Activists are rallying to secure the release of former Marine and broadcaster Adam Kokesh, who was arrested by police in Philadelphia on Saturday during a speech he gave at a marijuana legalization protest.

As the video documenting Kokesh’s arrest proves, he was not smoking marijuana when he was snatched by cops nor did he resist arrest. Kokesh’s “crime” seems to amount to no more than exercising his right to free speech under the First Amendment.

However, Kokesh still remains interned in a federal jailhouse in Philadelphia under charges of resisting arrest. He has not been charged with drug possession or use of drugs.

Kokesh’s abduction by Philadelphia cops underscores the fact that Americans are now being kidnapped and temporarily disappeared into the prison system for the egregious crime of engaging in constitutionally protected free speech.


As Paul Joseph Watson notes: "Although Kokesh is likely to have an initial hearing today, there is no guarantee that he will be released."

UPDATE: The video below from a supporter confirms that Kokesh has been charged with felony assault of an officer and that he will not be allowed bail because of “a possibility of a history of excessive drug use.”


Incarcerated political activist Adam Kokesh, arrested by police for exercising his First Amendment rights during a pro-marijuana legalization protest on Saturday, is set to be charged with “assaulting a federal police officer,” despite the fact that the video of the incident shows him not resisting arrest.

“I’ve received word from a reputable but not official contact that Adam will be charged with assaulting a federal officer under 18 USC 111,” writes supporter and activist George Donnelly. “This is a very serious charge. Take note that this is not official information yet. The source however is very reputable.”

Kokesh was kidnapped by Philadelphia police as he gave a keynote speech on Saturday. The former Marine was not smoking or in possession of any drugs when he was arrested.

Radio host Adam Kokesh was arrested Saturday in Philadelphia during a Smoke Down Prohibition rally.

As witnessed in footage of the event filmed by fellow activists, Kokesh appears to have been arrested for the victimless crime of exercising his First Amendment right to free speech.

The talk radio host recently garnered national attention when he announced a July 4th armed march on Washington D.C. in defiance of the capitol's firearms laws. As of yet, it's unclear whether his connection to the upcoming event had anything to do with his arrest.

On the Sunday broadcast of the Alex Jones Show, Alex spoke to one of Kokesh's crew members, Lucas, who stated the feds haven't yet disclosed where Adam is being detained.

I don't buy

the disturbing the peace thing.

Wikipedia on disturbing the peace:

Disturbing the peace is a crime generally defined as the unsettling of proper order in a public space through one's actions. This can include creating loud noise by fighting or challenging to fight, disturbing others by loud and unreasonable noise (including loud music), or using offensive words. ...

Standards for whether to charge someone with disturbance of the peace are highly subjective, and in many jurisdictions courts are highly deferential to the opinion of the arresting/charging officer as to whether the accused's actions violated the law...

I find it hard to believe simply open carrying a gun, legally with a permit, would get you arrested for disturbing the peace. You're not taking any action. How could any judge rule that you were breaking the law?

And what difference does it make after the fact and years later when you finally get to a judge if he rules for you?? Yeh - now you only lost how many months of your life, tons of money, aggrivation etc.

And my bad - the charge was Breach of Peace to be exact.

Time to wake up people.

it wouldn't surprise me

it wouldn't surprise me to find isolated cases where that happened. But likely, even if there were an arrest, charges would not be brought or would be dropped because it is legal. Doing something that is perfectly legal may in that instance alarm people and certain cops that aren't thinking about hte constitution might arrest you just because it is unusual and they think you are up to no good. That certainly doesn't make it right that they could do so, but disturbing hte peace is not a proper charge for someone doing something entirely lawful.
