DHS at Internal Checkpoint breaks drivers' window, seizes all his stuff and doesn't charge him with anything

An incredibly odd video is making the rounds on youtube which reveals a violent act by CA Homeland Security Agents, who angrily bashed in a driver's car window and put him in cuffs after he invoked his 5th Amendment right. The video description states the incident took place in Pine Valley, California on May 31, 2013. In response to viewers questions, videographer Robert Trudell states he was cuffed for six hours, had no access to a toilet for nine hours, and had all of his property confiscated. They finally let him go with only his ID and credit cards, and he had to wait 21 days to get his video and camera equipment back.

All this and not even charged with any crime.

Trudell has 4,202 videos on his channel, many of them of internal border checkpoints, including the 20+ minute U.S. Border Patrol Checkpoint. Dateland, AZ Gas & Cameras, No Response to "Are you a US Citizen?"(41,804 views, posted Feb, 15 2013); the one minute condensed version What Country are you a Citizen of? US Border Patrol, No Consent Search, Right to Remain Silent and the 12 minute Border Patrol Checkpoint, Right to Remain Silent, US Route 95 Highway, Yuma, Arizona.

His website, titled "The USA Mexican Border Dance", features many of his videos and photographs. Trudell's car is elaborately riggged with mounted cameras and one photo taken from inside his car captured the dramatic shot of the border patrol busting out his window while he sits in the drivers seat. At first glance it isn't entirely clear what transpired in the window-breaking incident, but Trudell's replies to viewers questions tell more of the story. Trudell responds to one commenter by explaining "I didn't Consent to a Search and Remained Silent (well except for the "Hmm?" to understand his Order.)"

Even though I'm not surprised at all, I still am TOTALLY PISSED OFF BY THESE PIECES OF TOILET S$%T pulling such stunts.

One thing about the human body is that we all know it dies one day. Weather we are good or bad, no matter, we are all dead one day. Including these pieces of s%^t.

I DO believe in Gods Justice weather on earth or after physical death. I do believe we are MORE than these bodies we inhabit on a temporal basis.

At least it's comforting to know that these thug pieces of s%^t will too one day face death weather they want to or not.

Nobody can stop that. And sometimes that's my ONLY hope for the s$%t that people do to other people, all in the name of the State and it's unlawful power structure!

With all the un-constitutional crap going on, I'm wondering just what would happen if a Congressman or Senator submitted the Declaration of Independence , Bill of Rights, and Constitution of the United States ?
We would see just who is "With us or Against us."

I thought I could find a copy of the original draft as submitted:
"A Declaration by the Representatives of the United States of America, in General Congress assembled."

Its not there. I would think it would be near page one.

Well like I said it was just a passing thought.
From time to time I hear people bring up a Constitutional Convention. From what I know about it ,if one is called they are starting with a blank sheet. Everything would be on the chopping block. ( No Thank You ! )

Hey, does anyone feel safer

Hey, does anyone feel safer because of this?

On another note, just yesterday

I was getting off my bike right next to a border patrol agent who was getting out of his car. I joked.."BTW they are all standing on the corner at Rite Aid a few blocks down". He informed me that actually most of the migrant workers there are documented and then he noticed my OathKeepers sticker on my bike and asked if I was a member. I informed him that I am not but support that organization. He said he was looking to join. I gave him an OathKeepers card as I carry a few in my wallet.

A couple weeks ago my friend was pulled over by CHP for speeding. Before the trooper could say a word my friend said "Before we start I want to make sure that it is your intention to uphold my constitutional rights". The trooper responded "off course". My friend handed him an OathKeepers card and the trooper simply said "Have a nice day" and walked away.

The first rule of fight club is you do not talk about fight club. Liberty is spreading. Don't let videos like this get you down.

And you have to prove that you belong, and if you can't, they throw you in jail, in spite of the fact that you're a citizen, in your own country.

That these exist is another datapoint that indicates how very late the hour is.

there are sometimes border patrol checkpoints set up near the US/Mexico border but not exactly AT the border. They are sometimes miles away along freeway routes.

As a single event, it sure

As a single event, it sure looks bad for the DHS.

BUT, what led up to this and why does this guy have 4-5 cameras all trained on the driver's side? Either he's the unluckiest guy in the world, he's been harassed before without cause, or he's repeatedly doing something provocative to get something incendiary on camera. Which is it? A "normal" person does not have cameras all over the inside of their car.

Also, what happened in the 5-10 minutes prior to the beginning of the video? With so many agents standing around, surely SOMETHING happened beforehand and the driver/cameraman put a LOT of time into preparation for this exact event.

I think we need more (a lot more) information.

For arguments sake, even if the first ten minutes were edited to hide something, what do you imagine he could have possibly done to warrant an assault like that? I mean really, he got glass in the face. His eyes were covered but his mouth could have been open.

They had him pulled over at secondary, he wasn't going anywhere. If they wanted him out of the vehicle so much, why not chock the tires? he would have to come out sooner or later.

I see no reason for this behavior at all on the part of the border agents. It was a criminal act.

He didn't

appear to be acknowledging the officers at all.

We can't see what happened before the window smash so all we can do is speculate, but for probable cause an officer has to actually witness something that makes them suspect a crime may be (or has been) committed. If the officers are asking him to roll down the window, or otherwise try to engage him and he just ignores them then the officers can say based on that they had reasonable suspicion something was wrong. Once they have probable cause they can act.

If he cracked his window so he could hear officer instructions and acknowledge he could hear them and had no problem cooperating with what they needed to do short of violating his rights then the officers might not have proceeded as they did. This is speculation since we can't see what happened prior.

more information would be good. Why did we not see even a few seconds BEFORE the window was broken? The cameras only turned on at that point?

I do think this was overly aggressive behavior by the border patrol agents, but there is obviously more to the story with all those cameras set up in the car.

If he wants a confrontation based on Constitutional rights then it's pretty easy to get one as things are now.

He mentioned in a comment that the longer, unedited version can be seen at his website. I checked though and couldn't find it. I then clicked on some of his other videos and at least a couple of them were a huge waste of time (e.g. he films himself setting up his cameras for 5 minutes and that's the whole video). I don't know about this guy. If he's sincere, he should've edited the video to show the entire encounter. This just feels out-of-context. That said, if it turns out his story is 100% legit, I wouldn't be surprised.

Why does he have to narrate it with pictures when he supposedly has the whole video. I don't need his edited-with-pictures version of events. I want to see the video and make my own judgment. He could've had a little speech at the beginning about what we were about to see and then showed the actual, unedited video.

Sorry to tell you, but you are now in a new Normal.

People in Russia had NO dash cams 10 years ago, same with people in the US.

Now they are very common in both countries. It still amazes me how many people apologize for a corrupt government.

I have two friends that both defected from Russia years ago. They both tell me the only difference between the state propaganda in Russia and the USA, is the people in the USA still want to believe it.

Sorry, that has never happened to me and I don't have 10 cameras in my car. This driver was looking for attention and footage. No need to be daft about this particular case.

Drivers in Russia didn't have dash cams before because small affordable digital cameras are a recent development, which I hasten to add is a very good thing.
