Although he is permitting the subsidies to be sent out, U.S. District Judge Paul Freidman has also refused to dismiss a lawsuit challenging the legality of Obamacare subsidies distribution by the IRS. The IRS has been arguing for months that a legal challenge should be thrown out; the judge has rejected the arguments. He also appears to be ready to hear arguments, presented by four individuals and three employers, that the actual language in the Affordable Care Act bars the insurance subsidies.
