Activists are rallying to secure the release of former Marine and broadcaster Adam Kokesh, who was arrested by police in Philadelphia on Saturday during a speech he gave at a marijuana legalization protest.

As the video documenting Kokesh’s arrest proves, he was not smoking marijuana when he was snatched by cops nor did he resist arrest. Kokesh’s “crime” seems to amount to no more than exercising his right to free speech under the First Amendment.

However, Kokesh still remains interned in a federal jailhouse in Philadelphia under charges of resisting arrest. He has not been charged with drug possession or use of drugs.

Kokesh’s abduction by Philadelphia cops underscores the fact that Americans are now being kidnapped and temporarily disappeared into the prison system for the egregious crime of engaging in constitutionally protected free speech.

UPDATE: The video below from a supporter confirms that Kokesh has been charged with felony assault of an officer and that he will not be allowed bail because of “a possibility of a history of excessive drug use.”

Radio host Adam Kokesh was arrested Saturday in Philadelphia during a Smoke Down Prohibition rally.

As witnessed in footage of the event filmed by fellow activists, Kokesh appears to have been arrested for the victimless crime of exercising his First Amendment right to free speech.

The talk radio host recently garnered national attention when he announced a July 4th armed march on Washington D.C. in defiance of the capitol's firearms laws. As of yet, it's unclear whether his connection to the upcoming event had anything to do with his arrest.

On the Sunday broadcast of the Alex Jones Show, Alex spoke to one of Kokesh's crew members, Lucas, who stated the feds haven't yet disclosed where Adam is being detained.

With all the BS 'charges' they tacked on, what is conspicuously missing, as far as publicly known is a drug possession charge.

They literally flung any shiite on, to see what would stick, regardless of all the video evidence that CONTRADICT ALL of the Feds' BS charges vs. Adam, from the usual 'resisting arrest, failure to process, and assaulting a Fed. "officer," etc.

"Assaulting an Officer"-'charge' always cracks me up. It'd be hilarious, if the sentence for it weren't so grave: up to 20yrs, which is more than what one actually serves (not sentenced), on average, for MURDER in America: 8yrs.

Granted, I'm preaching to the choir here, who already know that in fact, the State-actors DO assume & act like they are 'better' than us 'mere mundanes.' Regardless, for 'assaulting an officer' to be a legitimate 'crime,' they'd have to openly admit publicly that they're some separate class of humans/individuals, who are basing their 'logic' on the assumption that they are fundamentally 'above' us, or 'better than' us, their employers.

The only way that they can rationalize punishing the citizenry more for the same type of alleged 'assaults' if they were committed between two, non-govt workers, is to utterly violate the "No Bills of Attainder"-clause of the Constitution.

Because if so, they'd have to openly claim that we, their employers, are a separate class of human sub-species who deserve to be punished more for the same exact type of crimes, because 'we are lesser than they.'

anyway, in the interview, AK's producers claimed that the Fed. scums 'convinced' the judge to deny Adam bail because 'he MAY use excessive amount of drugs!' LOL!!!

But really, let's face it, it's because they already know who he was, is, and plans on doing on July 4th, 2013, and it's public knowledge that he has guns at his VA home.

On today's Alex Jones Show, Adam's producers were interviewed again: AJ wisely advised Lucas, one of the producers and himself a US Navy vet, to cool off and avoid their Virginia AVTM HQ, for a couple of days, if at all possible. And, try NOT to make any further provocative statements, until Adam's situation has been sorted out, as to not give them ANY excuses to clamp down on them, any further, because AJ sensed that the Feds could escalate this into a 'medical gun confiscation'/'barricaded suspect' vs. SWAT-scenario (the excuse of 'if you have PTSD, you shouldn't be able to own guns,' blah blah blah statist BS) and let the drama play our for the MSM cameras.

just talked to jerry weaver @ US Federal Courthouse (Phila): (215) 597-7704 and was told adam is being charged with a whole bunch of stuff including assault, interference, force-able resistance and a few other things.

jerry tried his best not to give me his name when asked and responded with questions about who i was and what i wanted. this went back and forth a few times until i got his first name. getting his last name took even more back and forth and a question about the call being recorded. he (the main operator) has a speech impediment which did not help either.

the Philadelphia Federal Prison: 215-521-4000 claimed to "know nothing" about the charges and told me to call the court but were too lazy or incompetent to provide the number. they were rude and quite the obstructionist as most government hacks are.

First of all, there have to be laws, and no a government by consent does not mean that after those laws are passed, we each individually get to second guess them.

So if a law exists, whether we believe it is a good law or not, the police can enforce it. It is illegal to incite others to break laws.

I suspect they arrested him for that/public disturbance/ etc.

I don't see why this is such a solid thing to rally around. There are bigger injustices in the world. Sorry.

..as that is the decision which initially determined/clarified/established (depend upon whom you talk to) the power of the Judicial branch to interpret the Constitution and rule on the constitutionality of hte acts of the other branches. So, you've cited the seminal opinion that lead to courts upholding as constitutional laws which seem on their face to directly contradict the constitution. That's right, without Marbury, no law abridging freedom of speech could exist, as the constitution says so. With Marbury, well, there's some complicated reasoning that a panel of judges engaged in which results in that very thing happening, sometimes. And so on.

What Adam Kokesh was doing at the protest was civil disobedience.

When you practice civil disobedience you can be (and you should expect to be) arrested. Your question then is only whether you're willing to get arrested for the cause you're supporting.

The point you make is exactly the problem

In reality - the police can arrest you for anything under the guise of another law.

Take for example in CT. You 100% have the right to open carry a pistol or revolver in CT if you possess a permit. However, none do - you know why? If you do they will not arrest you for carrying the gun - they will arrest you for - wait for ittttttt.
Disturbing the peace. As long as someone complains you are in fact disturbing them and their peace.

It is a solid thing to rally around because Adam threw down the gauntlet with his march on DC. It is a chess game - and the Fed just made a big move - the first back row piece to be taken so to speak.
