Insane Bong & Pipe Ban signed by FL Gov Rick Scott. 2x = Felony!

That's right, starting July 1st smoking devices are now illegal in Florida. Anyone found in possession of a pipe two times (even if it has never been used) becomes a third degree felon. In Florida, this means you are permanently banned from voting. For a fucking pipe.

With one swoop of the pen Rick Scott may have put thousands of companies out of business, and their employees looking for jobs. They also need to offload their entire inventory before July 1st when the bill goes into effect (yea, only a couple weeks from now).

The bill I'm talking about is FL HB49 / SB1140

Specifically the bill bans:

(a) Metal, wooden, acrylic, glass, stone, plastic, or ceramic pipes, with or without screens, permanent screens, hashish heads, or punctured metal bowls
(b) Water pipes.
(c) Carburetion tubes and devices.
(d) Chamber pipes.
(e) Carburetor pipes.
(f) Electric pipes.
(g) Air-driven pipes.
(h) Chillums.
(i) Bongs.
(j) Ice pipes or chillers.

From the final report:
Establishes the following five drug paraphernalia crimes:
1. use or possession of drug paraphernalia
2. manufacture or delivery of drug paraphernalia
3. delivery of drug paraphernalia to a minor
4. transportation of drug paraphernalia
5. advertisement of drug paraphernalia

Another disturbing revelation in the final analysis of the bill:

"...the Criminal Justice Impact Conference determined that SB 1140, which is similar to
CS/CS/HB 49, will increase the state prison bed population...."

The criminal justice committee met about the bill and noted in their summary:
"The bill may have a negative fiscal impact on state and local governments."

"it may
have a negative prison bed impact on the Department of Corrections."

"The bill does not appear to have any impact on state revenues."

How can a pipe or bong be made illegal? Are matches/lighters going to be made illegal as well? How about rolling papers?

Just stopped by my head shop... They say the law addresses "intent" like every other law that already exists. They own multiple head shops so it would be in their interest to know. They had no worry or fear over the law.

I'm with the poster below who speculated that this kind of nonsense is likely being done as a means of re-demonizing marijuana before the 'legalize it' crowd gains any more traction than they already have.

I hope you're right somehow, but I can't find anything to validate that. I just went to my local head shop and they were freaking out.

"It is unlawful for a person to knowingly and willfully
16 sell or offer for sale at retail any drug paraphernalia
17 described in s. 893.145(12)(a)-(c) or (g)-(m), other than a pipe
18 that is primarily made of briar, meerschaum, clay or corn cob."

Nobody sells drug paraphernalia

They sell unique tobacco smoking pipes. If that is the rewording, it's meaningless. The "other than" line is funny though. It's ok to knowingly sell drug paraphernalia as long as it's not nice drug paraphernalia I guess.

Paraphernalia is described in 839.145
The bill specifically bans section 12 a-c and g-m:
(12) Objects used, intended for use, or designed for use in ingesting, inhaling, or otherwise introducing cannabis, cocaine, hashish, hashish oil, or nitrous oxide into the human body, such as:
(a) Metal, wooden, acrylic, glass, stone, plastic, or ceramic pipes, with or without screens, permanent screens, hashish heads, or punctured metal bowls.
(b) Water pipes.
(c) Carburetion tubes and devices.
(d) - (f) not banned
(g) Chamber pipes.
(h) Carburetor pipes.
(i) Electric pipes.
(j) Air-driven pipes.
(k) Chillums.
(l) Bongs.
(m) Ice pipes or chillers.
(n) - (v) - not banned

I haven't read the bill but

I haven't read the bill but is there any language that indicates that this new law would require evidence that shows that the item was being used for drugs? Such as residue in the pipe for example? If not, I don't know how it would be possible to enforce otherwise. There is no way to describe the limitless "things" that could be used provide a definition of paraphernalia.

Ok, that would be a pretty big deal in enforcing it, proving what it was intended for. I would think if someone had replaced all their lawn ornaments with bongs and bowls, aside from some pissed off neighbors, there wouldn't be anything anyone could do about it, not that I condone lawn ornaments mind you.

Am I reading all of this right?

reading the final bill analysis it seems as though the original 'list' contained in the bill text was replaces will "drug paraphernalia as defined in..." but then the referenced definition of paraphernalia includes tons of normal stuff like lights that "could be" used to cultivate controlled plants (which could hurt all hydroponic and gardening shops). It also includes kits that "could be used" to cultivate controlled substances. Does this mean gardening centers could be slapped with 1st degree misdemeanors, and then felony charges for a second offense for selling indoor growing equipment?

I am not clear on what exactly the final bill text is, and whether it is only supposed to be sales or if possession was still in the final text. The website shows different proposals and drafts but wheres the full final text?
