I had quite a conversation with the Congressional aide for Bill Nelson, (D-FL)yesterday. I asked a few questions about its Constitutionality, which were essentially answered:
"If Roberts' ruling is that it was, than it was."
To which I responded, "I disagree, he sure didn't consider the commerce clause or original intent very seriously in that case. But I did agree with Chief Justice Roberts on one thing: If we can pass a law without even reading it, we can repeal repeal it as well."
Then I asked, "Why do businesses get a year delay of the penalties by executive fiat, but there is no delay of the individual mandate?" The staffer asked if I was asking a rhetorical question or was I truly serious! Tempted to say, "Serious as Hell!", I chose to stick to the topic, (as abominable as the individual mandate is, I wisely saw that this particular aide would not be likely to appreciate the irony.) So I simply said, "With the site being down, of course I'm serious!" The aide replied to me, "The individual mandate is what pays for the system!"
Shocked that the aide would actually be so honest with me, I fell momentarily silent. Then I asked, "I thought the Democratic Party was 'the party of the little guy', so why the break for the 'big business', and not us? Doesn't that seem rather thoughtless and counter productive?" He had no answer for that. I replied that when I could , I would find one of the few free market solutions left, such as a Medical Sharing Plan to stay within the bounds of my conscience .
Drudge report is reporting other problems with the site, in particular bad data, so I am confident it will assist in the delay of enforcement.
