When They Come For Your Guns, Know What To Do...

Great read. Found it while browsing the web for Gun Control articles.

What do you do when the police show up on your doorstep demanding the surrender of your militia weapons?

In responding, bear in mind that you have two important rights guaranteed by the Fourth and Fifth Amendments to the United States Constitution.

The Fourth Amendment protects you against unreasonable searches and seizures. If the police want to search your house without your consent, they need a warrant. Warrants may only be issued upon a showing of probable cause, supported by an affidavit. The facts contained in the affidavit must do more than support a mere suspicion. The test is whether the information in the affidavit would justify a person of prudence and caution in believing that an offense is being committed, e.g. that "prohibited" weapons can be found on your premises. The requirement of probable cause for the issuance of warrants is one of your most precious constitutional protections.

NEVER GIVE THE AUTHORITIES YOUR CONSENT TO SEARCH YOUR HOUSE, YOUR CAR, YOUR PLACE OF BUSINESS, OR ANY OTHER PREMISES UNDER YOUR CONTROL. Consent dispenses with the necessity of probable cause. While lacking probable cause, if the police conduct a search with your consent and seize evidence for use against you in court, your lawyer will not be able to suppress it on the basis that the search was warrantless.

The Fifth Amendment protects you against giving evidence against yourself, i.e., your right to remain silent. Just as you cannot be compelled to testify against yourself in a criminal trial, neither can you be compelled to answer a policeman's questions about that AR-15 you bought a couple of years ago and never surrendered. Don't be bashful about invoking this right. It's always better to remain silent and appear guilty than to open your mouth and prove it.

The Internet is replete with potential gun confiscation scenarios. Many people voice the opinion that this confiscation will take the form of armed troops going house to house searching for guns. This would be a potential source of revolution, would demonstrate the true nature of government and would result in the deaths of many of the regimes ostensible supporters.

I'll make the assumption that The Powers That Be are not stupid (evil, probably, but stupid, no). Since they are not stupid, and can foresee the difficulties with house-to-house searches, they will use other methods. Let's explore some of these methods.

Before we start that, we should be aware of the massive data gathering efforts that many government agencies have undertaken, and the abilities they have gained, in recent years. I don't think it is unlikely that the government knows, or can know quickly, with varying degrees of reliability, who a majority of gun owners in this country are. It is true that most of
the actual records of who own what are in the form of 4473s in individual gun shops. It is possible for the BATFE and related agencies to swoop down on gun stores and confiscate these records and, while it would take significant effort, convert them to electronic records. These records, when combined with all of the other data and methods that the Business Intelligence community has developed over the years, would create a database of gun owners with a pretty high reliability in my estimation. Even without the 4473s, combining credit card information (remember when you bought those M1 Garand bandoleers with your MasterCard a couple of years ago?), the intact database of background checks, explicit firearm owner databases (as in Illinois), State Police concealed carry information and the plethora of other data stores that exist, a comprehensive set of firearm owners could be put together. It does not have to be perfect! It doesn't even have to be that close. It will be your responsibility to prove that you don't have any firearms, not the other way around.

some defenses against those scenarios.

My thoughts

I would think that the first method of defense would be to not be on their list to begin with. That means buying your guns via private sale legally. There are ways to do that such as at gun shows in many states. If you have a gun now that was purchased via a dealer and there is likely a record, then consider what you need to be able to surrender that weapon or transfer it out of your possession. You can "sell" the weapon at a gun show and make a record of the transaction. That way when they ask for your gun that you own according to records, you can produce information that substantiates your claim that you sold it. Just tell them that you knew they were going to take away guns and you decided to sell it now instead of taking their cheeseburger coupon later.

I also don't recommend keeping your guns at your home if you have any other alternative, except for your main home defense weapon and your conceal carry weapon. A better place would be a storage unit if you can pay cash with no name on it.

You Lost Me With The Second Sentence

Police no longer "show up at your doorstep". Especially if it involves seizing firearms. It will happen at 3 AM when you are asleep. The front/back doors will be demolished, your pet dog shot, and you'll be hauled out of bed in your underwear and cuffed while they ransack your home until they've found what they want. You will do whatever they tell you to do.

Deaf, dumb, and blind

They will come through the neighborhood late at night. There will be flood lights lit up suddenly all over the street. Loud helicopters with spotlights, loud diesel engines spewing noxious fumes, people on bullhorns shouting orders, police/military directing everyone in different directions to create a state of confusion. The objective is to disorient people so that your thinking is broken down to a point where you comply with whatever they tell you without you even thinking about it. They won't want you to be in your home when they go searching it. You, along with your neighbors, will be corralled somewhere nearby until they are sure all the guns have been confiscated.

I suspect they will seize control of all media so that information will not get out because they can't do this all in one night. I think the only information that will get out is that there is some kind of "massive fight against a large, unprecedented in size, terrorist group". That will probably keep the masses from suspecting evil intent. Also, it will make a large upswell in military and police forces nearby a welcome sight for many people.


That article is out of date. It was written in 1990. It also

has a 4th, unspecified premise:

that the people there to "confiscate" your guns, are going to give a rats ass about any Constitutionally protected rights you have or about any curtailments on their power.

They are there to take guns, and/or murder you. Plain and simple. If they don't kill you on the spot, they will arrest you and put you in a camp. (not a prison, because there will be too many of you and the prisons are already full)

They aren't there to talk or to show you a warrant. They won't have one and they won't think they need one. Likely, some assclown judge will declare a "blanket" warrant for any and all premises, or, the legislature in question will simply try to write a provision that this special law doesn't need warrants.

It doesn't matter that this behavior is illegal as hell. They will do it that way anyway.

They aren't there to talk or to listen.

They are there to ransack, steal, and either arrest or kill anyone who even flinches in resistance to their 'authoriti.'

There is only one proper response to this act of war - lethal force.

They are guilty of an on-soil, inside invasion. Treat them as you would any foreign invader committing the same acts. They are just as criminal coming from Americans as from non-Americans.

The result of compliance with their violence against you is your death and the death of your family. You each might suffer a fate worse, before you die.

Surrender is not an option.

Do not give in to Evil's demands.

Resist it at every turn.

Is there another response appropriate to an overt act of war?

Is there another response appropriate to someone attempting to invade your home, confiscate your means of self defense, and/or arrest and imprisoning you regardless if you comply or not, or worse, there to murder you if you flinch in even the slightest way they don't like?

If Chinese, Russian, Iranian, or North Korean soldiers banged on your door and demanded your guns, demanded to enter your home to search for them, or whatever else they deemed "subversive or unlawful", were there to arrest or kill you or your family, what would be the proper response?

Why would your response be any different if instead, it were American soldiers, or American police officers committing those same crimes against you and your family?

Please, by all means, I await your alleged more "civilized" response to such uncivilized and naked aggression.

What I fear,

is a civil war. This is exactly what the establishment wants. Do you honestly think, that individuals can stop the takeover of American's guns by shooting the agents that come to their door? You think that is going to work???

^^^ that is what will happen. Thoughts? We're all in the same boat here, and I am totally down for self defense, but peaceful noncompliance IMO is my choice. Honestly I am not even sure what that looks like.

Yes. In fact, it's the only thing that will.

If each house they go to, they aren't sure if one or more or all of them aren't coming out alive or uninjured; if as they walk down the street, moving between houses, they are being sniped at; if they get real resistance at every turn, even from those who don't own guns, but don't appreciate being thrown into a tyrannical hell hole of a life; how long do you think they'll be able to keep it up? How long do you think before morale breaks down? How long before they have to bring in UN troops because not enough Americans are willing to go house to house killing Americans who just want to be left alone? How many children, wives, daughters, aunts, uncles, and little old grandmas are they going to be able able stomach killing?

On the other hand, if everyone simply doesn't resist, and instead decides to be a victim by choice, they will be no stopping the mass exterminations.

Regardless, civil war will be waged, just one side won't be fighting back under what you suggest.

There's no such thing as peaceful non-compliance at the point we are discussing.

You either resist and live or die, or you submit, and certainly die, and as this article notes, there are some fates worse than death before you eventually die.

I'd rather resist, and I feel an obligation to everyone else to resist.

To be born free is a gift.

Seems to be working for Afghans and Iraqi insurgents just fine. What the establishment wants is for you to fear a civil war so you will submit to slavery. They are the ones that need to fear!

I really don't know

and I don't claim to have all the answers. I am lost here. I just don't see how our government could fear us at this point, with all of their endless money and weapons exponentially more powerful than AR's. I hope people like you are correct, that we could stand up and beat them down. Just hard for me to imagine.

with the colonists in the 1770s.

They faced the most formidable army every assembled on a battlefield.

They won.

Not every battle. And it took them a while to really make progress. They were almost defeated. But they never gave up. They didn't surrender. (when they tried, they were slaughtered or died in captivity of maltreatment)

We might not win, but if we don't fight, we've certainly lost.
