Drudge Report.Com: Hill Battle Over War As Obama Backs Down!

Apparently Obama cares more about perceptions of his 'base' than originally thought. He is postponing the strikes, while still claiming (unConstitutionally, I might add) that he has the authority to strike. Discontent within his own party, as well as world-wide disapproval from allies in Europe to allies in the UN (Ban ki Moon) may also been influential in his most recent retreat.

These little arguments we have

regarding sections and subsections are irrelevant. It has become painfully obvious that the President regardless of party feels they have authority to do whatever the f**k they want to do.

The war powers act didn't authorize the Libyan war but no one cared (not people here...the politicians).

All we can do is hope for impeachment while we elect good people to office. Stay loud and strong and make them follow the law not because they want to follow the law but because it would be political suicide to NOT follow it.

The DC criminals are full up on Haliburton and Raytheon stocks. The bankers and the war machine (aka their bosses, we lost that title years ago) have to remove Assad to impose a FED bank and the petro dollar, just like they did in Libya.

The War Powers Act of 1973

The War Powers Act of 1973 would give Obama 90 days in Syria without congress' approval. After 60 days WITHOUT congresses' approval, he would be force to leave, and 30 days to do so. Putting it to congress, and getting their approval, would give him until he decides to end it, an open ended date that HE would decide. So if congress approves this could be a long drawn out kinda thing, ala Iraq, Afghanistan. If congress does not approve, he could still go in on his own for 90 days.

Wrong!

First, the Constitution is the supreme law of the land, it trumps ANY law Congress passes that is not consistent with it. The Constitution says the President is Commander in Chief of the Army and Navy WHEN CALLED INTO ACTUAL SERVICE by the United States. Congress is the body that calls them into service by Declaration of War.

Second, the War Powers Resolution does NOT say what you claim it does. It is found at 50 USC 1541 and says:

(c) Presidential executive power as Commander-in-Chief; limitation
The constitutional powers of the President as Commander-in-Chief to introduce United States Armed Forces into hostilities, or into situations where imminent involvement in hostilities is clearly indicated by the circumstances, are exercised only pursuant to
(1) a declaration of war,
(2) specific statutory authorization, or
(3) a national emergency created by attack upon the United States, its territories or possessions, or its armed forces.

The time periods you cited have to do with when reports have to be made. If there is no declaration or authorization, or if there is not an attack on the US, then the President has NO LAWFUL AUTHORITY FOR WAR.

Period.

50 USC 1544 (b)

(b) Termination of use of United States Armed Forces; exceptions; extension period

Within sixty calendar days after a report is submitted or is required to be submitted pursuant to section 1543 (a)(1) of this title, whichever is earlier, the President shall terminate any use of United States Armed Forces with respect to which such report was submitted (or required to be submitted), unless the Congress.

The President can send troops into foreign lands without reporting for 60 days. IF HE HAS NOT REPORTED FOR 60 DAYS HE MUST WITHDRAW. He IS required to submit a report, but he can continue on with doing so for 60 days, and THEN if he has not submitted a report he must withdraw. So if he thinks he can get the job done in 50 days, then he can do so, WITHOUT submitting the REQUIRED report, then on the 60th day, congress tells him to come home, but he has 30 days to do so.

The first section defines the scope of the act ...

The rest of the sections are written within the context of the overall scope. Sec. 1543 has to do with REPORTS, not POWERS. The reports are within the context of the SCOPE.

Any action the President does MUST be pursuant to (1) a declaration of war, (2) statutory authorization by Congress, or (3) in response to an attack upon the US or its military. If the President acts for one of those 3 reasons, THEN he must issue reports, and if he fails to do so, must withdraw.

The President has NO unilateral authority to engage in war without congressional approval, UNLESS it is a response to an attack. AND he must submit reports (although that part is probably unconstitutional, since the Constitution does not say anything about reports).

Anyone who claims otherwise is claiming that an act of Congress trumps the Constitution, which is impossible. The act, as written, is within the Constitution.

Regarless of its INTENT,

Regarless of its INTENT, REGARDLESS of 50 USC 1541 (C) (1), (2), (3), REGARDLESS of 1542... if you cannot read 50 USC 1541-1544 and see that the President can send forces into a foreign country for the purpose of military engagement for 60 days (actually 62 days) without reporting to congress, WITHOUT ANY REPERCUSSIONS to his own position, without so much as a slap on the wrist, then you cannot read the law.

YOU ARE CORRECT. THe president has no unilateral AUTHORITY do so such. But likewise, the War Powers Act of 1973 gives him the room to do so for 60 days with no one to answer to. The congress CAN direct him within those 60 days to bring forces home. Or, they can sit on their hands, as they always do, for 60 days.

If there is no action for the president to NOT do something, then he CAN do such.

That's really irrelevent to reality. The fact that presidents have been going into foreign nations for decades is reality.

What is relevant is that he is asking congresses' approval, meaning he may have intentions to stay longer than he is letting on. I rather see him just go in and be limited to 60 days, and 30 days for withdrawal, than to see congress approve it and give him unlimited time and at his own discretion of when he withdraws.
