Ha Ha! ~Secret Pro-Gun Provision Hidden In Obama Care Law!

Here’s the actual language from the amendment, which appears on page 2037 of the monstrous law.


(2) LIMITATION ON DATA COLLECTION- None of the authorities provided to the Secretary under the Patient Protection and Affordable Care Act or an amendment made by that Act shall be construed to authorize or may be used for the collection of any information relating to–`(A) the lawful ownership or possession of a firearm or ammunition;`(B) the lawful use of a firearm or ammunition; or`(C) the lawful storage of a firearm or ammunition...

Remember when Obamacare was rammed through the legislature and no one had time to actually read the bill before voting on it? Some of us suggested that maybe this wasn't the best plan. We argued that perhaps - just perhaps - it would be better to know what laws you're creating before they're enacted.

It was around this time that Nancy Pelosi took to the microphones and famously claimed that "We have to pass the bill so you can find out what is in it."

Well, she's about to become very familiar with "what's in it."

Senate amendment 3276, Sec. 2716, part c. was attached to the Obamacare bill by none other than Harry Reid. Evidently, it was written to appease the National Rifle Association, and make sure the organization didn’t get involved with the health care debate. At the time, Reid was a staunch advocate of the 2nd Amendment, though he now claims his views on guns "are changing."

Irony of ironies: CNN is reporting that his amendment makes it illegal for the federal government to collect "any information relating to the lawful ownership or possession of a firearm or ammunition."

In short, possibly because no one ever read it, Obama's signature piece of legislation contained language that forbids much of the gun control agenda that he and Dianne Feinstein so desperately want to pass.

Now, we’re dealing with an out of control administration – one that’s more than happy to ignore the constitution whenever it sees fit - so there’s no reason to think Obama wouldn’t ignore parts of his own landmark legislation as well.

Still, it is an obstacle, and an embarrassing one at that. In his feverish need to cram Obamacare down our throats, the President created a major roadblock to his own dream of national gun control and registration.

I hate to be negative & burst the bubble but, this needs to be said:

Just like the undeclared wars, just like Obamacare was forced down our throats, just like National Guardsmen were sent outside their state lines AND outside the United States, just like the other liberties we supposedly had and were PROTECTED under the Constitution and the Bill of Rights have been shredded, - I just don't see this being treated and pushed aside like all else.

All three judges on the panel were appointed to the appeals court by Obama. It's "Who polices the police?" It's "Do as your told because your job and future career on the line!"

Things won't change until it hurts enough. Everyday it seems to be getting closer to the SHTF.

The people in power enforce the laws on the books to their benefit - period. To me these are FALSE senses of security. Fool me once.....

Seems both parties are ignoring the citizens and just doing whatever they want.

That's been the case for awhile now.

Why should they bother listening to the citizens when the citizens believe anything and everything they are told, and in the meantime they are receiving payments via backroom deals with lobbyists? The only solution I see is for people to wake up. The light at the end of the tunnel was very dim back when Dr. Paul was one of the lone voices and considered a crack pot. Imagine if there had been 50 Ron Paul's (us). As the views are changing and people are wake up, the lights a lot brighter. More liberty minded people are running for elected offices. With a possible executive order of gun confiscation on the horizon, I just hope it's not a case of too little too late.

Also, what Secretary is it refering to; I think it would be refering to the Health and Human Services Secretary, which would do her zero amount of good anyway.

This was put in there to prevent the Healthcare Nazis from spying on people, when they went to their homes, as to the arms the individual on has avialable to them.

If there are enough votes to ban any type or all weapon, then there are enough votes to amend the Patient Protection and Affordable Care Act. The Act is written on paper, not stone.

he was a constitutional lawyer and professor who has continued and rapidly expanded every extra-constitutional policy of every president before him.


do not allow this to quell your fear about confiscation.
they ARE seeking complete disarmament of the uSA (no typo.)
a policy of incremental disarmament or total ban is irrelevant.
it's a matter of what the the public allow.

a single piece of legislation further infringing upon what is so unambiguous as the second amendment should be viewed with the same contempt, vigor and unabated rage as if it were a complete and total attempt at confiscation.

It just says that they can't use this law for it. They can always create amend, delete, veto....etc......

This looks like misdirection

This looks like misdirection by the press. "We aren't after your guns...See?" ...until the day after the banging on your door...
Then, they will say, "Well we really were, but we knew some people wouldn't like it."

Also, it probably just means, like the 4473, they aren't *supposed* to use information collected by medical practitioners to build a database of gun owners. In real life though, they will keep the questions about guns on all of their forms and send them up the chain, as directed.

That's just wronger than wrong. It would be neat if that were the case, but that language just says the secretary of HHS can't use the information gathered under obamacare for gun-related information gathering. Obamacare is not the supreme law of the land and the secretary of hhs is not the executive or legislative branch.

Obamacare is a big deal that people have heard of. Gun registration or grabs is a big deal that everyone has heard about. Somebody found the word "gun" in Obamacare and is trying to make it into something it is absolutely not. There are plenty of other ways the government can gather information on you without giving the secretary of hhs any new power. Sadly.

This find is encouraging, but does it really help?

The question now becomes this one:

Can an Executive Order negate this pro-gun provision of Obamacare?

If the answer is yes, then the coming e.o. will include an additional sentence addressing this issue in addition to the gun confiscation. If the government is hellbent on taking our guns away, these words are not going to stop them. The 2nd Amendment will not either.

I For One am Fed Up

With these executive orders. Just another modern day phrase for the Devine Right of Kings. Hope the American people wake up to that. Where are the checks and balances now?
