If You Don't Know:

1. That the Internal Revenue Code, as written, probably excludes your earnings as taxable income.

2. That the internet has provided the population with a valuable learning tool, especially enabling citizens to discover the truth about government efforts to deceive them about Title 26, the I.R.C.

3. That the TERMS, "Employer", "Employee" and "Wages" are statutorily defined TERMS in the code, and for purposes of the income tax, have lost their everyday household meanings, and the custom definitions probably do not include you or your earnings.

4. That an uninformed clerk, accountant or H.R. manager, who is equally unschooled, declaring him or herself to be an "employer" and you to be an "employee" and your earnings to be "wages" sends the IRS a PROVABLY false information return, and you have the ability (and I posit THE DUTY) to correct the record using a form from IRS.gov.

5. That once you correct the record, rebut the erroneous information return, (W2, 1099) by filing a correct, lawful return, (the easiest return you have ever filed) The IRS is obligated by law to REFUND all withheld taxes, including social security and Medicaid.

6. That armed with this information, (easily obtained) YOU, acting in your own self interest, can do MORE to rein in big government, than any other "pis in the fan" exercise. (marching, flat tax, general strike, million moron march, etc.)

7.That for 10 years, thousands of INFORMED, SELF EDUCATED, Americans have been filing correctly, and gladly getting refund checks instead of PAYING a tax they do not owe, with NO ONE being prosecuted by the government. (Source: Pete Hendrickson. Note: Mr. Hendrickson was prosecuted, but the accuracy of his return was validated.)

So, like it says in the title, If you don't know these things, then you probably have been poking around the edges, but failing to get to the heart of the problem. The heart of the problem is BIG POWERFUL government, and the life's blood of big government is the ability to tax, unchecked by the people. WE have the ability to check that power if WE act INDIVIDUALLY, in our own self interest. (paradoxically, this becomes a collectivist effort, but isn't that how revolutions happen? From a rebel song:

So how can one man "sweep" like a mighty wave? Answer: He can't. But an idea can. It has happened before, and can happen again. Do your homework, and join the wave. WSHIELDS@COMCAST.NET

If you are NOT someone upon whom an internal revenue tax has been laid or imposed, you have ZERO business filing related "information returns."

Such returns are ONLY for "taxpayers" to file - not for "non-taxpayers" to file.

A "taxpayer" is someone upon whom an internal revenue tax has been levied or imposed.

Title 26 deals ONLY with "taxpayers." "Non-taxpayers" are entirely beyond its scope. You will not find anything in there for "non-taxpayers" to do or concerning them.

If you determine that law does not apply to your situation, then you shouldn't be filing ANY related information returns mandated in that law.

The act of filing itself, is a self-declaration, under penalty of perjury, that you believe that those laws and those taxes DO apply to you and that such taxes HAVE been imposed or levied upon you or your earnings.

I would seriously caution anyone reading this post to be VERY careful when reading #5 and caution the OP to put a very strong disclaimer if they want to leave #5 up there. The OP can be put in jail just for "advising" others to "file false and fraudulent returns."

You also put the entire DP site and its user base at risk because the IRS WILL if they feel the need, seize this site, the domain, the physical servers upon which it is hosted, etc.

They've done it countless times and there is little or no reason to believe if they feel it is a threat that they won't do so again.

You will not get a fair trial. You will not be allowed to tell your side to the media. The media will report everyone associated as "tax cheats" and "anti-government anarchists."

Avoiding a tax, and knowing what taxes apply to you and do not, is not illegal.

Filing and advising people to file "false information returns" is.

Perhaps you would care to defend your position by debating Mr. Hendrickson on my radio show this Monday evening. I can make that happen. If Mr Hendrickson is unable or declines, I will debate you myself.

This is from stuff I researched long ago. I've read the statutes and case law myself, but do not have copies at the ready.

However, I CAN provide you with a source for the material, someone who is much more well versed than I, and who originally pointed me in this direction.

I'm sure you've heard of him - Dave Champion.

You can find him on the web at davechampionshow.com.

He's even specifically discussed in the past where Mr. Hendrickson went wrong, and why he was eventually convicted. You can find those episodes in his archives near the dates when Mr. Hendrickson was in court.

Can you provide a legal citation or authority for this?
As one who is schooled in legal research, I find Hendrickson's treatise to be complete with citations and references to supporting supreme court cases, etc. If your statements regarding the tax are simply your opinion, fair enough. Please let us know.
I hope you are not making an assertion that I ever advised anyone to file a false return or suborned perjury. If you ARE making that accusation, please repeat it for the record, or kindly retract it.

#5 and #6 are pretty clear there. Perhaps you might re-word them

so as to be clear that you do not mean any particular person should take these actions.
You are clearly calling people in general, to action on these issues.

A simple disclaimer at the end would likely suffice. I see you haven't included one.

In spite of what #7 says, someone did go to prison for it

In fact the someone who served time for it was none other than Pete Hendrickson!

Accuracy of his return validated? Not so much. He was convicted for filing with false information and sentenced to 33 months. Released 6/13/2012.

As for the "NO ONE being prosecuted" part, go find his victories page and start googling for the names to see what happened next. Posting those things with complete identifying info -- even images of refund checks! -- is mystifying enough. But then leaving them up when it's easy to discover that after getting the IRS's attention that way, they no longer belong in the victory column? Huh.

I was pretty sure 'ole Pete had done some time for that and I was pretty sure the claim of his return being validated was bogus but I didn't have the time to go look it up when I made my post to include it.

Also, the practice of posting your check with your info online is about as dumb as someone committing a crime, filming it, and putting it on YouTube. Kind of like the knuckleheads who put up a picture or vid of themselves on Facebook smoking pot - not bright man, not bright at all.

I wonder if anyone ever did a "what happened to them" posting somewhere of Pete's minions.

I also doubt the OP has followed this path personally and been successful - so far.

I just don't understand these folks who buy into the magic bullet snake oil stuff.

See the 1909 Corporate Tax Act as that is where you find the

definition of "income" that was considered by the Supreme Court to be the constructive definition at the time the 16th was ratified.

I don't have the case cite handy, but I'm sure you could easily find it.

"Income" is thus not wages or salaries in general, and not "everything that comes in."

Neither can Congress define "income" in any law since the word appears in the 16th. The only definition possible is the one in the minds of the People at the time they adopted the 16th, and THAT definition has been determined to be the one in the 1909 act.
