Proposed Weapons Ban Summary (Illinois General Assembly HB 1263)

The following is a summary of newly introduced IGA bill HB 1263 and its key points, which I've put together. I personally think this has a very low probability of passing. If it does, it's slated to take effect 1/1/14, but it is certain to face legal challenges immediately by the NRA, SAF, etc... and, in my opinion, it's likely to be considered unconstitutional by the courts.

However, aside from the legal challenges, this will set a very poor precedent for other states to attempt the same thing (e.g. CA and NY) and could potentially have an effect on Feinstein's proposed AWB.

This bill makes even less sense considering that the 7th Circuit Court has given the state until June to put in place a CCW permit process. Of course, the politicians in IL are top in the nation when it comes to stupidity and corruption.

  • Goes into effect 1/1/14 [if passed and considered constitutional]
  • Sec 1-10: Shooting ranges must be licensed to operate
  • Sec 5-5: Revisions to Sec 24-1-9 on prohibited weapons and ammunition. This section will now include:
    • Semi-automatic "assault weapons" including all of the following styles/models:
      • .50 cal rifles and .50 cal cartridges [Sec 5-5.a(5) specifically states 50 BMG but no mention is made of 50AE]
      • AK
      • Uzi and Galil
      • Beretta AR-70
      • Colt AR-15
      • FN FAL, LAR, and FNC
      • SWD M-10, M-11, M-11/9, and M-12
      • Steyr AUG
      • TEC-9, TEC-DC9, and TEC-22
      • Any shotgun with a revolving cylinder
      • Any semi-auto or pump action rifle with a detachable magazine and 1) folding or telescoping stock, or 2) a pistol grip or thumbhole stock, or 3) a shroud
      • Any semi-auto pistol with a detachable magazine and can accept 1) a folding, telescoping, or thumbhole stock, or 2) a shroud, or 3) a magazine that attaches to the pistol outside of the pistol grip, or 4) weighs >= 50oz when unloaded, or 5) a semi-auto version of an auto firearm
      • Any semi-automatic rifle or pistol with a fixed magazine that has the capacity to accept more than 10 rounds of ammunition
      • Any semi-automatic rifle or a pistol with the capacity to accept a detachable magazine, a muzzle brake, or muzzle compensator
      • Any semi-automatic shotgun that has 1) a folding or telescoping stock, or 2) a pistol grip or thumbhole stock, or 3) a fixed magazine capacity in excess of 5 rounds, or 4) an ability to accept a detachable magazine.
      • Semi-auto "assault weapon" excludes bolt, pump, lever, and slide actions, unserviceable or inoperable, antique, air rifle, or a rifle with fixed-tubular magazine under the barrel holding rounds end-to-end.
  • Possession of any of the above must be documented with the State Police within 90 days of 1/1/14, and transfers must also be documented.
  • Excludes peace officers, prison personnel, military and guard, competition as recognized by Olympic committee
  • A bunch of rules for shooting ranges
  • Violation results in a Class 2, 3, or 4 Felony charge, or a petty offense or Class A misdemeanor

    This violates that State Constitution, Article 22.

    Why don't they just propose the legislation as an change to the State Constitution and put it up for a vote?
