IRS Won't Be Able To Collect Obamacare Tax

I don't believe I have seen this anywhere on here. The article is a bit old, so if they have changed something since then, tell us.

This is interesting, apparently the only possible way they can collect the fine for not having health care is for them to subtract it from your tax refund.

Knowing this, it wouldn't surprise me that many people stop having taxes automatically taken from their paycheck removing the governments ability to take their money completely and only giving what is 'owed'.

I think you are kidding yourself if you think you are immune from the irs. They will seize your property, your bank account or anything else they want to do.

Changing your exemptions sounds nice but

Couldn't they just subtract the ObamaCare fine from the gross taxes paid first, then say you underpaid on the rest of your taxes, for which you would normally be fined? I wouldn't put anything past them...

What about people who pay their taxes at the end of the year? The tax fine wouldn't be added to the amount owed?

If OBarryCare is successfully rolled out over the next few years

enforcement will morph, either by executive order or legislatively, into other necessities of life. For example, DMVs will have a cross check; if you haven't paid the "tax", no license til you do, no hospital admitting, etc. That may sound far fetched, but if we don't stop this insanity now, it is where we are heading.

I read in another discussion here at the DP that credit rating will be a factor in obamacare rates. Kind of seems like what you described, but for the benefit of bankers. Keep your credit rating high or we will penalize you with higher health insurance rates. Pay your obamacare premiums or we will take away your license. Etc, etc.

Wouldn't be surprised if they added having a license into the credit rating algorithms.

Wait a second.

Say you owe $1000 in fine for not signing up on insurance. It may be true that if you do not have a tax refund pending then the IRS cannot take further action or arrest you for not paying the fine.

But I read somewhere that this $1000 (plus interest) will be considered as taxes owed, for the next year, by the IRS and will be considered for auto-deduct from your pay or liable for IRS criminal proceedings if you fail to you. Can someone confirm if this is true?

"Taxes" are withheld, but since I am a CTC educated American, I know how to rebut the erroneous W2 sent to the IRS by a clerk who knows nothing but the legal fiction propounded by the IRS and the mostly ignorant population.

Is there a simple write-up for non-legal people to understand this 'escape' from taxes concept? Especially for someone who has already signed W-2 with the employers and for people who have no other choice apart from signing the W-2 to accept the job offer and start the job.

There is no "escape" from taxes. The I.R. Code is legal and it is constitutional. It is, however, mis-applied to cover earnings it was never intended to, and which the actual text verifies as excluded as taxable income.
Ask yourself: Is it a direct or indirect tax? Is it an excise tax or a capitation tax authorized by the 16th amendment? Are there standing supreme court cases that address these issues, (and that the IRS hopes you don't read.) Are "terms" different from "words" in the text of the law? What are custom definitions and why do they matter? How are the rules of statutory construction applied to the code?

If the clerk who sent the IRS a W2, swearing to information about the character of your property, cannot answer these questions, don't you think you should discover the truth, so that you can either verify it or rebut it?

does that mean he is wrong and the government is right? We all know the government never lies about anything except everything! As a friend of mine always says, "The government lies about everything and it even lies when the truth would serve it well." Reagan said "trust but verify" but now it should be "doubt until verified."

I guess my reluctance to comment is based

on the suspicion that Forbes is not a reliable news source. Tyrannical gov'ts can do some pretty bad things and I don't know how to extract truth from fiction in the media at this point. Ever since Forbes started buying Greek land for pennies on the dollar after Greece collapsed, I've just kind of thought the guy is a sleaze ball and I don't trust any of his publications. He's one of those armchair free market businessmen who points out the value of markets when its to his advantage but then is silent when he can make a buck off of other people's misfortune.
