Much of a hoot as this is, important principles underlie.

Check the telescopic thread below. It's a hoot. On it's surface it's the status quo (individual) vs. the individualists (as a group) which is funny enough as it is but this might as well be Monstanto. Catch the part about the "rat" dude's weed seeds contaminating everybody else's lawn?

Courts have repeatedly found Monsanto free of responsibility in cases of breed contamination, they can even force farmers to pay royalties to Monstanto even when they didn't want that seed in their fields to begin with.

You are on shaky territory if you are against Rat Man below. He can now proceed against you and force you to pay royalties for growing his seed.

I hear concern for property values and understand the argument. His property condition somehow lessens your property value. So goes conventional wisdom. Arizona law is quite clear on this, and this is why HOA's are very popular among retirees and people who require everybody else to measure up to a certain standard because AZ law specifies that if you don't like what I do with my property you can make me an offer to buy it or you can pray I leave and somebody you like better buys it.

What I like best about some comments below is the implication that people who don't conduct themselves in a "normal" manner have less rights than those who do. But I suppose the counter argument is that they have every right in the world to simply CONFORM.

But there we are. At what point does your neighbor's rights curtail your own rights as a property owner? Who's seed is it anyway? Current libertarian "environmentalism" suggests that if you can prove material damage and it's source you have a civil court case against that source. Which will naturally result in more financial and work-value related damage.

How about the rat issue? The real ones, not the person hosting them. They can cause hella property damage and represent a legitimate health risk. What if a neighborhood dog contracts rabies from these rats? Seems a growing legitimacy in concern on that score. What if a child is infected?

I have a trashy neighbor

His yard makes the whole street look like chit! Weeds that go to seed and contaminate everybody's yard around him with weed and bug problems. Everybody is pissed off at the guy. Rotten boards on the house with curling paint and rats going in and out at night. He's been served MANY times by the city and he just keeps on keeping on. We neighbors have to mow his grass because he wont do chit until he gets threats by the city about it and even still its only a half assed attempt. How the guy can even afford to live here is beside me. Why do people who cant keep up their lawns and house maintenance move in to nice neighborhoods in the first place ? I wish they would remove this Rat, i really do. He has no business being in this neighborhood PERIOD. People like this guy are a eye sore and devalue peoples property. This guy isn't even fit to live in a barn. I have no sympathy for filthy people , none at all...

You don't have the right to

You don't have the right to not have to see a property that you deem ugly. By that logic the good-looking can go around making the ugly mask their faces. If you say that they don't have a right to their property, so you get government involved in either forcing them to cut it, send them to jail, or outright removing them by force, what makes you think you still have a right to yours? Or don't you care about absolute property rights?

You have no right to not have

You have no right to not have to see something ugly. A property is land. Too many people are putting money before everything and trying to make every thing in existence an instrument of profit. Land is a place to live, not an investment. You seem to think you have the right use government to force others to make their property look a certain way. So I'm just trying to find out where your line is where people have an absolute right to something. Weeds are not pollution, and neither are rats. You also talk about how the paint on his house looks, the way his car looks, and how the inside of his house looks. All things that don't spill over onto your land, and you think he has to be forced to change such things.

Your property values are not his problem. If this is such a concern for you, you should have thought ahead and bought property with no neighbors. You can also move.

I hope that you will reflect upon yourself, and consider what property rights actually mean.

* Offer to assist cleaning up, if it bothers you that much.

* Invite him/her over for a drink and discuss property values.

* Consider moving to a neighborhood where others are more inline to you.

Guy we have already done this...you should read before you post. Over the last 7 years i have probably upped several hundred dollars worth of yard maintenance for this Rat and we are currently talking about painting this Rats nest as well...If this is the freedom you dolts are pushing your going to have a hell of a time selling this 'trash'...

I cant move and leave that Rat infestation next door for my good neighbors, what kind of neighbor are you anyway? Besides that, i couldn't sell my nice castle with a Rat infestation next door unless i knocked it down to 1/3rd the value then my nice neighbors would have two Rat infestations instead of one...what kind of neighbor does that to people ?

Maybe it is time for you to think outside of the box and come up with a better legal/peaceful solution. Throwing even more money at this may not be wise, is certainly not conservative, as it may lead to more welfare enabling.

we keep our grass longer. We have many very neat and tidy garden beds, and we have a lot of garden in our front yard (done discretely)--

but we looked long and hard for a neighborhood that would accept our way of doings things--

Our gardens are very productive, but we focus on food, not on grass. Every year we get rid of more grass, but one of the things we do is keep our grass taller--

and we use no chemicals--

whereas our neighbors might mow every week, we mow more like very two weeks (at the most)--

if we need to get a harvest in, the food comes first. We've had no complaints from neighbors, but we work hard to keep things looking nice, in spite of our long grass.

We are also older, and one of us has severe health problems. When health is good, things are always tidier. We share food with our neighbors, too.

As I said, I am just very glad that you're not my neighbor.

Have you taken the time to get to know this person? Perhaps there is a health problem. Maybe you're right; maybe he's a lazy guy; maybe he just doesn't want to work, but do you know that for sure?

we have taken the time to get to know him ( not that anybody would want to). We have asked him nicely to cut his grass, we have done everything we can to get this Rat to clean up his house and yard and he doesn't. The guy drives an old dented up beater that leaks oil all over the driveway. Like i said, how he could ever afford the house in the first place is beside me. He must have sewed somebody or something. This guy NEVER cuts his grass. Apple's to Oranges here guy. I have neighbors that grow vegetables in their flowerbeds. That is not whats going on here...You can try all you want but you cant make excuses for pure Filth and this guy is the definition of the word... he is a filthy RAT ! What kind of neighbor would sit back and watch his neighbors have to come over and cut his grass ? We are even considering painting his house because he wont do it! Filth is Filth, simple as that...

He wont even pay to have his yard mowed or his house painted. One of my neighbors looked inside one day when he answered the door and told me i wouldn't believe what is inside the guys house. Piles of junk and garbage like one of those pack rats you see on TV. All sewing him would do is get a judgment against him and he would still remain. Its a hopeless situation...

he doesn't have a problem making it to the bar everyday in that wreck of a truck he drives but no money to cut his grass or paint his house. If he is depressed, maybe he needs to get some help.
