Update: It got postponed until Thursday and now in Circuit court. They offered Mark a deal of reckless driving and Mark said HELL NO. Now they say the reason he was arrested is because he was driving to fast and he almost ran over 3 officers. If that would have happened, Mark would have been bleeding in this video, broken nose and everything else after cops gave him a beat down because they are always looking for an excuse!

20 years ago in ohio, while younger and dumber, I was called to serve on jury allt he time...4 to 5 times a year. couldn;'t do it because I had small children at the time. Now, living in Tennessee, know about jury nullification and would really love to sit on jury, I haven't been called 1 time in over 10 years. I call this rather convenient.

I didn't watch the video... but, how is it possible that he blew .000 yet is being prosecuted for a DUI?

That basically makes no sense.

Is the officer claiming that his testing equipment malfunctioned?

Is the prosecution going to not use the breathalyzer evidence and instead rely only on some other part of testing that your friend failed?

This sort of case seems it would deserve news attention, maybe even national news attention. It's an embarrassment to have government officials who work on our behalf prosecuting people for DUI after they pass the breathalyzer with flying colors.

Exculpatory

The breath test is what is considered as "Brady material" (google "Brady material"). Since it's common knowledge (judging from the story itself) the he blew a .000 and that his urine test was negative, that evidence is considered exculpatory (tends to show innocence) and MUST be turned over to the defense. If the prosecutor doesn't use it you can damned well bet the defense will present it to the jury. The prosecution could try to claim he was under the influence of a drug that can't be detected by blood or urine (LSD for one comes to mind). I could have a lot of fun with that theory though in generating a metric butt-ton of reasonable doubt. Waaayyy to hard to prove and the behavior produced by that drug is totally different from what he was originally arrested for. That provides reasonable doubt right there. In the video, he is calm and coherent, something that is impossible for someone on LSD and I know this from personal experience.

I live 7.5 hours away now so if I was there I would be there with my camera. This event pissed me off enough to write something to my group at midnight. This is what I posted to my private email blog group just now:

Folks this one makes my blood boil. If this is not enough evidence now that we have become an absolute police state, I don't know what else to say.

Sometimes the states violate the US Constitution, too, such as in "unlawful searches and seizures."

Anyway, by the time you read this, the trial will be underway.

Besides my boiling blood, this case has special significance for me as it happened within a couple miles of where I grew up.

This guy's problem, even if he is innocent is that he went on rambling and talking to the cop. As you can see, cooperating, taking the tests, talking, answering questions, all backfired on this guy.

There is never any reason to speak to police. If you speak they can say you slurred your words. If you take the test, they can say you stepped out of line.

Best thing everybody could do is to present a card that says you will not waiver ANY of your Constitutional Rights.

And then you have the right to an attorney, or you have the right to remain silent.

Nothing worse than overzealous law enforcement. But there is never any reason to speak to them....AND IT IS BECAUSE OF INCIDENTS LIKE THIS!

From the get go, this can start off as a 4k retainer fee for a lawyer. Worse, this could end in conviction.

I think if everybody presented the card describing each right that will not be waived (and then just shut their mouth and not answer anymore Mickey Mouse questions)....maybe they will stop this throwing of crap at the wall for their pension scamming and grant/OT pay.

He said he was going to test negative and the cop said even if he did he was able to arrest him anyway because of his performance on the field sobriety test? You've got to be kidding me! I believe there are many innocent people in prison, and I show up for jury duty because I would want someone like me to be there.

After prop 215 passed in CA (medical marijuana) Seven of the people I had known from working on Prop 15, were arrested for distribution, and all faced 10 years mandetory minumums.. I went to those hearings, and stood up for these heros that were being made into criminals.. one died in prison. I think it's very important to stand up for people that are going down because they acted on something I believe in.

Back in the 80s

I met two nurses that protested nuclear testing in Nevada, were arrested 137 times each when I met them.... but back then, an organization could set up a bail fund.. not now with the Patriot Act.

I'm pretty sure the way to change that is through committee work.. you think it's getting arrested in between passiong out aaron russo movies.. at least you're haivng fun, eh?
