Florida arrested and Prosecuted Homeschooling family who obeyed the letter of the law

A War on HomeSchooling

As a parent, you rest in knowing that you are the one to make choices for your children and your family. You have the unique ability to know your children better than anyone else and to manage your home in the way that best suits your family’s needs, beliefs and well being. This is a freedom that all parents should have, the freedom to raise their children in a safe, nurturing environment but this is a freedom that is currently being attacked in one family in Tallahassee, FL by the State of Florida.

On February 3, 2011, homeschooling parents Steve and Kristina Spell were approached by law enforcement at their home and told that they were under arrest. Shocked, they struggled to find childcare for their six children who stood scared and confused as they watch their parents apprehended by state officials. Kristina was eight months pregnant with her seventh child. They were given three hours to find childcare for the evening and then were told to turn themselves in. Otherwise, the police would return and forcefully remove them from their home. They were being charged with five counts of Compulsory Attendance Violation. In other words, they were being arrested for homeschooling.

Do the "officials" not know their own state laws?

“Home Education is a parent-directed educational option that satisfies the requirement for regular school attendance. Florida Laws protecting home education became effective in 1985. Parents have the freedom to determine their child’s educational path and the plan for reaching their goals. Students have the opportunity to explore and learn at their own pace, in any location or at any time. Home education students are able to enter institutions of higher learning and are eligible to participate in the Florida Bright Futures Scholarship Program. More than 60,000 students in approximately 42,000 families are in Home Education Programs throughout Florida.”

The law cannot make a wicked person virtuous…God’s grace alone can accomplish such a thing.
Ron Paul - The Revolution

Setting a good example is a far better way to spread ideals than through force of arms. Ron Paul

after over 20 years of homeschooling . . .

we're finally past the truancy laws.

We were lucky.

This is horrific. Is there any support for these people?

it's hard to be awake; it's easier to dream--

Ahh ...

the aroma of persecution. It is a constant reminder one does not need to feel sorry for a people who finally get to enjoy the fruits of a government they have sown. The harvest of tyranny is indeed plentiful as it continues to be reaped. Let the unjust scales of oppression fall upon every single last person without grace or mercy.

Remember, if you are outraged by this story contact your representatives and leave it to the professionals. Don't worry about doing anything else beyond bitching ... your turn will come soon enough.

gee, trolly, trolly reading is hard

From the article,

Kristina, the founder of a non-profit organization that rescues and restores victims of sexual trafficking, has continued her work and her homeschooling, in spite of blatant threats from the State of Florida to enroll her children in public school.

So yeah, the mom started a group to play offense on the worst form of tyranny. Perhaps she cut in on the governments operation and this is the retaliation. Remember the the state senator from Georgia who got iced investigating in this same area of vice.

Since WHEN is it "illegal" to homeschool??

Florida?? California??? Where?

This is outrageous & illegal for our government to do this to American citizens.

WHAT DIFFERENCE DOES IT MAKE----GIVING YOUR CHILDREN TO A "PRIVATE" SCHOOL FOR INSTRUCTION, such as a Catholic school, OR doing it yourself per the State guidelines in your home?

Answer--there is no difference, but if I were them, I'd send my kids to a Catholic school system. At least, they are better than the public system, and I don't think they can do a damn thing about it.

This is one of the most disgusting comments that I have

seen on this site in a long time.

That goes for you too

We'll hang together or we'll all hang separately...

How do you know what those people have sown or what they do for liberty?

Your comment strikes ma as pretty sanctimonious and blame-the-victimish.

That attitude doesn't much win friends for our shared cause.

Do you actually believe that

anyone is going to hang together?

Blame the victim? Who is ultimately responsible for any oppressive government demanded? Some small group of people in the dark corner of a room somewhere no one can name the names of that are pulling all of the strings?

I can however name the names of plenty of people who have hung separately ,.. no need to feed me any hang together BS because it is a conformist fairytale.

Anytime anyone gets a taste of the cake of tyranny that has been baked I celebrate because another person has gotten exactly what has been demanded and more than deserved. Show me a poll of people willing to risk life or property on behalf of freedom or liberty.

I can't wait till a currency or social security crisis so I can throw a party and really laugh at watching fools suffer who more than deserve it. Unfortunately that will likely never happen because some international organization will show up as a timely welcomed savior to alleviate the suffering of losing savings or fixed income.

So I will have to settle for second best which is watching tyranny enablers who said I don't need to worry because it can never happen to me get the crap beaten out of them by police, caged, or legally plundered.

When you consider the amount of suffering of a free, independent, and sovereign people who have demanded government take care of them and provide everything ... one can appreciate nature has a sense of justice by ensuring only what has been sown can be reaped.

Who am I to argue with nature or expect it is just to reap what has not been sown?

just another reason to join HSLDA

For $9/mo., you get an attorney on call. The article said they had legal fees and did not mention hslda. Hslda has a procedure for its members to follow should the state show up at your doorstep. First, don't let them in. Get all your kids to come to the door to show the Leo or social worker that they aren't emaciated, cigarette burned, etc. Meanwhile, call the hslda hotline and tell them you're contacting your lawyer. The lawyer on call will ask to speak to the official and explain the law to them. They almost always back down when they know you've already got muscle behind you. Highly recommend, especially if you have crazy, vindictive relatives.

I hate to be controversial, but HSLDA--

is a group of opportunists. Back in the days when home educators of all varieties were coming together to lobby for good homeschooling laws, it was almost universally decided that homeschooling should be a constitutional right. Politicians of most states were in agreement; it was even looking good for a federal mandate to protect he education.

The founders of hslda wouldn't join this lobby, and they've been making money off bad laws ever since.

About 10 years ago I read intensely about all of this and had all the names, etc.--
of everyone involved. I have forgotten the names, but these people supported bad laws in the beginning and have since made money off the injustice.

But, you are correct about not opening the door.

And you are always correct that it is unwise NOT to join HSLDA now--

I hear that

And even blogged with some of my issues with them here:

I hope they don't hold my opinions against me if I need their services.

Sounds like the NRA...

One of the comments on the article said the HSLDA would take the

case for free.

"It appears as though an

"It appears as though an estranged family member was seeking revenge on both Steve and Kristina and reported them to the Leon County School System, claiming that their children were being neglected and deprived of an education."

Family members acting as snitch?? :O The Italian mafia families have far better morals and ethics. The Government has become the common bully :(
