Legal Reasoning
There is what we feel is just in our gut (street justice) and then there is how the law sees it.
Yes, you can use force to regain your property - legal. However, if you continue to apply force after you have regained your property it crosses over into assault especially if the other party has ceased to defend themselves - illegal. Deserved? Oh yes. Legal - no.. and so the tape is a problem.

I was watching an episode of
"Beyond Scared Straight". One of the delinquents (13 yo) was bragging about how he liked to steel bicycles in his neighborhood. That waas bad enough...what made it worse was his logic (paraphrased): The bikes are outside on the lawn so I am free to take it.
Interesting mentality, wouldn't you say?
There was some poetic justice...his bike was stolen a few weeks later (but I suspect it wasn't really his).

Really stupid move on the part of the "tracker"
Give this story a little time and you will see the person who took the iPhone sue the guy for battery and premeditated assault. I can almost guarantee it. It was just a phone and it could've simply been remotely wiped by the owner instead.

How about assault? That's not legal. Technically, they should've called police and had an officer meet them where they found the signal. Liberty means taking responsibility for your actions, even when the other person refuses.

And as you say most officers will turn the other way if you add in a little "extra" for retribution sake. But legally there is a limit. The tape creates a problem. Look at my post above. Its good to know.
BTW - I am not suggesting you call the police if you can regain your property without assistance. I am saying don't tape it and post it on Youtube.

Since I can't see everything on tape, I won't comment on the event itself. Although, the tracker does have every right to pin the man down and handcuff him; I just couldn't entirely tell what was happening with the fight. But as to your statement that "they should've had an officer meet them where they found the signal" - from experience, the police will not do this. (At least my local police.)
I experienced this exact scenario. I called the police, and they told me they could not help with this. I had the man's home address as well as his current location with 'find my iphone'. They still would not help whatsoever. They said it's too small of a theft and all they could do is call me if he turned it in to them. Though the officer I spoke to did tell me that "You can attempt to confront him yourself. But we highly recommend that you do not." So, aside from the rest of what happened, they may very well have called earlier and asked to meet somewhere; which amounted to nothing.

You're so right! I saw an ABC special on the TSA, where this agent stole a laptop from a customer ( undercover reporter) and actually took it home! Anyway The reporter followed the signal to the guys house and only because there were cameras there he gave it back. But ask yourself this, how many times has did guy done this? Probably a lot, ppl like that feel they can't get caught! Their above the law! Isn't there something called property rights?
