Supreme Court rules drug companies exempt from lawsuits

Washington. In case readers missed it with all the coverage of the Trayvon Martin murder trial and the Supreme Court's rulings on gay marriage and the Voting Rights Act, the US Supreme Court also made a ruling on lawsuits against drug companies for fraud, mislabeling, side effects and accidental death. From now on, 80 percent of all drugs are exempt from legal liability.

In a 5-4 vote, the US Supreme Court struck down a lower court's ruling and award for the victim of a pharmaceutical drug's adverse reaction. According to the victim and the state courts, the drug caused a flesh-eating side effect that left the patient permanently disfigured over most of her body. The adverse reaction was hidden by the drug maker and later forced to be included on all warning labels. But the highest court in the land ruled that the victim had no legal grounds to sue the corporation because its drugs are exempt from lawsuits.

Karen Bartlett vs. Mutual Pharmaceutical Company

In 2004, Karen Bartlett was prescribed the generic anti-inflammatory drug Sulindac, manufactured by Mutual Pharmaceutical, for her sore shoulder. Three weeks after taking the drug, Bartlett began suffering from a disease called, 'toxic epidermal necrolysis'. The condition is extremely painful and causes the victim's skin to peel off, exposing raw flesh in the same manner as a third degree burn victim.

Usurpation of the Legislature by the Courts

And the legislature just bows down to the "kings".

You can still sue the FDA for making a bad decision.

I predict this will end badly - maybe not this case, but a

future one for sure.

Those who make peacefull justice impossible in the face of clear injustice will ensure a violent reaction.

I predict that someone will be wronged by a "legal drug" will seek redress in the courts, be rebuffed under this ruling, and then resort to lethal violence against everyone involved including these and other justices on the wrong side of this and any other similar case.

It's a near certainty. Someone is going to snap.

When you remove ALL liability through peaceful means, justice will be had, the piper will be paid.

Note, that doesn't mean I'm calling for it or will do so myself, but only a naive fool would think it won't happen sooner or later.

This decision is a clear and present danger to the public safety in multiple ways.

Going Out of Business Sale! Court forces Its Own Liquidation!

Electronic Freedom Foundation
Recent court rulings have had unexpected side-effects on courts themselves. Mentally incompetent to rule, the courts have been recused... Disqualified from participation in decisions on grounds of prejudice or personal involvement. The courts, according to their own prior rulings, lack standing to rule against what ails themselves. Each court has become yet another barbaric relic.

In lieu of flowers, the victims which have lost their ability to sue may make donations to the Electronic Freedom Foundation. Recent donations to Electronic Freedom Foundation have provided:

I wrote to my senator, MARCO RUBIO, last summer about this

His response: "thank you for your interest in animal rights"

In just the last 3 years pharmaceutical corporations such as GlaxoSmithKline and Pfizer have been fined a staggering total of 11 billion dollars for criminal and unethical behaviour. The illegal practices have directly endangered the health and lives of patients and highlight the extent to which these global corporations will go to sell their somewhat dubious products. Of the 26 offending companies, 8 are in the top 10 pharmaceutical producers in the world.

another court decision that should get justices removed

from the court for nor being in "good standing" and obeying the constitution.

Contract your senators and congressman ask for these justice to be removed for not supporting the constitution. (equal protection under the law).

It's "Equal protection OF the law"

It is the law itself which is being protected, not any other entity. Without equal protection, we are no longer living under the rule of law, but the rule of men.

Undo what Wilson did

I hope she can refiled against the "Brand-name" company

since they developed the drug. This is a disgusting miscarriage of her rights to recompense.

She would lose, most likely because the brand name has the

It really is an irrelevancy if it does or not. As the ONLY literature given to her was for the actual generic taken. I'd sue the shit out of the pharmacy and the doctor for proscribing it and not informing her of the side-effect.

this comports with corporations are people?
