An update on Aaron Tobey's TSA lawsuit - he won today!

Wired: A Virginia man who wrote an abbreviated version of the Fourth Amendment on his body and stripped to his shorts at an airport security screening area won a trial Friday in his lawsuit seeking $250,000 in damages for being detained on a disorderly conduct charge.

Aaron Tobey claimed in a civil rights lawsuit (.pdf) that in 2010 he was handcuffed and held for about 90 minutes by the Transportation Security Administration at the Richmond International Airport after he began removing his clothing to display on his chest a magic-marker protest of airport security measures.

“Amendment 4: The right of the people to be secure against unreasonable searches and seizures shall not be violated,” his chest and gut read.

What I understood is that he didn't actually win the lawsuit--

what the judges ruled was that his case could go to trial.

I got clobbered in school when using Dissenting Judge Wilkinson's "reasoning". Lucky for us, this clown is in the minority on this bench.

Also, having worked in a Texas airport, Tobey would have gotten roundly applauded from the passengers waiting in the screening line. Nothing like this deluded (Honorable) judge excerts: Defendants responded as any passenger would hope they would, summoning local law enforcement to remove Tobey—and the distraction he was creating — from the scene.

I would like to ask the distinguished judge where he would have Tobey protest... some place far away from the 4th amend. violators, no doubt.

Congress should

pass a 2700 page bill that nobody reads banning markers that can write on skin. Ban the Markers! Ban the Markers!

The only real shame, aside from a dissenting judge, is that the fed's printing press will shell out the monitized judgement and the violators of constitutional rights will get off scott-free. Real people colluded to deny him his constitutional rights. Real people should be liable.

I appreciate this more than most, I'll bet.

Good news and bad news. Sure

Good news and bad news. Sure this guy gets $250K but who has to pay the $250K? Not the TSA agents that perpetuated this action, they did not all pooled together and came up with the money. In the ends it is us the taxpayers that eventually have to foot the bill. Not a single one of us approved this bogus TSA agency yet we have to pay their salaries and their lawsuits expenses. I bet all of the agents that withheld this guy still have their jobs today.

It is better to look dumb and not be, than to look smart and not be.

"Good news and bad news." It is unfortunate that the criminals are not being held personally liable, as is the status quo for "law enforcement" criminals, especially those employed by DC. The $250k won't slow down the TSA. It shows every agent and every flier that the TSA acts with impunity.

It is clearly great that this guy was able to get a little limelight like this, and even better that he was able to pick the fed's pocket, but they won't even bother printing it. They'll just click a few buttons and pretend like the situation was made right.

No one said Liberty was free........

Yes, taxpayers have to pay but look what we get, a landmark case that lets the TSA goons know they have limited power.

If we get more cases like this, eventually, taxpayers that support this nonsense will ire over patriots making gun money at their expense and demand a stop to the TSA over-reach (no pun intended).

Demonstrate that rights were violated.
