Governor Mike Beebe Signs Arkansas Constitutional Carry Law

United States Constitution Amendment II -”A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”

For some positive news, look to Arkansas, which with Governor Mike Beebe’s signature and as of July 1st, has joined Arizona, Alaska, Vermont, and Wyoming in becoming one of the only constitutional carry states, an effort and list that 13 other states are also considering joining as the competition for freedom and gun manufacturers across the states heats up.

What is Constitutional Carry?

Constitutional carry is a legal situation within a state in which its residents are able to open carry or concealed carry guns without a permit or license. Constitutional carry is accompanied by a certain respect because of its legal proximity to the intentions of the Right to bear arms enumerated in the 2nd amendment, which has not authorized the barriers in gun ownership that currently exist in many states.

Before you get too excited, take a look at the Attorney General's opinion on the law.

He states, "Act 746 does not authorize “open carry.” This act does not, in other words, permit a person to possess a handgun outside of their vehicle or other mode of transportation while on a journey outside their county of residence."

A couple notes - His opinion is not law. However, it is an indication of how his office will react (read: prosecute) to the law. Also, he focuses on the "journey" aspect of the law. Nowhere does he address the addition of "attempt to unlawfully employ" to the code.

Unfortunately, I think the value of this law will be determined by the courts. And I don't plan on being first in line.

So if a state reciprocates with Arkansas...

does that mean an Arkansas resident can legally constitutional carry in that state?

No

reciprocity means they will recognize that states ccw/chp not the Constitution. Hilariously sad.
