SC has found way to exempt citizens from gun laws WITHOUT Nullification
Submitted by Vots on Sun, 01/20/2013 - 00:10Tom Davis along with other SC state senators, is sponsoring a new bill that deals with any future federal gun laws, and it may very well become a blueprint for other states. Because get this, it doesn't nullify anything. How?
Exempt the state's unorganized militia.
"The unorganized militia consists of all able-bodied people over the age of 17 who are U.S. citizens residing in South Carolina and legally allowed to purchase a firearm, according to current state law....The bill, sponsored by state Sens. Tom Corbin, Tom Davis, Kevin Bryant and Lee Bright, excludes members of the militia — essentially all state citizens who are at least 18 years old — from any federal gun rules passed after New Year’s Day."

Hey, I'm in the Ohio unorganized militia!
It says so right in the Ohio Revised Code, Chapter 5923: ORGANIZED MILITIA
5923.01 State militia membership - limitation of troops.
(A) The Ohio organized militia consist of all citizens of the state who are not permanently handicapped, as handicapped is defined in section 4112.01 of the Revised Code, who are more than seventeen years, and not more than sixty-seven years, of age unless exempted as provided in section 5923.02 of the Revised Code, and who are members of one of the following:
(1) The Ohio national guard;
(2) The Ohio naval militia;
(3) The Ohio military reserve.
(B) The Ohio national guard, including both the Ohio air national guard and the Ohio army national guard, the Ohio naval militia, and the Ohio military reserve are known collectively as the Ohio organized militia.
(C) The Ohio naval militia and the Ohio military reserve are known collectively as the state defense forces.
(D) The unorganized militia consists of those citizens of the state as described in division (A) of this section who are not members of the Ohio organized militia.
(E) No troops shall be maintained in time of peace other than as authorized and prescribed under the “Act of August 10, 1956,” 70A Stat. 596, 32 U.S.C.A. 101 to716. This limitation does not affect the right of the state to the use of its organized militia within its borders in time of peace as prescribed by the laws of this state. This section does not prevent the organization and maintenance of police.

So if and when the feds decide firearms are illegal there will not even exist an "unorganized militia," i.e. federal gun rules would override the law anyway. Exempt my ass; this doesn't even have as much teeth as Sen. Feinstein's NDAA amendment (you can't violate due process unless congress votes yes) Basically They're exempt from whatever gun laws don't stop them anyway. Fail.

Depends on how it's worded
This could easily turn into a mandate that we all serve our states when called whether we want to or not and if the State is in cahoots with the Feds.. well it needs to be thought out.

The unorganized militia are the people. Those people need to be armed in case the need for activation arises. You could essentially use this against every gun restriction on the books.
