Where Is The Arrest Warrant And Evidence That He Did Anything? Deeply Disturbing

Part of the deep problem this country has is a complete lack of knowledge of the basics of our rights and court system. People aren't taught it in schools anymore on purpose, and are completely ignorant of what their basic rights are. Witness the answer to the following question.

"Since when does law enforcement have to prove guilt to the public? Isn't that the job of the courts?"

They need at least SOME evidence to go to a judge and get an arrest warrant.

Due process wasn't followed.

You can only arrest someone if you are following them after seeing a crime committed. Otherwise, you go to a judge, state the evidence that makes it seem likely the person committed a crime, and get an arrest warrant.

I have seen no newspaper account of arrest warrants issued or what information was given to a judge to lead him to believe there was a sufficient cause for an arrest warrant should be issued. The fact that they've been calling them suspects the whole time means there wasn't any evidence to get an arrest warrant, because they were called suspects.

Suspects are people you want to question, but you don't know enough to get an arrest warrant yet. YOU DO NOT USUALLY SHOOT AT SUSPECTS. These guys immediately started shooting. Without enough evidence to get an arrest warrant.

This is why he is now suddenly "an enemy combatant". There is no evidence, and no arrest warrant. Due process wasn't followed from the get go. So call them enemy combatant and claim you don't need an arrest warrant. This is the real reason, not "reading them their Miranda rights", which is pretty much small nonsense. They didn't have enough evidence to even convince a judge that they were anything but suspects.

If you believe they were

If you believe they were actually in a shootout.

Where's your proof there was

Where's your proof there was no warrant issued? Just asking.

Great thread MaxK.I am in awe

Great thread MaxK.I am in awe that anyone can disagree with you on this at this forum. Awe...

You stated and defended your position well here. I hope it cause those other contributors to pause and rethink as we all should from time to time to center on liberty.

Shucks that means a lot me.

Shucks that means a lot me. :)

You know we need to educate people about these basic rights. I may sound harsh, but I know I've been more ignorant myself in the past. It took a lot of years, and not ones that anyone in school would teach. The government and media basically acts like the Constitution doesn't exist - and it's hard to learn in that environment.

Come Monday, we need to start bringing this issue up, unless we want to wake up to martial law in our city next. I mean ***. The whole thing. But this too.

When idiots assume they have a "free speech"

right to talk about things they have no clue about, the result is verbal pollution and idiocy. That has become the hallmark of DP. Search warrant and arrest warrant is not the same. Arrest warrant does not apply to catching criminals committing the crime (stolen car.) It will be issued later by the judge.

I actually agree with you.

I actually agree with you. And why does everyone here think they have the right to see the evidence in an investigation. Are they all experts in these situations?

No it can't be issued later

No it can't be issued later you ignorant smuck.

There was no arrest warrant issued for these two for terrorist attacks. The police just started shooting at "suspects".

They had ample time to go to a judge to get an arrest warrant for terrorist attacks at the Boston marathon. There is no arrest warrant for that. Because there isn't enough evidence to convince a judge they did it.

OK, bubba

go to a Judicial website to spew nonsense about law, an anti-Semitic site to talk about Israeli women and to a religious site to preach religion.

So

weak

Considering you were not on

Considering you were not on scene, you make far too many assumptions in your argument.

The thing that does concern me is the application of a "public safety" excuse to withhold the arrestee's constitutionally guaranteed right to a lawyer. I believe this rotten kid and his brother did what they are accused of, but the younger kid is in fact an American citizen. Constitutional rights are not something that can simply be erased or withheld whenever most convenient to law enforcement or the government. It has to be protected for the best AND the worst of us.

Based on what evidence?The

Based on what evidence?

The entire point is they haven't released enough for anyone to determine that, even to a judge who is suppose to go it. People, reporters, everyone has been asking the whole time. Not even a judge got it, and now they're going to call the kid "an enemy combatant" and claim they don't need it. Where's the evidence for the arrest warrant?

So we shoot suspects now and shut down an entire city - without even an arrest warrant?

I'm making no assumptions, and you know it

I'm not making any assumptions.

They didn't have an arrest warrant. If they had, it would have been in the papers with the reasons for why they were being sought, because every reporter was asking for it.

A suspect means exactly that. Someone who doesn't, and may not ever, have an arrest warrant issued.

You have to have an arrest warrant to arrest someone if you didn't see them commit the crime and followed them.

It is exactly this reason they are now called enemy combatants.

Have we seen the video of one

Have we seen the video of one of the brothers placing this bomb?

Have we? Where is the proof

Have we? Where is the proof that the bomb was in that backpack? And how do you know he wasn't following instructions as an actor in a drill?

I haven't, did you?

I haven't, did you?

They only became brothers early friday morning. Before that, other people were suspects. Seeing someone isn't seeing their name or identifying them, and it's obvious they didn't even know their name.

If they had the evidence, they would have released it 2 days ago when everyone was saying they wanted it, and gone to a judge for a warrant.

That is why they were only called suspects. but you don't shoot suspects. You can't even arrest them without a warrant.

I'm pretty sure you don't shut down a whole city without even an arrest warrant.

We just saw complete madness on TV.

I agree I was just watching

I agree I was just watching the evening news which i rarely do and this is just way to neat of a package all tied up and sealed now with this arrest. People cheering in the streets as if this guy has been tried and convicted already no one concerned with the unlawful order to stay in your house and house to house searches with no warrants or probable cause and one guy was in his window with his smart phone filming as swat and military searched his yard and garage without a warrant...

Makes me sick one of birth places of liberty cheering on the police state and they got their man how convenient and of course it was all fed to the news to report the blow by blow. And Obama speaking as if he caught the guy himself when was the last time that happened? Since when do detective give a blow by blow to the media when investigating a crime...Sigh!

Looking on this site and watching the media

Looking on this sight and watching the media, and many people don't even know what an arrest warrant is, or the difference between seeing a crime committed and getting one otherwise.

The attack I'm afraid is ignorance, education, propaganda. Maybe even the water. But it isn't natural for people to think like this or to be this ignorant. But they are ignorant!

Let's keep this thread bumped and at least educate a few.

And for the support of this Declaration, with a firm reliance on the protection of Divine Providence, we mutually pledge to each other our lives, our fortunes and our sacred honor.

Amendment Four of the Constitution

Amendment Four
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized..

There was no evidence released to the public, no copies of arrest warrants or oaths mentioned in the papers, about the probably cause and reasons to arrest these two people.

BECAUSE IT DOESN'T EXIST. NO EVIDENCE to even arrest.

They just shot two people without warrants, and shut down the entire city of Boston without any evidence. And neither the public or any judge has any reason to think they even did - no evidence given.

And for the support of this Declaration, with a firm reliance on the protection of Divine Providence, we mutually pledge to each other our lives, our fortunes and our sacred honor.

faces of men in the photograph & last set of suspects matching

By the way, a minor note, and I didn't want to make it a different thread. It is a question.

They kept changing the names of the suspects through Thursday night after releasing the last round of photographs, and also the number of suspects if you were watching. The first set had two different last names. They now claim it was actually brothers that did it.

The photographs released show two men that look nothing like brothers. Does everyone else agree with that?

Two: Although the picture of the corpse of the first suspect is gruesome, I didn't think his face looked like one of the suspects. Anyone else agree or want to take another look?

And for the support of this Declaration, with a firm reliance on the protection of Divine Providence, we mutually pledge to each other our lives, our fortunes and our sacred honor.

The faces don't look like the

The faces don't look like the ones of the corpse, or brothers. Again, not sufficient reason to convince a judge to get an arrest warrant, and apparently, they didn't get one.

They were called suspects the whole time. It's why he's being considered an enemy combatant, so you "don't need an arrest warrant".

They never released any evidence to the public proving these were the men while this event was going on, and apparently they didn't have enough evidence for a judge either.

And for the support of this Declaration, with a firm reliance on the protection of Divine Providence, we mutually pledge to each other our lives, our fortunes and our sacred honor.

Really?

It is alleged, by the kidnapped carjack victim, these two guys said they did it! They are the ones who allegedly, again, killed the cop. I don't think anyone is going to wait for an "arrest warrant" to shoot back when they are being fired upon, cop or not! ARREST WARRANT MY ASS!

Then again, they were stupid enough to shoot a hole through the boat!? Did the cops not get training that tells them that they identify their target, first? Shooting blindly through doors, walls (and boats) is against all sane gun rules! Maybe a lot of them should not be allowed to carry guns. They should have never fired a single shot through the boat!

I wonder how long it took them to figure out how to take the tarp off of the boat! The guy could not see through the darned boat. (FLIR could see him!?) Crawl under it, cut the straps and pull the thing off. They needed a robot to do it for them because they were too cowardly to figure out how to do it, simply, without being seen?
