Biker Paralyzed in SUV Dispute Hires Allred as Scores Rally
Edwin Mieses Jr. suffered spinal injuries and broken legs in a confrontation between an SUV and a group of riders on the West Side Highway
On the same day 100 motorcyclists rallied near his Manhattan hospital, the biker who was run over during a dispute caught on camera between a group of riders and an SUV driver hired celebrity attorney Gloria Allred to represent him in a potential case against the man who mowed him down.

The family of Edwin Mieses Jr. announced Wednesday in a statement that they retained the media-savvy Los Angeles attorney who stars in a courtroom TV show and has represented clients in lawsuits against Michael Jackson, Arnold Schwarzenegger and former mayoral candidate Anthony Wiener.

Mieses broke his leg and suffered spinal injuries after he and a group of bikers clashed with a Range Rover on the West Side Highway Sunday. The altercation has drawn national attention since footage from a biker's helmet-mounted camera went viral, garnering nearly 6 million YouTube views.

"There's no hope for his back," his wife Dayana Mieses told reporters. "They crushed his spine. They broke it in two different places, so he will be forever, forever paralyzed."

Mieses' wife has said her husband was the victim in the confrontation, which ended in the beating of the Range Rover's driver. Wednesday night, bikers rallied outside of the upper Manhattan hospital where the 31-year-old is recovering.

"We're not savages, we're not animals," said one rider. "We're just average people that love to ride."

No one is innocent in this situation, everyone will need to be held responsible for their own actions, damage and injuries they have caused.

Putting that one aside, there are not a lot, but still way too many DPer's trying to justify these thugs on two wheels.

Watch the seven videos previously posted by Barracuda_Trader. Watch all seven of them before you try to justify these guys. They are nothing but a bunch of lawless thugs, who found trouble, and weren't prepared for, or counting on the driver of this SUV fighting back. One of them got fxxked royally for his stupidity, and rightfully so.


If you take into account that over 200 '911 calls' came in about these same bikers that day, you'd realize they were nothing but a bunch of troublemakers. HOW MUCH MORE DO YOU NEED??????

If these bikers were a bunch of Cops behaving in this fashion, NOT ONE PERSON here on the DP would have even attempted to justify such behavior.

I watched the video of the biker getting hit.

In my opinion he fully initiated the act of him getting himself hit and ran over. The driver had little to no choice. The driver of the SUV tried to slow down but the biker pulled a hard stop in front of him after swerving in front of him. In my opinion the SUV driver should not be charged and from what I have heard he isn't being.

Any motor vehicle...

Any motor vehicle driver/rider has the legal responsibility not to hit another vehicle from the rear. If he hits someone from the rear he is legally responsible for the accident. That is the law until it is changed. Your opinion if you like it or not like it does not change the law. Does "Failure to maintain a proper distance" sound familiar? I had someone stop short on me and I hit them. I was charged with the accident and given a ticket that very same thing. We are accountable for our own actions and not those of others. Saying "He made me do it" or "I had no choice" didn't go over when you were in school and it does not in court. When are you going to stop blaming the victim and start blaming the aggressor? There is a man that has been paralyzed, both legs broken and in a coma. He is the victim of being assaulted by a man in a 5000 lb SUV that deliberately drove over him. How much more clear does it have to be for you?

I have a "crotch rocket" ...really it's a Honda CBR 929RR.... And yes, I love to ride it.. but, I DON'T RIDE LIKE THESE IDIOTS... i respect others on the road and would never pick a fight with a SUV. I don't go into ONCOMING traffic like these douches do for fun and possibly endanger the lives of other in their cars. Not to mention, some of these guys were on Off Road Dirt Bikes....

The magic word "INTENTIONALLY " Thank you. Do think that the SUV driver " INTENTIONALLY" ran over the motorcyclist that was paralyzed, in a coma and with 2 broken legs? The way I saw it, the driver was at a complete stand still and then " INTENTIONALLY" accelerated over him. No from what I saw

The gang of 2 wheelers were screwing w traffic. I saw it as the intent was to cause accident with the car. Fault motorcyle and motorcycle gang. Let me ask you this if you were in that car with your family would you have felt threatened? Threatened enough to protect your family?

With good cause you can see what this gang of thugs did, draged him out of his car and nearly killed him.

Gangs are where cowards go to learn to be brave enough to be bullies of course with the backing of their fellow cowards.


First I would ...

First I would be smart enough not to get into a verbal confrontation or a power struggle with a group of motorcyclist. A couple of thumbs up, some smiles and some waves would have gone a long way to de-escanlte the situation. I would have slowly reduced my speed so that they would tire of me and they would go on.That would have been the smart thing to do. Showing fear or aggression to a stronger opponent is a sure way to be attacked. Starting a verbal confrontation no matter how right you are will only escalate the situation. You do not want to stir up a pack attack mentality instead you want to de-escalte and keep the lowest profile possible. Let me describe a real life situation that happened to me. I was walking in the woods and came across a pack of 6 or 8 dogs. I knew that I could not out run them or protect myself from an attack. I knelt down on one knee and patted my other and whistled and in a kind soft voice I called them to me. Since I did not present a danger to them and I did not show fear and run, they just left and did not attack me. I did the same thing with a black 200 lb Great Dane when I was in his yard as a process server. Controlling your fear and not letting your opponent see it will go a long way to your survival. I learned that many years ago as a martial artist. If you panic, show fear and attack a stronger opponent you will probably lose. Survival is mostly a strategy of the mind. I really hope you will take to heart what I have said and understand how valuable a strategy for survival can be. Go Ron Paul!!!!


I have always had some weird attraction to crazy peeps

If I am in a room with thousands of people by myself in a corner some crazy person will locate me and seek me out for confrontation. So I use those same tactics you have described above. The video shows this situation beyond that. So in retrospect I and others here are speculating as to guilt.

Also I have strong opposing feelings about any gang I have always been an individual who likes to avoid being in a group or gang.

I had a bad 15 year experience with the ultimate gang. US ARMY.

The accident was fully caused by the biker who purposefully caused the crash. I don't care what your pretend "law" argument states. The biker caused the accident and is being held responsible by being all busted up.

I don't care what your pretend law states, well it's not my pretend law, it is the law. When you hit someone from the rear, you are at fault. There is no doubt that the motorcyclist and the SUV driver both contributed to the situation. But... the law places the responsibility on the driver not to hit someone from the rear and place the fault on them. Do your research, my research is first hand experience from a similar situation. If there are any personal injury lawyers or people here that work for insurance companies that can verify or deny what I say would you please comment?

Looking at this from a civil liability, insurance perspective, the driver is at fault. I am sure the SUV's insurance carrier will set reserves at the policy limits and probably settle this claim ASAP. I think many here are looking at this from a self defense perspective and may be influenced by the stereotypical "out law biker" image portrayed by some motorcycle gangs and the media. Gloria Allred likes to take high profile cases, but I doubt she would take a case she was not reasonably confident of winning. I also doubt this will even get to court, the insurance company will make an offer, probably for the policy limits and Allred will take up to the customary 33% and it will be settled.

Now as far as criminal charges against the driver, it appears that the prosecutor is not charging the driver. That's his discretion, he may feel the drivers actions were in fact self defense or due to the overwhelming popular support the driver has, he may feel he couldn't get a conviction if he does bring this to trial.

Thank you, for your perspective. As far as criminal charges goes that situation can change with enough public pressure and then made to go away with a plea deal. It still sucks no matter what happens. It is easy to forget after all the legal wrangling is over, that a man will be paralyzed for the rest of his life. Does anyone deserve that over a verbal confrontation?

a) did the suv hit a biker and thus the rest of the biker's friends tried to attack the suv?
b) did the bikers try to attack the suv for some minimal reason, and then the driver of the SUV ran over the guy in question while trying to get away?

It seems like a little of both. The only thing that we know for sure is that both have a degree of responsibility in the situation. One man is a victim of a hit and run and is in a coma, paralyzed with both legs broken. Many people seem to blame the victim and or support vigilante justice. Sounds upside down doesn't it?

For one thing, even when the car was finally stopped no harm came to his wife and daughter. So that speaks for itself and lets the air that argument. You have got to stop watching those B grade "Biker Gang" movies from the 70's and 80's. They were so campy and melodramatic and so was your comment. I got a good laugh out of it. Your comment is straight out of the script from one of those movies. If I were your Dad I would probably tell you that you have a flair for writing fiction and possibly a career in that direction. I would also tell you to reread what you have written, capitalize your title and correct the grammar. Something like "Who does he think he is, Charles Bronson?". And do it before you submit it for others to read so you don't embarrass yourself. I don't quite understand your title and I have watched almost every Charles Bronson movie that has been made. First, the title...it was a line from the movie True Romance, Gary Oldman played a pimp with racial identity issues and very little regard for proper grammar. It seems you should have put that together considering those grammatical errors were glaringly absent in the post. Most people would have anyway. Second, those campy movies you are referring to, they have a basis in reality. As a lifenlong resident of NYC and having grown up in the most God awful ghettos in the Bronx during the koch and dinkins era I can assure you a healthy does scepticism and disbelief goes a long way in terms of self preservation in situations like this. Perhaps you have never been on the receiving end of a 15 person beat down, or subject to this sort of harassment because of your race but I can assure you this culture of violence still exists in nyc even as the police state has grown. I especially appreciate how you chose to attack what you thought were grammatical errors instead of addressing the issue that flight is inherent to human nature when one's family is in harm's way.

Since age 15 I have ridden bikes (I am now 61). For many of those years I rode, built and had a Harley shop. My life involved dealing with 1%er clubs (not biker gangs) repairing, building and selling Harley parts. I worked very hard to stay neutral. The fantasy that is presented in biker movies does not cover the reality. Most things are a total joke and Hollywood hype and some things in real life are best kept secret and never hit the movie screen. I did spend 2 years in The Guardian Angels with Curtis and Lisa Sliwa in New York, Virginia, Washington DC and Maryland. I was shot near or at 6 times and my patrol leader Unique King was stabbed with an ice pick in the kidney in one of the many scraps we had. I had my skull fractured and a concussion when 8 of us were attacked by 40 or 50 people. They were angry because we upset and interrupted their drug dealing. So do you want to have a pissing contest and compare scars and broken bones? I would probably win that one.
Yes, there are some really bad biker people and some that even scare me. The idiots in the video would not last 5 minuets with real bikers and I have seen it personally happen. They are a bunch of idiots that are showing off and pretending to be real bikers. I don't take them seriously and I just stay out of their way and I don't have any problems.
I understand the natural instinct of flight or fight, I have been there many times. But you are always responsible for your actions. If you knock someone out and they fall and crush their skull on the concrete it is called manslaughter or worse. If you run and put someone in a coma, paralyzed and with 2 broken legs you do not get a free pass by saying " I didn't mean to do it, I was afraid". You are responsible for your actions, and blaming the victim doesn't cut it.

Sounds like you are making up things like the MSM does all the time. When you make up things it brings into question the credibility of the rest of your statements. But you don't need me to say that, people can figure that out for themselves.
My situational awareness and training over all these years has brought me thru many situations that many people would not have lived thru. I have been to funerals of many of my contemporaries and that seems proof enough.
