Man fired for aiding woman rejects Walmart offer to hire him back

(Reuters) - A Michigan man rejected an offer from Walmart Stores to rehire him after he was fired for helping a woman who was being attacked in the store parking lot during his meal break.

Kristopher Oswald, 30, who worked nights stocking shelves at a Walmart store in Hartland Township, located northwest of Detroit, said on Friday that he does not feel safe going back to work.

"I believe my job was only offered to me because of the negative publicity they received," Oswald said. "There is no way I can expect to walk in as if I was a new hire and everything would be OK."

Take the Job

I've been through something similar. I took the job back, and I don't regret it:

1. The person who made the decision to fire him, was most likely not as high up as the one who offered to hire him back. (I haven't read the story.) "Corporations" are not a single person, so unless the problem is systemic from bottom to top, you should never assume that the action taken is approved by all the individuals in the company. (I will never shop at Target again (since 2003) because their customer service policies are awful through and through, but a chashier or middle manager having a bad day is no reason to wash your hands of an entire chain of stores.)

2. Once they hire you back, due to fear of "wrongful termination" or lawsuit, you are safe. They can't easily fire you because it will be seen as a consequence of the original problem, and they'll still have the threat of a lawsuit to contend with. In other words, they now need real concrete evidence of wrongdoing or incompetence on your part to get rid of you for any reason. If "corporate" hires you back, no one below them can ever fire you, again (most likely).

3. When someone does the right thing, it should be rewarded. Apologies and corrections should be accepted. This is how you teach others to do the right thing: reward them when they do it.

I was fired so my supervisor could save face (i.e., for no good reason). Actually, I was asked to resign and refused, then I was fired, and then I wrote a 10 page, single spaced, letter to the Chairman of the company (cc: HR) telling him everything that was wrong with the company's management.

I was reinstated with back pay. I was given a different store to manage (when I asked my new supervisor if he wanted to interview me, first, he said, "No. I've read your letter."), and it became my second store to have to add square footage due to high sales. I was greeted warmly by the managers at my next manager's meeting--at which we discussed how not to fire people. I gave them another 18 months, was a top 10 store (of 300), and quit when managers were sent a memo from Corporate telling us how our desk drawers must be organized (they promptly went out of business).

In short, once you've had a documented dispute with your employer, and they offer you your job back, you are actually much more secure than you were before.

Any retaliation by someone at a low level should be reported to someone whose job it is to prevent the company from lawsuits and claims. One of the biggest advantages of big companies is that they have HR, loss prevention, and legal departments who know how important it is to be fair and jury-friendly in their dealings with employees. Of course, in my case, all they had was glowing reports on my competence, and no disciplinary actions or complaints, so they had nothing to support my supervisor's action. They didn't know me--I felt it was my job to prove that they did they right thing to reinstate me (with back pay).

Lesson learned: Never resign for an injust reason; make them fire you. Go to the person(s) most responsible for the interests of the whole company because it is their career and job description. Document everything you can. Don't assume that a corporation is anything other than a collection of individuals with a corporate culture--all of which varies.

I don't have a problem with Wal Mart terminating

The people have gotten a government they have demanded. The rules of the wise overlords elected by the people stipulate Wal Mart does not take on any liability by calling trained "professionals."

If I owned Wal Mart my policy would be call trained "professionals" or be fired because I don't need any further liability from a stupid people who elected/re-elected stupid politicians which enacted stupid rules.

that would fire you over that probably isn't a great work environment. He probably realized after being fired the crap he was living with everyday.

Sounds to me like he tried to do the right thing, got screwed by the store, and corporate is trying to make things right. I don't blame him for not wanting to work at that specific store but, I hope he finds a job.
