"They Kidnapped Our Child": Why CPS Needs Transparency Now

I believe CPS abuses is one of the most important issues we need to be aware of, especially for those with children or who ever plan on having children or knowing any children. The CPS system is completely corrupt and any good family can be falsely accused and have their children removed and even adopted out on the most trivial accusation of abuse by an anonymous caller to the abuse hotline.

Mandated reporters are another strategic part of the system that funnels kids into state care. Mandated reporters are threatened by state fines to report the most mundane 'suspicion' without evidence or strong indication of abuse. Abuse in now a broad concept that includes neglect and emotional abuse. Such abuse under the law can include showing favoritism to one child over the other, having clothes on that are too small or for the wrong season, or verbally arguing with your spouse in front of your child. When the parent or child is questioned or your children are seized, There is no miranda rights, no jury , no attorney, no ability to face your accuser, no account of the allegations alleged, and no ability to counter the claims for most parents facing this outrageous process. People have more chance for justice and a judicious process in traffic court than what they will find in the courts where these cases take place. Many parents are bullied by CPS into signing case plans which may eventually terminate their parental rights to their children if the don't complete the demands of CPS which are often vague or impossible to comply with. It doesn't help that once a parent is branded with the ugly accusation of abuse they have a difficult time garnering sympathy, understanding, and support from others who might otherwise help them contest the allegations.

To me, CPS agencies are the thin edge of the wedge for government to gain a foothold into a parent's life and to dominate families and individuals into compliance. No one wants their kids held hostage and possibly taken into foster care or adopted out. Can you imagine having your kids taken under false pretexts and then convinced over time while in state custody that you abused them, maybe eventually forgetting you even existed or hating you by the time they are 18 and you may once again reunite? There are untold numbers of families facing this crisis. In the past it was mostly the underclass that was targeted but this has begun to seep into the middle class where some people have the resources and education to fight back.

There is a growing movement of families who are connected via the internet and are learning how to represent themselves to sue CPS. Unfortunately that is mostly the only option for parents because there are so few attorneys who have the interests or ability to challenge CPS and state laws. One attorney in CA, the one who handled Deanna Hardwick Fogarty who was featured in the Reason video has been at the forefront of these 4th and 14th amendment cases that are prevailing against CA counties, CPS, and the CPS, Police, and mandated reporters who are acting under color of law believing they have full immunity from prosecution. Let me just say that this is a very big deal and that I believe we are just now only seeing the tip of the iceberg in terms of the corruption and the legal aftermath that will come of this.

Yes, this is exactly what they are doing in every single one of these cases when they take children who are not in imminent danger and without a warrant. They violate the 4th and 14th amendment. To me it is actually worse than that because the CPS social workers are trusted by the courts and they actively make up evidence and hide exculpatory evidence all the while coercing the victim parents to give up their rights, and all without due process. The children are 6 x more likely to be abused, molested, or killed in state and foster care than they are in the home they are taken from.

I dont understand why people dont

charge these individuals acting under color of law we gotta file FEDERAL CRIMINAL charges against the "agents" in their private capacity because they are over stepping their delegated authority behind their agency (color of law) constituting a federal crime under the law that i listed.

Has anybody heard of a CPS employee going to jail for...

Mostly, like any other federal "agent" or police "officer", they seem to be immune from the law and punishment.

If there have been convictions, probably the verdict requires some type of secrecy of said verdict, so the word doesn't spread.

Very important questions. I am going to comment on this further a bit later since I have to run. Lets say I am glued to this topic and following what is going on here in CA because there is a small group of attorneys who have made inroads on successfully suing the counties, CPS and the immunized CPS employees. None have been criminally prosecuted (yet) but they have been financially/civilly penalized which is a step forward. I'll post more later as I think you guys will be as interested in following this as I am because it strikes at the heart of self ownership, Constitutional rights/violations, property rights, and more.

I dont know, most people file complaints the dont charge them as private indivduals like they do to us ! color of law means that they are pretending to be agents while acting outside of their agent capacity if you can prove that breach of trust or usurpation of power you will win, look at the first line of SS 242 it says claiminy ANY statute, it doesnt matter who they "think they are ' if you dont take the right avenue to get remedy you wont recieve it, if you file a complaint or something NO WAY if you charge them with criminal action under this statute in their full commercial liability and you can prove your case to a federal judge saying mr. john cps was acting like he was within his official capacity while violationg every law in the book they are using the law as an excuse to break the law

There should be local community non-government employee review groups formed every time a family is threatened to have their child taken. The review group should have the final say.

Yeah, he got the surgury. The parents now have CPS out of their lives and the CA CPS is getting audited by the state auditor. However don't hold your breath for any major changes to come of it. The auditor will likely put out a report, CPS will not change, and it will be business as usual. The most effective means to get policy changed is for the parental victims to sue CPS, the CPS social workers, and the municipalities. When enough of these suits prevail, the counties will have no choice but to reform policies and practices. In addition perhaps more legal talent will be cultivated when they realize there is $$$ to be gained in these cases. Fogarty got 10.8 M. Her attorney prevailed in several other high stake cases and has many more underway. There are only <8 other attorneys in all of CA that take on cases such as this and there is far more work than they can take on.
