Clearing up the confusion: Is the income tax voluntary?

Though it may seem confusing at first, the correct answer is: The federal income tax is voluntary, and if you volunteer, it is mandatory. Those Americans who voluntarily choose to work for the National Government as a career choice find that the federal income tax is mandatory due to the Legislative Intent of the 16th Amendment.

Those Americans who were born in one of the 50 states of the Union, to parents of which at least one of them was born in one of the 50 states, or those who were naturalized, must realize that the federal income tax for them is completely voluntary.

The truth has been obfuscated for many years by a government who is not only trying to protect its stream of revenue, but indeed growing an empire via military action with bases in over 120 countries.

I've been fighting the system for nearly 30 years

This statement is from my personal experience and the experiences of people that are closest to me.

Income tax is voluntary until you file your first 1040, then it becomes mandatory. Once you file, a Master File is created using your SSN. Once the Master File is created the IRS computers will be looking for a return from you every year thereafter. The signed 1040 is evidence that you indeed volunteered. That is why few (if any) win in IRS tax cases.

This is the honest truth. A few people that are the closest to me (4), who leaned this have not filed a tax return in over 25 years. Annually, they are asked to fill out a W4 form. They claim EXEMPT on both Federal and State withholding. These people have never been contacted or harassed by the IRS... Ever!

I have not figured out how to stop SS, medicare/medicaid withholding.

How this usually starts is when people get their first job. They ignorantly volunteer the withholding on the W4. At the end of the year, they see all of the cash that was stolen and want it back. But in order to get back a few hundred dollars they have to file for it. If they do, they are screwed.

Myself personally, I locked horns with the IRS a long time ago long after I had filed my first 1040. I withdrew from the Income Tax the wrong way. They came after me and I nearly lost everything. But I never gave up and refused to pay another dime. The IRS gave up on me after all of their liens expired (I had made myself (judgement proof)so they could never find anything else to steal from me. If you have skills where you do not need to be employed, you'll do just fine even if you have mistakenly volunteered.

What most people can't remember is when they volunteered.
It is a several step volunteer program just to be sure they have your consent to tax you.

Step 1 Beg for a Birth Certificate from the U.S. Government (democracy/communist state)
Step 2 Accept a "Certificate of Berth" instead of a certified copy of the birth record.
The birth record records you as a new State Citizen, heir to America, the "Certificate of Birth" is actually a death certificate which places your inheritance into a private trust set up by the vital statistics people as a side gig to make money off of you. If your Mother falls for this bait and switch and doesn't ask for the real birth record but accepts the public employees side scam then you just got probated (until challenged). The U.S. citizen is legally dead just like a military soldier and has "no lawful rights of any kind". By Accepting the Death Certificate the vital statistics officer sent your Mom she accepted citizen ship for you in the land of the dead (Washington D.C.) instead of in the land of the living, your country, like Iowa, or Kentucky (State Citizen).
Step 3 ACCIDENTALY sign up for a job as a Warranted Contracting Officer serving on a military supply vessel performing War Contracts for the military government. Social Security is this War Contract! It was created in 1938 to supply World War II which was well under way by then.
Step 4 ACCIDENTALY sign a codicile to your will on an Estate gift tax form. The 1040 is an Estate gift tax form. Look it up, section five IRS tax forms "Estate Gift Tax". Since your mother accepted a Death Certificate for you and Probated you ACCIDENTALY and you never undid that, all your property is in an Estate! So the first 1040 you sign shows your will for who the Estate Gifts will be going to! Of course you can gift the tax to yourself as soon as you are 18 if you weren't clueless.

So yeah, you got volunteered by Death Certificate and War Contract Supply Vessel (Social Security) then sealed the will with your signature on the 1040.
Best to get rid of the Social Security "Warranted Contracting Officer" job on a military Supply Vessel and get your Estate out of Probate by recovering the certified copy of birth record and returning the fraudulent death certificate concealed by the name "Certificate of Live Birth".

Like they changed the name of the War Department to Department of Defense they also pulled a fast one on you by sending your Mom a Death Certificate (Cerificate of Live Birth) for her baby instead of a certified copy of the birth record. So you got the New Deal, you are legally dead and are considered property of the State of United States (singular). Maybe your Mom didn't mean to volunteer you to be cannon fodder?
Maybe you should pipe up and ask for the certificate of life. Of course the vital statistics officer will ask for the Death Certificate back that was "ACCIDENTALY " sent to your Mom.

Clever, you were volunteered through deceit and our own ignorance.
If you want, it is easy to undoe. Just write to the vital statistics office and ask for a certified copy of birth record.
Of course they will ask for the fraudulent Death Certificate Back to conceal their crime.
Play dumb, don't challenge or accuse them of anything.
Then send the SS card back to the Department of Treasury and ask for a refund.

It is amazing simple to unvolunteer from U.S. citizenship (communism) and return to your native land's State Citizen status.
So what are you waiting for?

There may be some exceptions, but I think that is the general rule.

However, what if you do not have income? What if you are not a citizen? The minimum federal filling requirement is around $10,000, depending on one's sex, age, and marital status. By law, a one ounce silver eagle coin is $1, and a one ounce gold eagle coin is $50.

So, one could bring in ~10,000 oz of silver, and still have no income.

Anyway, that's how it was explained to me.

Income is voluntary. Social Security is voluntary. But if you do have income, and you are a citizen with a SS number, the tax is mandatory.


See strikeforce and cdistasio's post below, they are absolutely right.The income tax, as it is misapplied, is simply extortion against the american people.If a fourth of the people in this country stood up tomorrow and said we are done being extorted and will no longer pay things would change drastically. You want government to go back to it's proper role then the people need to stop funding it. Good luck finding enough jails to put all the non payors in or finding a jury to convict them. If brave people step up and say no the rest of the sheople will follow quickly. When they realize they can keep their money and won't go to jail the decision will be a no brainer. It is time for the young people in this country to take a stand and start this revolution against the government extortionists.

A couple items not mentioned, but relevant to any IRS post

First, the Income Tax was enacted to provide the US with a revenue source to help pay a specific debt. (And, also why public schools were created to free up 'Mom' from the kids - so she could join the work force ... and add to the IRS income. Sneaky Bastards)
So ... What debt, you may ask?
As detailed in the Grace Commission report ordered by President Reagan in '92;
A third of the individual income tax is wasted by inefficiencies of Government and to pay for the IRS bureaucracy. The report also stated a third is simply not collected due to the underground economy (in other words - cash sales, barters, etc). The later, of course, is projected since there is no way to truly document it without records.
The third that is left goes to ... What do you think?
Roads and bridges?
Schools, maybe?
Pay the degenerates in Congress?
Or, do they pay for the constant state of war the US Government has us in?
None of the above.
Bearing in mind, Corporate taxes are a different animal, as defined in the IRS Code. (And why GE only pays less than a 2% tax rate - Because they write the rules, people!)
Anyway ... drum roll !
Every penny left of our 'individual' income tax return goes to the IRS headquarters in Puerto Rico (A Territory belonging to The District of Columbia, NOT the USA; look it up) to pay the outstanding interest we owe the Federal Reserve for the money 'they print' for the US Government to use, calculated by the amount that is in circulation at the end of their 'fiscal year'. Which is, of course, April 15th.
Anyone remember a couple years ago when the date taxes were due was bumped to the 16th? If you read past the first sentence, it said it was due to a Puerto Rican national Holiday falling on the 15th. Didn't you wonder what the hell that had to do with the IRS's ability to collect the annual fleecing of the US work force?

There are folks who have fought the IRS and lost; big time.
However ... There are also many victories. Just not reported.
Gotta keep the throng from finding that chink in the armor.

Does anyone remember Joe Banister? He was an armed IRS enforcer and CPA who, during the seizing of a home for tax evasion, was asked by the homeowner, show me the law where it says I have to pay a percentage of my income to the US government.
After a concerted, investigative effort, even to the point of asking his superiors to guide him to the text that he thought must surely be documented somewhere, Joe could find no written law. IRS code, sure. But that is not law, that is an agency outside the jurisdiction of the three branches who writes it's own 'code' which is then 'approved' by a Congressional Committee.
He eventually quit, then the IRS tried to prosecute him with several income tax indictments as well as instructing others how to not pay the IRS.
Yeah, he won.
Look him up, interesting story, that.

I'm under duress just as anyone else on here is. No one can convince me that I personally and directly consented, with full knowledge and understanding of the terms of the contract, to enter into an agreement to allow myself to be income taxed. It never happened. Had I known and had full freedom to choose otherwise, I would never have entered into such agreement. And that's the only definition of voluntary that I find valid.

I was suckered in like almost everybody else around here, and it's too late to back out without serious pain. That's called duress.

Just another problem with any notion of limited constitutional government. It creates an impossible situation of no responsibility or accountability to provide any full and honest disclosure from people who established and ordained government or from government itself. It leads to an absurd thread like this 225+ years later where people can't even explain income tax, a concept dating back to the Civil War, when a plenary power to tax is a delegated power. It leads to absurd quoting of court opinions (I wonder why they are called that) stating income tax is to complex to understand when the principles behind how something is derived are not complicated. It leads to a society with an unproductive parasite class who call themselves attorneys and seek to create a plethora of positive obligations without any explanation of who they apply to or why. It creates a society of cowards who can't even admit the only reason they pursue an electoral course of action is because they are too afraid to resist unjust decrees by a government they claim to be their own.

When people say there is no law, are they talking about the IRS tax code, or the constitution? How is there no law saying we need to pay an income tax?
