N. Carolina Man Arrested for Drinking Iced Tea Offered 'Deal' by Prosecutors (3-26-14 Update)

by Kim Paxton

So, it’s a warm day, and you’re standing in a parking lot, drinking a refreshing can of iced tea.

Suddenly, a random dude walks up and demands your beverage. You show him that it is in fact iced tea and that you aren’t publicly intoxicated. He tells you to give him the can and you say no, figuring this stranger can get his own iced tea.

Incidentally, the random dude is a plainclothes police officer. Despite the fact that you’re drinking iced tea, you are flung to the ground and put in a chokehold, because we all know that folks just can’t be drinking iced tea all willy-nilly in a parking lot like that.

This is exactly what happened to rapper Christopher “Xstrav” Beatty, who was handcuffed and arrested by Officer Rick Libero of the Cumberland County Alcoholic Beverage Control Law Enforcement for drinking a can of Arizona iced tea in the parking lot of a liquor store in Fayetteville, North Carolina last April. Luckily for Beatty, a friend was right there, capturing the arrested on his camera. It’s also important to note that Officer Libero did NOT immediately identify himself as a police officer.

I'm an older guy and I don't

I'm an older guy and I don't like rap much but you know, most of the "rappers" I've met are aligned with the freedom movement for the most part. Yes, some of them are mistaken about handouts but really, who gets everything right? I like to think I do, but I bet you there's some out there who think I'm wrong about stuff. Look for common ground as it relates to liberty and go with that. We can all pretty much see that this charge is BS and needs to not only be dropped, but a strong apology and a change in police policy to reflect that...

Beware the cult of "government"...

my common ground is a one inch scar.

Discusting typical police action

The cop gives private property a new meaning. There was a time when a pig could not come onto private property like that and make claims of trespass.

Seems the owner of the property is the only person that could make trespass claims not a plain cloths liquor store cop.

Charges dropped.

Charges of trespassing and resisting were eventually dropped last September. According to his filmmaker buddy, Tino Brown, he also had no jail time.

I don't believe that is accurate.

The case is still active.

I hate cops, but I also hate

I hate cops, but I also hate wannabe "Thug Life" punks that look, dress, and act like they are just out of prison or headed there.

Pull your pants up! Don't hang out in parking lots! Don't act like you're a tough guy! Exude respect, don't demand it! And act your age!

Honestly speaking, I used to act very disrespectful and simiirlarly... when I was a teenager! Then I grew the fuck up! You have to grow up. You have to set a positive example in your community. It's freedom, not freedumb!

My vitriol is NOT just pointed at the urban community either. I look at these 40-year-old suburbanites too and shake my head with all their tattoo sleeves.

If you look at the USA society from the outside looking in, it looks like the majority of the population has either been in prison or is headed there.

By design, I dunno? Tell me....

I can see that liberty and freedom for all just dripping off your words.
That is,if they acted, talked, dressed and looked like you.

If we deny truth before your very eyes, then the rest of what we have to say,is of little consequence

Yes, a classic libertarian

Yes, a classic libertarian that believes in private property.

Your beliefs

lack conviction.
You see, clothes and people are private property, and you have a problem with any and all who do not conform to your own views on what "it" means.
This is your problem to solve
You sound exactly like the ones here who wanted and tried to force RP people
to shave, shower and dress NICE,you know, instead of letting people live the lives they want to live, and live it the way they want to live it
A classic libertarian? getting all up tight about tats and low lying pants is no the definition of libertarian,it is though,a sign of someone who is uptight, and want to look, talk, act and dress just like you.

If we deny truth before your very eyes, then the rest of what we have to say,is of little consequence

My belief is this: If you

My belief is this: If you want respect, you can't demand it, you need to earn it. Is Prison culture something to respect? Is evil something to mirror?

I have tattoos. And after living in Japan for over a decade, made me come to terms with how idiotic my tattoos really are and also that if you want respect and to be treated with dignity you have to earn it, you cannot demand it, and it's not given to you just because you think your tough.

Men who want to look "bad" or dangerous are not men who should be celebrated. They should be looked at like the sad creatures they are. They lack confidence, lack a moral compass, and they lack judgement. And like me, they will realize it later in life, and if they don't they are even worse off then they project themselves.

The US community is sick. It is rotten to the core. Even the police mirror the prison culture now. If we don't have some sort of renaissance soon, we will lose our souls, if we haven't lost them already.

pandas get respect for doing nothing and it disturbs me

You are very shallow.

To say the least. How dare someone have tattoos. Don't they all know that having tattoos means your a criminal and a generally bad person?

I have tattoos. I have 3 of

I have tattoos. I have 3 of them. I regret all of them. They're not ugly, actually well done, but I got my first one in 1988 and my last one in 1995. Point is, I grew up! I look back on that time and think how idiotic I must have been to get them. I thought I was cool and hip, but reality is I just destroyed my own body with symbols that mean little to nothing to me now.

This is why I laugh at all these idiots who run out in their 40's and get tattoos like some badge of honor! What have you done so wonderful in your pathetic life in Ohio or wherever you're from to deserve a permanent body badge??? Because you're the toughest guy at the bar? Or maybe because you own a Harley? ROFL!!!!

Sick, sick, morons.

Freedom to live

Why on Earth would you think everyone should conform to your standards? The whole point of supporting liberty is exactly to grant individuals the freedom to dress, speak, and act in any way they choose as long as they are not infringing on other people's liberty. Your perspective is completely warped. It basically sounds like something a neoconservative would say, not libertarian in the least.

Every culture expresses themselves through fashion in their own unique way. Just because you don't like or agree with how people dress, that does not mean that the gentlemen in this video in any way deserved to be harassed and arrested.

It is quite sad that people like you think they are supporting liberty (i.e. being present on this site), when in reality you are just perpetuating the same neoconservative judgments of people that are different from yourself.

bigsurjune has a point.

Bill Cosby has soundly chastised folks for saggy pants and other immature behavior. He told his audience that certain people need to grow up and get civilized. Cosby is right.

There's a big difference between

someone's choices causing you to not want to hang out with them and those choices being cause for stripping them of rights. At least I hope there is.

Defend Liberty!

Neither bigsurjune nor I are advocating

anyone being stripped of their civil rights.

wow that's ignorant.

Watch the video.

Why is it ignorant? In any

Why is it ignorant? In any other civilized society, this might happen, especially if you look a certain way or exude ignorance. The guy is on private property, not public.

Do you understand what private property is? Are you a true constitutionalist? Libertarian? Believer in Ron Paul?

Yeah, lots of societies

have sub-cultures that have associated dress and demeanor norms. So, all you need is another segment of the society to label those things as ignorant and their own ways as better and of course it could happen there, that's been happening since before civilization. I advocate that we strive for improving civilization by treating everyone with dignity.

Defend Liberty!

Dignity is not associated

Dignity is not associated with today's hiphop culture. Long gone are the days when Public Enemy had something to real to say. Now it's turned into prison cultural--a sick, demented, inhumane part of our Prison Nation that uses terms of endearment like bitch, nigga, murder, rape, and shank. This isn't even a culture, culture is meant to support life and growth, this is something all together very different.

I get it

You are advocating not treating people with dignity based on your judgement about what their dress and demeanor means to you. I'm advocating the opposite.

Defend Liberty!

No, you don't get it.

He is not advocating treating other folks poorly. He is advocating that people act civilized.

Don't forget the tattoos!

Apparently tattoos make you unqualified for respectful treatment also.

You must only be exposed to

You must only be exposed to the MSM's hiphop, which makes you sound ignorant. Kind of like if someone came on here and told us that their worldview is based on Fox and MSNBC.

Just the IDEA of Ron Paul

Just the IDEA of Ron Paul telling someone else how they should dress is extremely hilarious.

The private property owner did not ask the Stasi to investigate, let alone assault, his regular customer on HIS property. The assault was uninvited. Would you want an uninvited party to assault your paying customers?

I also find your use of "civilized" interesting. Is the "civilized" one the person telling others how to dress? Or is it the uninvited party assaulting a paying customer? Maybe the civilized ones are the people who killed those savage uncivilized native americans?

Was the off-duty cop hired or

Was the off-duty cop hired or not? If he was then STFU, if he wasn't then my bad.

He was not. You sound VERY

He was not. You sound VERY civilized by the way.

I've stood in parking lots before...

I don't know about you, but I have stood in parking lots with my friends before. Making some claim about 'private property' does not in any way justify the action of the police.

You are completely ignorant about respecting other people's culture and way of life. As long as they are not infringing on anyone's liberty, there is nothing wrong. Period.

People don't have to 'exude' anything in a free society. People can behave in any manner they choose (again as long as they don't infringe on the liberties of others). Until you realize this, I don't think you quite grasp what Libertarian means. It certainly does not mean pretending to be someone you are not in order to please ultra conservative individuals such as yourself. Your perspective is thus: "I don't think tattoos look classy, therefore anyone with tattoos is a thug and if they are arrested without reason, they had it coming." Or, "I don't think it is classy to wear your pants below your waist, therefore anyone that dresses in that manner can be arrested without cause, and that is fine." You do realize that what you are saying is that people should be arrested for dressing/acting/appearing in a manner that does not fit your 'ideal.'

That EXACT attitude is what the entire liberty movement is trying to break. I don't know why you are here, unless you are just trying to antagonize people on this site. If that is your aim, then you are succeeding. If your aim is to actually support individual liberty, then you are far from your mark. However, based on your responses, I suspect you are just a troll causing trouble on this site. If not, then you are seriously deluded.

All cultures are not equal, and not all cultures

are respectable. Some beliefs and cultures produce the opposite of liberty. Check out the book Life at the Bottom by Theodore Darymple.
