Open carrying property owner arrested after confronting a trespasser, footage erased but recovered

A man in Crawford County, Mich., was arrested and charged with felony assault with a deadly weapon on Sunday after he called authorities about a trespassing suspect on his property, his wife (Heather) tells TheBlaze. There are also serious allegations being made about officers demanding that video footage of the incident — taken by the man’s wife — be deleted.

Thomas Donald, a military veteran, was reportedly out hunting with his 11-year-old son and armed with an “unloaded” single-shot .410-gauge shotgun (his son chose to use a crossbow instead) when he confronted a man riding a dirt bike on his 10 acres of land. The man and his son then reportedly escorted the trespasser to the front of his property and told his wife, Heather, to call the Department of Natural Resources (DNR) to file a “recreational trespass.”

Heather says she turned to walk away from the officers, but put the cellphone on the railing of her front porch after she was threatened with obstruction of justice charges. The deputies then allegedly confiscated the phone temporarily, but returned it to her before they left.

Just a fyi, Open carry is 100% legal in Michigan, except for a few 'gun free zones' which if you have a concealed permit you can open carry (subjectively). However, the gun-hating legislators are starting to move to fill in that 'loophole' as they call it.

Granted, I don't know every county in our state... I was surprised to see it was located in the heart of upper lower peninsula.

I agree with what most of you are saying

I didn't see enough information in this post to personally believe execution would be appropriate but maybe I didn't get the full article.

It gets harder and harder to defend law enforcement these days but there is and always will be a handful of constitutional sheriffs and peace officers like myself who do this job for the right reason. I have found throughout my caterer that cops at least in Texas are inherently republican and so by default they claim to love the 2nd amendment. But I also feel that those same 2nd amendment lovers would be the first to show up at your door and confiscate your guns if the legislators told them to.

I know from experience that cops are engrained with the "us against them" mentality from early on in their careers. They weren't all born bad people they just got brain washed along the way. I found Ron Paul a couple years into my career in 2008 and it changed everything for me and the people around me who have been forced to listen to my teachings about the 4th amendment, drug raids, traffic stops, etc.

I have found over the past few years that a larger number of peace officers are waking up to what's going on. I have almost changed careers a few times because of my disgust over incidents like this that I read about and have personally seen myself. But I keep sticking around because of the fullfilment I get in being on the right side of the law when the opportunity presents itself.. Some of the newer guys run when they see me and my partner rolling up because they know they are about to get lectured on libertarianism and personal freedom. I try to teach them that when responding to a call for service they must side with whoever is constitutionally in the right and provide due process to whoever is in the wrong. And when it is unclear use common sense to problem solve. Always ask yourself before making an arrest or filing a charge, "how is my action going benefit my community as whole." Never consider how will it benefit the city council or my career.

There are those of us who are trying to fix the problem from within so don't start shooting just yet. You may hit one one of the good guys.. Keep filming! We see these videos too.. And most of us are apolled by what we see.

i think youve put your thumb on the cusp of a problem that i personally thinks NEEDS to change, if there is ever a hope for a peacable change, and that is how "law" enforcement is trained, in regards to, who trains, and WHO makes the decisions on picking those trainers, i mean, an open public database with jobs lost if falsified or manipulated kinda change, of the top of my head with no doubts room for improvement if not a much better way of doing it

In a few years. My chances of getting elected are slim though. The the county where I live and the next county over where I work are both in the bible belt of east Texas. Hard core republicans. The current Sheriffs and their predecessors ran on cleaning up the streets by heavy drug law enforcement. I couldn't stand in front of a group of voters with a straight face and discuss drug laws unless I was advocated repealing most of them.
I would be bood off stage in this town and my house would probably be subsequently raided. They might find my silver as a result and try to Rico Act me out of everything I own. lol.

I still want to be Sheriff so I can show people what they've been missing out on but it would be an uphill battle to get fairly elected.

I could see this being a tough nut to crack for you. Let us know if we can help if you do decide to run. I was going to post to your comment above, but both my Father and my Uncle left law Enforcement because they could no longer take pride in their association with fellow officers. They became embarrassed of what it had become and left with some dignity remaining.

I totally sypathize

With your dad and uncle and feel that way too. There are days when I feel ashamed for my affiliation. Ive driven home many days feeling dirty for having been present and unable to act in some situations. I too have almost walked away a few times and still consider it regularity.

Its just a bad situation.

Unfortunately I've divoted almost a decade to this business (yes I called it a business) as well as my education. I think I will take a long shot at running for Sheriff and truly being in a position to change everything for the citizens in my town and if that doesn't work I will walk away and try to start a business.

I commend your family for walking away on principle. Cop skills don't transfer very well to the private sector so it's not easy to walk away.

For wanting to make difference and change in the system. Hopefully many more are starting to feel as you do. At some point I hope others see the wrong in how the system truly works. Your statement concerning "Cop skills don't transfer very well to the private sector so it's not easy to walk away". A strange thing happened when my Dad and Uncle left, They are now the biggest advocates to fight the system against all odds of succeeding. They agree that the biggest difference could be made if Qualified and Absolute Immunities were abolished. I think they are on to something with this.

Similar happened to me last night.

I had to chase off three guys breaking into a couple of our outbuildings here. Knowing the layout like the back of my hand I creeped up on them in the dark. They had three flashlights and were just coming out of one building headed towards another. Knowing the cops were at least an hour away I decided there was no time for them to be any help. So I stood behind one building and bounced my voice off another to change the direction of the source of my voice and told them they were trespassing and had better leave NOW. Instantly their flashlights went out and they yelled back "Where are you?". I stayed silent for a few minutes and then yelled again LEAVE NOW! All I got back was "O.K. We are going". They knew they were a target in my sites and had no idea where I was so decided it was time to go. After coffee I have to go see what damage they did. Guess what? I went and got the plate number off the car first, So this may not yet be done this morning, lol.

It was just not worth the mess,lol. I am pretty sure I was the only one armed so I really did not want to shoot myself in the foot and be the only one going to jail. Already did this one time. A few well placed misses

In this county it is against the law to discharge a firearm at all unless you are at a certified range or hunting, What you are hunting is in season, you have a current license and the firearm "fits the game" you are hunting. It is even a crime to point a plastic gun at someone and scare them. If they had been the ones to call the police after I discharged a couple rounds, I would have gone to jail and been charged with attempted murder. Welcome to my current world, trust me it sucks. lol

The other night our Pomeranian was going apeshit over something in the yard. Normally it's a coyote. But I thought I heard footsteps in the gravel. I told the wife I was gonna check things out. I go outside towards the house (I'm caretaking a property that's for sale) and I hear voices on the deck. The lights are pointed towards me so I'm totally exposed. I decided to lob a mexican brick from the yard onto the metal roof, once it hit I gave them a
