rail against this as officious, while, at the same time, supporting such intrusive invasions as, say, the Patriot Act. Since, of course, if you haven’t done anything wrong, why worry?

Perhaps she'll just change the wording to "get the fingerprints from the local/state authorities"; here in MA, I had to be fingerprinted and wait 4 weeks to get my "license". I really hoped they wouldn't grant it, also; I was somewhat looking forward to a Constitutional fight.
