Eviction

I've been renting a room from this lady for a couple years. There is no lease. Four months ago she said I should move out at the end of August, and I said that is unlikely because I cannot afford it. Even so, I said OK. Well, today she asked for my keys and said I have by the end of the day to get all of my belongings off of her property. Even though it's some verbal rental agreement, does she still not need to give me a written notice that gives me like 10 days to vacate? The PA law leans towards that she might be running a boarding home (even though I'm the only one paying rent here) and that requires zero notice nor a written notice.

If it makes a difference, today is the day rent is due.

Those who seem to lecture

Those who seem to lecture most about responsibility still have mommy and daddy to fall back on. They always have a place to stay rent-free without question if their lives fall apart. I've had to pay rent since I was in high school, so I have no safety net.

you clearly still feel you can ignore the wishes of your landlord because you are having a rough time. Sucks to be in that situation but you don't have the right to force your landlord to house you against her will.

That is the same as just showing up at a total strangers house and demanding that they make accomodations for you living there since you can't go anywhere else. What BS

she gave you fair notice to leave

she didn't need to give you more than 30 days. sounds like she is a nice person and you should abide by her wishes for you to leave. Legal or not if you have any sense of right and wrong you will leave immediately. At midnight tonight you will be occupying the property illegally since you have already been given notice to leave. As far as I'm concerned you are a despicable person for staying any longer than today. It is your own damn fault you did not take the time to find alternative housing. Now GET THE HELL OUT!

I don't care. I'm almost all packed to take it to a storage unit and then I will find a place to park and sleep in my car.

If you had been paying full rent timely.

Then in most states the landlord is required to give you a FULL month's notice.

I.e. If she wants you out, for example, 11:59pm Aug 31, she needed to tell you PRIOR TO Aug 1. IF she informed you after that you have the right to stay to the end of the FOLLOWING month provided the full rent is paid on time.

That's in most states.

Different Notices

In NC if you rent by the week, your only required to be given a 24hour notice...If you pay bi-weekly, 3 days....If its by the month then 2 weeks if your single..30 days if you have a family..unless the contract is up..in that case..back to 1 week...All notices must be mailed.. registered...

You made the least-bad choice.

Trying to "go legal" on your landlady would have made her your enemy. And it would have made YOU a person no landlord would want to rent to. Very soon you will be trying to rent another room, and when they ask where you've been living for the last two years, you can list her as a reference. Consider the alternative.

Either you are not being completely truthful (most likely) ...

or she has decided that she no wishes to be a landlord ...

or she just doesn't like you (least likely).

She is going to get her way eventually so you know what that means.

Here is what I think is most likely going on ...

You pay late and you're behind.

She has been accepting partial payments for a period of time ...

And now she is fed up.

Or ...

She is also having financial trouble and is having a hard time keeping the lights on and is trying to do you a favor.

I don't see any other alternatives with the info that you have provided.

You damage ... no room.

That is how it works.

Look, I have seen this thousands of times. Either she is doing you a favor because she is in financial straights or you are not paying rent on time and in full.

Those are really the overwhelming most likely reasons. That is how it works.

I've done it to people, and have known other landlords who have done the same, especially when the landlord is only renting out a room or two versus, say, an entire apartment building.

When you're basically living with/next to your landlord, personality clashes can and usually are a factor in how your average landlord is going to treat you.

edit: Ramicio, like another poster said, try craigslist if you haven't already. It's pretty much my go-to site besides the DP.

Check out Craigslist, this guy made a documentary on how he traveled across the country for a week with no money using craigslist.

Post an ad stating your situation and you need an extra room. Say you dont have much money but you can do chores/clean/reonovate whatever you need to for a few days to get your feet back on the ground. You will be suprised what opportunities may show up if you work for it.

Farm work

If you'd really like to pursue opportunities to work on a farm, a good time to have started looking would have been four months ago when you were given notice (and said okay) or even earlier. There are organizations that help with such things -- http://www.wwoof.net/ is one of them. Getting started investigating those options now might still be a good idea, probably not for the short term but thinking ahead to next year.

BTW, if you can barely cover expenses why in the world are you paying for cable TV and a monthly cell phone plan? Nobody needs cable TV. Libraries often have free computers. Tmobile has a prepaid cellphone plan that would let you have a phone for necessities (but no apps or interenet stuff) for under ten dollars a month. How much could you save if you cut your spending to the absolute minimum?

Then he is a guest that has overstayed his welcome.

It looks as if in PA she can go to the court and you get a 10

day extension. Then you appear in court to plead your case, and if the court rules to evict then you get another 10 days. The 20 days in question you will get rent free. Is there any way to put back enough cash in a month to find a 1 bedroom somewhere, or to get a bus ticket and get out of PA where there are more employment opportunities?

By law she must serve you with papers...

This is a thirty day extension, but if you are not out and she takes you to court, they will grant a 90 day free stay while you look for another place, in most circumstances.

I don't think that is correct.

He would have to estblish residency.

Sometimes jurisdictions allow financial related mail.

My guess is that he has none of that.

It does vary quite a bit between jurisdicitions and states.

He might have a sypathetic judge in an urban area, but he is going to have to get to court first which means he is going to have to go down to the court house and request a TRO or a Stay.

If he refuses, then the lady is going to call the sherriff. My guess is that the cop his going to put the hand cuffs on. But he/she may also walk away and tell the lady to get an eviction.

Cell phone is almost justified, but pre pay only.

Dude, it sounds like you have priority issues.

I'd even forget about internet and go to the library to get your fix until things turn around for you.

Are you in an urban area?

If so, go down to the YMCA and state your case. Most downtown Ys still operate a boarding house.

Are you a felon or a sexual predator? If so, I would do something to get arrested again (non violent of course since I am a pacifist). That might be your only means to get by if you fall into this catagory.
