JBS on Mark Levin's Dangerous Constitutional Convention Ideas

John Birch Society on Mark Levin's Dangerous Constitution Convention ideas.

It can be assured that any Constitutional Convention today, will not have anyone near the caliber of men such as the Founders;

Corporations, Unions, Bankers, Special Interests, attorneys, international powers, etc. await;

For Once you had agreed to remove the protections of the present Constitution, it would lay the citizen bare to these wolves of corruption that would tear the citizen's to pieces with their own definition of rights - i.e. replaced with "privileges" to these wolves own definition.

Read the Ratifying Conventions that define the Constitution and the Constitution so that you KNOW what it says and means.

The Constitution works if you obey its set limitations on the federal government. As clearly stated in this video, if the government and people do not follow the Laws of This Constitution, what makes you think the Government and people will follow the Laws of another.

Yes, conventions in 3/4 of the states ratifying

Makes an amendment. Congress does not even have to call a convention. And, they won't. If they were going to they would have done it in 1911 when 2/3 of the states applied.

Congress is not even counting the applications. There is a formal request in for the history from the clerk of congress.

Levin needs to know about preparatory amendment for Article V assuring the peoples definition of constitutional intent is used. In order to prepare and empower the people to do this, three amendments need to be made before a general convention. Then, time for the amendments to take effect needs to be provided. THEN America is ready, state by state to propose and ratify properly.

Preparatory Amendment:
1) End the abridging of free speech
2)Campaign finance reform
3)Secure the vote.

Can we stop doing all the things we are doing that we do not want to do while still doing what we need to do?

There are really very few talk show hosts if any that

There are really very few talk show hosts if any that understand, or are willing to correctly describe the Constitution;

Most preach blind nationalism and are neocons, and for giving "exclusive privileges" (Government Contracts, Grants etc.) to collectives - corporations etc. - so called "legal" government sanctioned price fixing cartels;

And then misnaming and selling them as free trade and free enterprise, when it is actually it is "Privileged trade" and "Privileged enterprise".

American Patriot Party

First formed in 2003 is a party that promotes the Original intent of the founders based upon Common Law principles, Declaration of independence and other Founders documents defining freedom.

If you read the APP Suggested Reading documents, you will find in the Virginia Ratifying Convention 6-16-1788, that change in our Constitution is only allowed "WITHIN" the Delegated Powers; (more below video)

Neither the Federal or state legislatures can arrogate NEW powers upon the federal government through the Ratifying or amendment process.

This is not what the ratifying or amendment process is for as is clearly presented by the Founders in the Convention:

Edmund Pendleton: "Mr. Chairman, this clause does "NOT" give Congress power to impede the operation of ANY PART of the Constitution,(N)or to make ANY REGULATION that may affect the interests of the citizens of the Union at large. But it gives them power over thelocal police of the place,..."

"...If they (federal legislature) should be about to pass a law in consequence of this clause, they must pursue some of the "DELEGATED powers", but can by "NO MEANS" depart from them,

(N)OR "ARROGATE" "ANY NEW" powers; for the PLAIN LANGUAGE of the clause is, to give them power to pass laws in order to give "effect" to the "DELEGATED" powers"....

"...I understand that clause as NOT going a "SINGLE STEP BEYOND" the "DELEGATED powers". What can it act upon? Some power given by this Constitution. If they should be about to pass a law in consequence of this clause, they must pursue some of the "DELEGATED powers",but can by "NO MEANS" depart from them,

(N)OR "ARROGATE" "ANY NEW" powers; for the PLAIN LANGUAGE of the clause is, to give them power to pass laws in order to give "EFFECT" to the "DELEGATED" powers"."

These processes are to check unseen powers against our freedoms so to remove them. Not as a means to arrogate new powers not delegated;

An example is changing "ENUMERATED" taxation a "delegated power, into a UN-ENUMERATED unlimited flat percentage tax, such as the income tax - which is an arrogated power expressly prohibited and unconstitutional no mater how many states ratify it. The Amendment is therefor Null and Void.

Enforcing it, or other powers outside the delegated powers, is a act of enforcing a "pretense of authority".

(on Video) JBS has some very good videos concerning freedom;

One is this three part video speech by Dwight D. Eisenhower's
Secretary of Agriculture, Ezra Taft Benson called "Stand up for Freedom"...shown above.

The other two parts are found at top right on the American Patriot Party.CC Main Page, top right.

I have also have posted all three here on the Daily Paul in another thread: http://www.dailypaul.com/298245/ezra-taft-benson-videos-stan...

The American Patriot Party

Seems to me, this is designed to appeal to the GOP fall out. Another third party.

Levin is worse than the others; he misuses the Constitution.

Beware of anyone who says that they support and follow the Constitution, and they trash Ron Paul.

110% right

The guy poses as the ALL knowing prophet of the Constitution. You could have a drinking game with 20 friends where every time Mark Levin say's "Constitution" a different person takes ONE shot and i guarantee you everybody would be dead from alcohol poisoning by the end of the show...

Yet....he is THE premiere Basher of Ron Paul. That tells me all i need to know, and I wish less people on this site would drink his cool-aide

The Constitutional convention

The Constitutional convention Levin is advocating, isnt your typical convention where everybody gathers in one place. States can amend the constitution and there's no actual convention. If 3/4 of the states simply pass an amendment, then it's law.

That is how I read it, too.

As it is, a whole bunch of amendments have been added using questionable methods, starting with the 14th and maybe even the 13th. Contesting the will of 38 states would bring all those other amendments to question, and that would just be messy. Better to just add the amendment. :-)

the constitution as it stands

the constitution as it stands right now is not adhered to and has some numerous flaws including a handful of things that need to go.

i would argue that yes there would be many horrible things that "common democracy" would probably allow into a new one .... but i wouldn't argue that we are at more peril than we were in the past ... the constitution was not put together by men that agreed on anything .. that's why it was abused from the very start. human beings were evil and stupid back then as they are evil and stupid today.

i think lysander spooner expressed this very well. if they are going to bleed us dry ... let them do it blatantly, openly, and quickly ... this way we can dissolve the union and form separate states of self respecting peoples.

a whole lot of the constitution can be fixed by fixing the wording in such a manner that it cannot be misinterpreted.

All paper money eventually returns to its real intrinsic value, zero. - Voltaire

This is why it important to read the Ratifying Conventions

The Constitution is not a stand alone document, the founders knew that the Ratifying conventions needed to be consulted because there are "general phrases" in the Constitution.

Here Thomas Jefferson and James Madison state this:

Thomas Jefferson, letter to William Johnson, June 12, 1823, The Complete Jefferson, p. 322.

"...On every question of "CONSTRUCTION", let us carry ourselves back to the time when the Constitution was adopted, recollect the spirit manifested
in the DEBATES (i.e. THE RATIFYING CONVENTIONS), and instead of trying what meaning may be squeezed out of the text, or invented against it,
conform to the "probable one" in which it was passed". "

Here is James Madison illustrating the dangers of going by the "General Phrases" of the Constitution;

Virginia Resolution 6-16-1788:
In FULL: http://www.americanpatriotparty.cc/candidates

"...That the General Assembly doth also express its DEEP REGRET, that a spirit has in sundry instances, been manifested by the federal government, to "enlarge its powers by FORCED constructions" of the constitutional charter which defines them;

and that implications have appeared of a "design" to "EXPOUND" certain >>>"GENERAL "PHRASES" (which having been copied from the very limited grant of power, in the former articles of confederation were the less liable to be misconstrued)

so as to destroy the meaning and effect, of the particular "ENUMERATION" which NECESSARILY EXPLAINS AND LIMITS THE GENERAL PHRASES;

and so as to consolidate the states by degrees, into ONE sovereignty (APP: i.e. ONE NATION - NO WHERE INTENDED), the obvious tendency and inevitable consequence of which would be, to >>>"TRANSFORM" the present "republican" system of the United States,

into "an absolute", or "at best" a "mixed" >>>"MONARCHY"." ...

-----

So when someone proudly states the have a copy of the Constitution in their pocket;

Say: "Yeah; But do you have a copy of the "Ratifying Conventions" that define the meaning of the "words and phrases" in the Constitution?"

You will find many if not all the questions asked today were asked and answered 200 years ago. They were very thorough:

Start with this Convention in Full: http://www.americanpatriotparty.cc/americanpatriotpartynewsl...

Links at bottom that page will bring you right into ALL the day to day Constitutional Ratifying conventions on Constitution.org website. All anyone has to do is click and read....

You will find there are few flaws; and it is mostly government simply not following and obeying the Constitution as it was intended that is creating the problems we are experiencing.

How can anyone argue with

How can anyone argue with Art's logic here? This has been my stance as well. Doesn't it make sense to try enforcing what we already have before scraping it or adding to it?

Individualism-
To be nobody but yourself in a world which is doing its best, night and day, to make you everybody else means to fight the hardest battle which any human being can fight; and never stop fighting.

I've said it time and time again here too

probably more than a year ago when people brought up con cons.

A Con con would be a special interest-lawyer-lobbyist-corporation fest nightmare, commandeered, run, and finalized by the same corrupt trash we have already running the country.

As Boehner said at the RNC convention: "The ayes have it."

It would be a liberty /freedom /rights catastrophe.

scawarren's picture

Yeah I believe a nightmare,

Yeah I believe a nightmare, for us anyway, is exactly what it would be.

.

They don't argue. It would expose their untenable positions.
Instead they ignore, omit, lie, obfuscate.
