Missouri Legislature Nullifies ALL Federal Gun Control "law" by a Veto-Proof Majority!

Missouri (my state) just passed, by veto proof majority, the most comprehensive nullification of federal law in American history, I'm really really proud.

Goodbye NFA, hello freedom.

From the 10th Amendment center:

As law, HB436 would nullify virtually every federal gun control measure on the books – or planned for the future. It reads, in part:

All federal acts, laws, orders, rules, and regulations, whether past, present, or future, which infringe on the people’s right to keep and bear arms as guaranteed by the Second Amendment to the United States Constitution and Article I, Section 23 of the Missouri Constitution shall be invalid in this state, shall not be recognized by this state, shall be specifically rejected by this state, and shall be considered null and void and of no effect in this state.

(2) Such federal acts, laws, orders, rules, and regulations include, but are not limited to:
(a) The provisions of the federal Gun Control Act of 1934;
(b) The provisions of the federal Gun Control Act of 1968;
(c) Any tax, levy, fee, or stamp imposed on firearms, firearm accessories, or ammunition not common to all other goods and services which could have a chilling effect on the purchase or ownership of those items by law-abiding citizens;
(d) Any registering or tracking of firearms, firearm accessories, or ammunition which could have a chilling effect on the purchase or ownership of those items by law-abiding citizens;
(e) Any registering or tracking of the owners of firearms, firearm accessories, or ammunition which could have a chilling effect on the purchase or ownership of those items by law-abiding citizens;
(f) Any act forbidding the possession, ownership, or use or transfer of any type of firearm, firearm accessory, or ammunition by law-abiding citizens; and
(g) Any act ordering the confiscation of firearms, firearm accessories, or ammunition from law-abiding citizens.

I've been having this

conversation with a lawyer/legislator in my state. The judicial branch cannot change the language of the law. Only the legislative branch can change the language of the law.

By changing the language of the law to find Obamacare constitutional, the Supreme Court overstepped its constitutional authority. Obamacare was passed unconstitutionally in congress and then was found constitutional by the Supreme Court unconstitutionally.

The "Show Me State" shows the rest of the States how it is done

This from the Huffington Post:

On states passing legislation to nullify federal laws on guns:

Robert Cottrol, a law professor at George Washington University, told HuffPost last week when the Missouri legislation was passed that states are prohibited by the Constitution from overriding federal law and that any state law written as such would likely be struck down in court.

http://www.huffingtonpost.com/2013/05/01/alabama-gun-bill_n_...

What part of "Congress shall make no law..." doesn't this esteemed law school professor not understand?

That is what I thought when I heard of nullification

But, this is a great test! And, my congratulations to the Americans of Missouri for having a state legislature that at least has the spirit of the law of the law of the land.

The Constitution was an agreement to use Article V instead of nullification which was problematic leading up to the Constitution. So, in that way, nullification is going backwards.

There has been a concerted effort, and public schools have often participated "to dumb down" and selectively teach American government, history etc. Accordingly the logic of Article V replacing nullification goes forwards with the great contract. Now, implied here is that all rights are unimpaired in every way, so Americans maintain a true appreciation of Constitutional intent enabling states citizens to take their state to Article V in unity.

That's where states start to think nullification to enforce states powers. What has happened is that the abridging of free speech has disabled the people from supporting the states towards a proper Article V.

We shall see at least; if the state backs down from legal pressure, then if not-do the feds try to enforce outside of state control? Now, "does the state uphold its own laws?", becomes the question.

Examine this proposal for preparatory amendment at a new Article V forum.

Can we stop doing all the things we are doing that we do not want to do while still doing what we need to do?

Glad Missouri is following Kansas lead

It is appropriate that the heartland is doing it first.

What is your state doing?

Now the Lord is that Spirit: and where the Spirit of the Lord is, there is liberty.

Wait a moment, so if the Liberator gun files get hosted in that state, doesnt that mean there is nothing the feds can do to shut it down this time?

To climb the mountain, you must believe you can.

does this bill forbid mandating of any gun/gun-owner insurance?

thanks.

suppose it's broad and open ended enough to include "insurance" in that definition.

but we're talking govt...so left to their devices... well, y'all know the deal: it's always the native impulse of all statists to want a full blown dictatorship, if they had their way.

I'd say better safe than sorry and list every govt prohibition under the sun. lol.

This reminds me of way back in 1989

when news spread of a domino effect of Soviet Republics declaring independence one by one. I don't think it will go that far right away, but this is encouraging.

Remember to support Curtman's

Remember to support Curtman's HB 421 for the sound money in MO. It's stalled and needs more phone calls. http://www.house.mo.gov/billsummary.aspx?bill=HB421

That wipes out everything.

Even machine guns are free game now. Even Texas isn't that free with its gun laws.

They just nullified the '34 act!

That is awesome!

I wonder if any automatic weapons manufacturers will spring up, and I hope they are prepared to fend off the ATF.

SW Missouri

The most Liberty minded part of the state.

The legislature is about to defund the Missouri Dept. of Revenue as well.

The Governor (D) Jay Nixon illegally sent conceal carry gun owners info and anybody who applied for a Drivers Lcense Info to the Federal Government to comply with the Real I.D., only one problem Missouri outlawed any compliance with the Real ID.

Governor won't stop getting the info illegally and sending it to the Feds, so the legislature is about to defund the Dept. of Revenue.

Huge scandal

Freaking AWESOME!!!

Freaking AWESOME!!! Did your Governor sign it into law? Whats your Governor like?

*Wisconsin Constitution* Article I, Section 25 "The people have the right to keep and bear arms for security,defense,hunting,recreation or any other law-abiding purpose"

Jay Nixon

Is a tyrant wanna-be, but we don't need him to sign it. It passed with a veto proof majority.

He just recently was identified as being in coercion with Janet Napalitano in providing the SS administration, DHS, and the ATF with a list of Missouri ccw holders (me included).

Despite him pleading ignorance there has been proof found to the contrary. (thank you letter from cousin Janet) The legislature recently defunded the DOR in Missouri, and the head of the DOR resigned over this. It's a huge scandal i wish was getting more coverage.

I love the massive growth of

I love the massive growth of the gun culture in America. Thank You Mr President and thank you Missouri.

How could this possibly

How could this possibly happen when 90% of the people support gun control? Well, speak up obama, I can't hear you.

If this is in fact

If this is in fact operationally true, meaning that since the passage of this legislation that there will be no more ATF background checks or handgun waiting period, or the need for Class 3 approval and other such things, then I may move to you State. That being said, I have a feeling if this does happen in Missouri, then the Feds will make it difficult for the Guns Stores to purchase weapons from outside of the State.

I would like for more States to pass this legislation; it would put more pressure on the Feds.
