Texas Deputy Dies Performing No-Knock, No-Announce SWAT Raid For Marijuana

A Rude Awakening

Henry Goedrich Magee, 28, was awoken from a sound sleep at around 5:50 a.m. to the sound of his front door being broken down, footsteps, and loud explosions. The intrusion jolted Magee out of bed and he grabbed a rifle that was kept in the bedroom he shared with his pregnant girlfriend for protection. What transpired on the morning of December 19th, 2013, would be a life-changing event for all involved.

Magee, without a moment’s hesitation, took aim at the shadowy figures that had crashed into his home. His shots fatally struck one of them.

As the situation settled down it became evident that the people that had broken into the mobile home were police officers. Magee surrendered without further incident.

I dont see what everyone is raving about

an officer was shot dead, but that didnt stop law enforcement from arresting Henry and confiscating his legally-obtained firearms. Not only that but Henry is probably going to face life in prison for murdering an officer. The tyrannical states mission was accomplished, perhaps better than they intended.

The Grand Jury did not indict him on murder, if you read the entire article, but indicted him on the marijuana and having a weapon while in possession, a felony. They will push, and probably get, the ten year sentence, but his life will be over as he has known it. What a Shame. Does anyone want to start a fund for his defense on here?

He won't be tried for murder

Read the story all the way through. The grand jury refused to indict Magee for murder, though he's still facing drug and weapon charges that could put him in prison for 10 years. That's not much to cheer about, but it could have been much worse.

Maybe folks are cheering for the pig who got his just desserts.

However he shouldn't be charged for any crime, nor should his firearms be confiscated. Henry is looking at 10 years away from his family, and his free life. Thats a really Long time! Not to mention a Felony will appear on his record which means he pretty much better off dead.

ownership = authority. who owns you and your property? if the answer is "i do", then you have authority to protect your property anyway you see fit. "The right of the people to keep and bear arms shall not be infringed." armaments are used for offense and defense.

You also will be responsible for any resulting accidents that come of those defense items. Like, the mail person dying because they wanted to deliver you a letter and your claymore accidentally went off, etc.

It's shocking what country worship can do to your brain. This cop risked his, his men and the home-owners life merely because of some strange love and worship of country and it's tyrannical laws against drug usage.

A man smoking pot violates nobodies liberty. There's no victim, and therefore, there's no crime. But as soon as the cops come busting in we finally have a victim and as such, now we have a crime. The criminal is the cop, the crime is being perpetrated by the cops and the innocent person is the peaceful homeowner whose property and personal liberty have been violated. This homeowner's life has been ruined and not by drugs, but by these mindless cops who're obsessed with these tyrannical drug laws.

The cop broke at least three laws, deserved his fate.

Let's see, 1) breaking and entering, 2) failure to serve warrant, 3) enforcing a prohibition of marijuana which is essentially a crime against the US Constitution, 4) concussion explosives used and weapons drawn putting innocent lives in harms way.
I'd like to see what a lawyer would say about these police criminals.
It's good the shooter was not charged for the killing, and he should beat the drug rap, I hope.

The deputy who was killed actually requested the no-knock warrant based on the fact that he thought knocking during the day would be dangerous or futile...

It's insane that an informant, probably a drug addict thief, can say there were 12-15 marijuana plants and that is enough to raid someone's house. No investigation, no further evidence, just boom kick the door in.

At least they dropped the murder charge and now he's only facing 2-10 years in prison for possession of marijuana.

I don't like lives being lost

I don't like lives being lost but it is good this is happening, especially when we have people waking up and giving "Not Guilty" verdicts for people defending their homes. If cops start dying with no repercussion to the defender they will be forced to change their policy which is reminiscent of Stalin's regime.

Good for the homeowner, he refused to be a victim of a criminal or a tyrant.

Sgt. Sowders, age 31, had been a part of a SWAT team performing a no-knock raid to enforce prohibition laws. The noises that had startled Magee were the sounds of eight deputies detonating concussion grenades and breaching his front door — all without actually knocking or announcing themselves.

Sowders himself had requested that officers serve the warrant “without first knocking and announcing the presence and purpose of officers.” The reasoning, in Sowder’s own opinion, was that approaching Magee — who had no violent offenses on his record — by knocking on the door during daytime hours would be “dangerous, futile, or would inhibit the effective investigation.”

Look at the freakin' guy....

He was a special volunteer in the AV Room and ran the projector when he was in high school. He had his lunch money regularly confiscated and his bicycle seat tossed in the dumpster by "the cool people". After a youth spent listening to the monikers "Doofus" and, "Shit For Brains", of course he'd grow up wanting to change his paradigm and possibly seek revenge on the "Cool People".

He'd search for any possible way to gain power over others and what could be better than a uniform, a gun, and codification that would protect him anytime he got overzealous or out of control.

This job was FUN man! He got to use guns and yell at people and make them "get on the floor" where he could knee them in the back, or break stuff and, hit them with stuff.

Whadda great job. Of course he wouldn't want to have to simply knock on the door. What FUN would that be...
