Update: High School AP History Book Rewrites 2nd Amendment

It is our duty to stop stuff like this.

Guyer High School (and obviously several others) are complicit in attempting to condition students to interpret the 2nd Amendment in a clearly opposite manner in which it was intended. The 1st, 3rd, 4th, and 5th are also misinterpreted as several commenters below pointed out.

This textbook, currently being used by Guyer High School, is attempting to redefine the Second Amendment to impressionable young minds. Parents, you must speak up and demand action. Investigate your child's history book ASAP, and post more pictures in the comments below. Call your school and demand that revisionist history books like this are removed from the school district.

Textbook version: "The people have a right to keep and bear arms in a state militia."

Actual 2nd Amendment: "A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

Did you catch the sleight of hand?

A militia is a body of citizens enrolled for military service, and called out periodically for drill but serving full time only in emergencies. It's a common man army of citizens, NOT soldiers. The citizens are called up in emergencies to protect the free State.

The 2nd Amendment says that a militia is necessary to protect a free State, so in order to be able to have a militia, the citizens have a natural right to keep and bear arms and the government cannot infringe on that right.

The textbook version implies that we're only allowed to keep and bear arms if we're in a State militia, a clear misrepresentation of the 2nd Amendment.

Your Call to Action:

1. Call Guyer High School and tell the appropriate person something like the following:

"Hello, my name is _______________. I saw that your AP History course has issued a book titled, United States History: Preparing for the Advanced Placement Examination. In this book, on page 102, the definition provided for the Second Amendment is incorrect and seems to be suggesting that only members of a State Militia are allowed to keep and bear arms. Who made the decision to use this text book? I'd like them to issue a public statement on this book's attempt to redefine the 2nd Amendment and why they chose to use it. We would also like this issue to be discussed at the next school board meeting. Please include it on the official agenda."

Just got off the phone with Kim Stevenson, Admin to the Superintendent.

1. Board members will not address any speaking on an item that is not part of the official agenda.

2. A community member could not add an item to the agenda.

3. You must sign in at Kim's desk in order to speak. You can speak up to 2 times and for 3 minutes. If a large number of us are attending we can assign a person to be our spokesperson and they may possibly give that person extra time.

The state adopts the textbooks every couple of years. She advised that besides attending next week's board meeting that we also speak with Darrell Muncy, Director of Student Services or speak with someone in the curriculum department.

...I have noticed lately they've been ramping up the childhood propaganda machine in preparation for this generation of kids to move into adolescence.

Anybody else ifind it funny that in an advanced placement

book at the high school level they actually had to notate what "quarter" meant under the 3rd.

Wow - if that's advanced I would hate to see all the notations needed in standard versions.

Standard versions include pictographs, much like

comic strips (or like those safety info cards on airplanes), to convey the story!

It completely murders the Constitution, instead of verbatim copies of the Amendments the Author lists their own interpretations.
In particular the 2nd Amendment gets slaughtered.

The book version of the 2nd Amendment:
"The people have a right to keep and bear arms in a state militia."

The Actual 2nd Amendment:
"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."

SCOTUS interpretation of the 2nd via District of Columbia v. Heller, 554 U.S. 570 (2008) confirms the Second part of the 2nd is NOT dependent on the First part of the 2nd.
The individual right to bear arms is NOT dependent on being in the Militia.

If there is one issue that has suffered revisionism, there is likely more.
This book should be pulled and corrected or simply outright scrapped for recycling.

This Appears to be an Egregious Attempt to Deceive By Fraud

In order for a person to be charged with the crime of fraud the alleged act must meet 5 conditions:

1. A false statement of a material fact,
2. Knowledge on the part of the defendant the statement is untrue,
3. Intent on the part of the defendant to deceive the alleged victim,
4. Justifiable reliance by the alleged victim on the statement,
5. Injury to the alleged victim as a result.

1. Is the textbook 2nd amendment definition a false statement?

Yes, since in 2008 the U.S. Supreme Court ruled the operative clause, "the right of the people to keep and bear Arms, shall not be infringed." is not limited by the prefatory clause, "A well regulated Militia, being necessary to the security of a free State," (see: District of Columbia v Heller, at http://www.loc.gov/law/help/second-amendment.php ).

2. Did the publisher know the definition was untrue?

Yes, since constitutional cases concerning the 2nd amendment have captured the public's attention on a national level. Ignorance of the law is no excuse.

3. Did the publisher attempt to deceive the victim?

First, who is/are the victim(s)? An entire class of persons, that being impressionable students who rely on educational material presented in a formal public education system to be factual and accurate. The fact the actual definition of the 2nd amendment in the Bill of Rights was misconstrued in such a manner to deceive the victim (student) can not be explained away with arguments such as, "literary/political license" or "typographical error". American history textbooks are not fiction. They are scholarly works written whose sole purpose is to provide a foundation of knowledge based upon verifiable facts that have occurred in our country’s past. To distort such history is to deny the truth from an unsuspecting and vulnerable person.

4. Does the victim rely on the information to be truthful?

Yes, every time a student who refers to the text when tested by the education system and gives an answer citing verbatim what the falsity of the text declared.

5. What injury does the victim suffer?

The greatest injury of all is false knowledge pushed upon the youth of America. Whether it is the myth of Abraham Lincoln, the unconstitutional ratification of the 16th amendment or the IRS having the right to tax the American people not just on all forms of income but for any reason (Obamacare).

The flagrant lies repeatedly taught to our children can only be stopped when the American people take prudent and necessary steps to charge these purveyors of false historical revision with the crime of “educational fraud” in the judicial courts.

Looks like they rewrote them all.

I guess that's because even AP students can't read well enough to understand the language of the originals. That's F-ed up. Which edition of the NewSpeak dictionary are we up to now? How long until we're communicating by grunts?

It's super easy to give them a call and let them know how unacceptable this is. You don't have to be a dick, but be firm, and make it clear we won't stand for it.

It takes less than a minute. Let's make their phones ring off the hook. Let's force them to either buy real history books or hire a call floor.

Looks like they got #3 and #4 wrong as well.

#3 seems to be only a prohibition on quartering during peacetime, but the amendment CLEARLY states

No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.(emphasis mine)

#4 summary seems to imply that "reasonable" searches and seizures are allowed. And that technically is true, but they are ONLY reasonable if backed by a WARRANT. There is no such thing as a reasonable, but warrantless search or seizure, despite what Michael Hayden, the NSA, CIA, and FBI believe. It is the warrant that deems them reasonable, because in order to get a warrant an (allegedly) independent judge had to have been presented with EVIDENCE of probable cause of a commission of a crime. As well, the requirement to describe SPECIFIC places to search and SPECIFIC persons or things to seize is key to their reasonableness. It is entirely unreasonable to search just anything you want to, and seize anyone or anything you want. The search must be done with the purpose of gathering evidence for a particular crime, and ONLY evidence of that particular crime may be seized. (yes, some limited exceptions if they discover evidence of OTHER crimes not known about)

I'd bet a full reading of all of their "summaries" shows they got every one of them wrong.

I would go and read it at amazon but I refuse to download a 35 meg "Kindle Bundle" into my PC just to read it from my PC. I emailed them about this and they said they would consider a "lite" download for those that just want PC only access to buy and read a book. I am thinking I am not the only one so they are losing a lot of potential business over this issue.

There was only 1 trial eveheld where a jury actually heard all the evidence from this case and that was the civil case of King vs. Jowers (1999) where a jury came back less than 1 hour with a "guilty" verdict after hearing over a month of testimony. Jowers, and co-conspirators including the Memphis Police Department and the FBI were found guilty. Remember James Earl Ray was convinced to plead guilty so no evidence was ever presented back in the 1960's. Make sure your child's history book doesn't just feed them the government lie that Ray was the lone-assassin.

On a different note, I am glad to hear William Pepper, the King family lawyer for that 1999 case, appears to have plenty of evidence to open up the case and re-try Sirhan Sirhan for the murder of Robert Kennedy AND also just filed papers 2 weeks ago claiming CIA involvement in the murder of Mary Meyers, ex-wife on then CIA official Cord Meyer, one week after the Warren Commission Report was released. Mary visited JFK over 30 times in the White House in the month leading up to his murder and many have always believed she was taken out to silence her from coming forward with the story of what happened in Dallas almost 50 years ago.
