Bombing suspect won't be charged as 'enemy combatant'

Good News

(CNN) - The surviving suspect in last week's Boston Marathon bombings, Dzhokhar Tsarnaev, "will not be treated as an enemy combatant," but rather will be prosecuted "through our civilian system of justice," White House spokesman Jay Carney told reporters Monday afternoon.

"Under U.S. law, United States citizens cannot be tried in military commissions," he said.

Translation: we'll let this guy have a trial

but we're gonna change some laws so the next "domestic terrorist" doesn't get one.

Fixing the criminal complaint:It's a State crime not Federal,etc

Although he is now at least in the system and is not being called a "military combatant", so there is some improvement, there is no federal jurisdiction in this case, it's a State crime.

Likely, he will also be charged with State crimes, thereby giving the problem of double jeopardy. This has caused problems in the past, so charging him in two different jurisdictions should be dropped - and he should be charged in the State only, where the crimes were actually committed.

If you read the criminal complaint, you'll see the following things contrived:

"weapon of mass destruction", is nonsense.
"using it to destroy property" - all of which is in the State of Massachusetts, so not federal, is again nonsense.

Strike "territory (district) of Massachusetts" and put "State of Massachusetts" in for where it occurred.

Strike "United States of America" as plaintiff, and do not put "State of Massachusetts" in as plaintiff, but the actual murder victims, injury victims, and property victims of the bombing. Putting in a State as a plaintiff instead of the actual victims was one of the first corruptions to our legal system. States are not actual victims - and it is a violation of your rights to have accusers that you can not face.

Put in the lawyers of those representing the plaintiffs (aka prosecutors) and defendants if you will - which in this case currently is the public defender and public prosecutor - which can later be changed to private lawyers on either side, but be aware that having socialized public prosecutors is what originally caused this mess - they usurped their authority over the decades and a hundred years to end up having this mess, which resembles nothing as to what it was or should be.

Who Signed The Consent Form For Sedation Medication?

In this CNN article here (see: ) the doctors describe how a patient can be brought out of medical sedation (i.e., "sedation holiday") for periods of time and them returned to full sedation again.
In order for deep sedation to be used, there must be consent given either by the patient or someone who has permission to give consent on the patient's behalf (see: ).

If Dzhokhar Tsarnaev was not awake an alert to give consent, then who signed the sedation consent form? Why would the doctors keep him sedated and for how long will it continue? How will his lawyer be able to communicate with him if he does not remain awake?

many times you will find "official" correspondences from GovCorp Inc officials do not even bear an autograph or seal - nor are they "official" in any way.

It's very likely some ignorant doctor looked at some very official looking form with NO autograph on it and just "did his job" without question.

Autographing a document like that would make that individual legally responsible for the action... nobody in "gov" wants to be responsible or held liable for anything they do. They like to steal from you purely on your own ignorance... rather than breaking the law.

anything he said prior to being mirandized cannot be used in court. The purpose of delaying Miranda is to get info that might prevent another attack...but the info will be suppressed in court.

Perhaps they interrogated him before reading his rights was to bypass an attorney so they could get intel on possible other plots or who trained them ect and maybe they have enough damning evidence without a confession so it would not matter if the confession was thrown out because the info they sought was not going to be used in court anyway. Just saying.

According to Beth Israel Deaconess Medical Center, Dzhokhar Tsarnaev remains in serious condition. The FBI is releasing this information at the request of the hospital.

Moments ago, in addition to White House spokesman John Carney announcing Boston bombing suspect Dzhokhar Tsarnaev, who became a US citizen several years ago, will not be treated as an enemy combatant and that he has just been charged under seal, the FBI released a "status update" on his health condition, which is listed as "serious."
