Why Roberts made the decision

He made the decision because he knew this issue would be back. Ginsberg wrote in her decision that it did not justify any civil liberties issues with the bill. Check out Bryant v Holder. It was dismissed prior to the decision because there was no mandate, however, Bryant v Holder brings up a single civil liberties issue: medical privacy. (Miss Gov Phil) Bryant filed the case on the grounds that it violates his constitutional right to medical privacy protected under Roe v Wade. In opinion, one of 2 things happens: Roe v Wade gets a whole lot weaker, or Obamacare goes down.

So much of the argument over Obamacare has been just that without bringing up Roe (Medical privacy was initially protected in Griswold v CT) Why do you think they plaintiffs argued in the initial case that it was a violation of the commerce clause? They didn't want to bring up Roe or Griswold. Griswold discusses that the state of CT broke the commerce clause by outlawing condoms, which effectively violated the medical privacy rights from people from other states, necessarily interfering with interstate commerce. The case was doomed from the start, because Congress has always had the power to regulate interstate commerce in such a way. However look back to campaign finance reform, that survived the initial round of SC cases, but it fell on a subsequent, more balanced case. When Bryant comes back, and I have confidence Roberts will allow it to, liberals on the court are going to have some very difficult decisions to make.

Very important post!

This provides the Constitutional grounds for refusal to participate in ACA.
WE are the only enforcers of the Constitution, and this is the time. Do not expect "them" to do it.
They can take all my belongings or throw me in jail, I will not participate, and this is the reason. The courts have no authority to write law! We must not go there.
